ORDER OF THE CABINET OF MINISTERS OF THE KYRGYZ REPUBLIC

For the purpose of implementation of the order of the President of the Kyrgyz Republic of January 21, 2025 No. 11, according to part 2 of article 4 of the Law of the Kyrgyz Republic "About public procurements", Item 31 of the Protocol on procedure for purchasing control of appendix No. 25 to the Agreement on the Eurasian Economic Union, Articles 13, the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic":

1. When implementing public procurements to establish withdrawal from national treatment of the goods coming from foreign states according to the list of the manufactured goods made in the territory of the Kyrgyz Republic and having the certificate of origin issued by authorized body according to appendix (further - the list).

2. Allow to participation in public procurements of producers of goods according to the list.

3. Determine that state bodies, state-financed organizations and public institutions financed from the republican budget of the Kyrgyz Republic the local government bodies financed from the local budget the organizations having special accounts and means of funds and also other legal entities created at the expense of public funds, means of state bodies or local government bodies perform shall buy the goods specified in the list by method from one source from domestic manufacturers within approved republican and local budgets.

3-1. Recommend to the state and municipal companies, and also economic societies in which authorized capital the share of the state constitutes 50 and more percent, when implementing purchases of goods to give priority of industrial output of domestic manufacturers and conduct it procurement by means of the direct conclusion of agreements in the cases and procedure provided by the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About approval of the Standard procedure for the organization and implementation of purchases by the state and municipal companies, economic societies where 50 and more percent of share in the authorized capital belong to the state, including their affiliated economic societies" of June 10, 2022 No. 301.

4. In case of lack of opportunity at producers of the Kyrgyz Republic to make the necessary technical specification, the characteristic or amount of the public procurements specified in the inventory when implementing the national treatment is applied to the goods coming from foreign states, delivered by foreign suppliers.

5. To the Ministry of Finance of the Kyrgyz Republic to carry out the necessary procedures connected with the notification of state members of the Eurasian Economic Union and Eurasian economic commission on establishment of withdrawal from national treatment in the field of public procurements, following from this order.

6. Recognize invalid:

1) the order of the Cabinet of Ministers of the Kyrgyz Republic of March 16, 2023 No. 112-r;

2) the order of the Cabinet of Ministers of the Kyrgyz Republic of April 25, 2023 No. 197-r;

3) the order of the Cabinet of Ministers of the Kyrgyz Republic of March 19, 2024 No. 103-r;

4) the order of the Cabinet of Ministers of the Kyrgyz Republic of August 1, 2024 No. 467-r;

5) the order of the Cabinet of Ministers of the Kyrgyz Republic of October 18, 2024 No. 656-r;

6) the order of the Cabinet of Ministers of the Kyrgyz Republic of October 31, 2024 No. 694-r;

7) the order of the Cabinet of Ministers of the Kyrgyz Republic of December 19, 2024 No. 812-r.

7. Control of execution of this order to assign to management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

8. This order becomes effective since March 17, 2025 and is effective within two years.
