About approval of the List of the documents and data necessary for customs clearance of goods according to the chosen customs regime

For the purpose of realization of provisions of the Customs code of the Russian Federation (Russian Federation Code, 2003, N 22, Art. 2066, N52 (p. I), the Art. 29) and according to Item 2 of the Presidential decree of the Russian Federation of May 11, 2006 N473 "Questions of the Federal Customs Service" (The Russian Federation Code, 2006, N 20, the Art. 2162), subitem 5.2.11 of the Regulations on the Federal Customs Service approved by the order of the Government of the Russian Federation of July 26, 2006 N459 (The Russian Federation Code, 2006, N 32, to the Art. 3569), I order:

1. Approve the enclosed List of the documents and data necessary for customs clearance of goods according to the chosen customs regime (further - the List).

2. Determine that:

in case of submission of copies of the documents necessary for customs clearance of the goods according to the chosen customs regime certified according to Item 7 of Article 63 of the Customs code of the Russian Federation, the customs authority has the right to check compliance of copies of documents to their originals. At the same time the official of customs authority performing transaction on customs clearance of goods on the copy of the document makes the entry "It Is Verified with the Original", signs and assures print of personal number seal. Originals of documents after comparison to the copy return to the customs applicant;

the documents necessary for customs clearance which will be used (without introduction of changes in them and amendments) in case of the subsequent declaration of goods, can be provided to customs authority once if the requirement about their representation is in accordance with the legislation of the Russian Federation not established in case of customs clearance in the form of originals (in this case documents shall be attached to one customs declaration). In case of submission of the following customs declarations of the data on such documents are included in the list of documents with indication of number of that customs declaration to which they were attached. At the same time documents shall be submitted in duplicate, one of which is put to the customs declaration, and another is used by customs authority in case of verification of the subsequent customs declarations;

the documents necessary for customs clearance, according to provisions of Item 8 of Article 63 and Item 1 of Article 124 of the Customs code of the Russian Federation can be provided in the form of electronic documents according to the procedure and in the cases established by other regulatory legal acts in the field of customs affairs.

3. To chiefs of customs in which region of activities the customs clearance of goods according to the chosen customs regime is performed, from coming into force of this order to provide carrying out customs transactions and customs procedures on customs clearance of goods according to the chosen customs regime in case of submission by persons of the documents and data specified in the List.

4. Consider invalid:

the order of the State Customs Committee of Russia of September 16, 2003 N1022 "About Approval of the List of the Documents and Data Necessary for Customs Clearance of Goods according to the Chosen Customs Regime" (it is registered by the Ministry of Justice of the Russian Federation 13.10. 2003, рег. N 5171);

the order of the State Customs Committee of Russia of November 12, 2003 N1275 "About modification and amendments in the order of the State Customs Committee of Russia of 16.09.2003 N1022" (it is registered by the Ministry of Justice of the Russian Federation 28.11.2003, рег. N 5285).

5. To impose control of execution of this order on the deputy manager of FCS of Russia V. M. Malinin.

This order becomes effective after 90 days from the date of its official publication.

The list of the documents and data necessary for customs clearance of goods according to the chosen customs regime

1. When placing goods, imported (imported) on customs area of the Russian Federation under the chosen customs regime (except for customs regime of the international customs transit), the following documents and data are submitted:

a) the documents confirming powers of persons on making of customs transactions;

b) the customs declaration in the form of the cargo customs declaration (CCD) completed according to rules of filling of GTD when declaring the foreign goods imported (imported) on customs area of the Russian Federation and (or) issued for free circulation and (or) in other forms * (1);

c) the documents in accordance with the legislation of the Russian Federation confirming legal capacity of persons, data on whom are specified in the customs declaration, on activities implementation in the territory of the Russian Federation (can treat such documents: constituent documents, certificate on accreditation of branch or representation of the foreign legal entity, passport * (2), certificate on state registration of the legal entity or certificate on state registration of a person as an individual entrepreneur);

e) business documents (the invoice (invoice), the pro forma bill (proforma invoice) to the agreement, other business and settlement documents, including the cash or sales receipt on purchase of goods in retail network, the documents confirming carrying out calculations with use as instrument of payment of securities * (3) - depending on conditions of calculations and others);

g) the agreement (including the amendments, agreements to it concerning the declared goods) or the agreement extract provided that it contains the data necessary for customs clearance if movement of goods through customs border of the Russian Federation or change of customs regime is made based on the agreement, and in case of making of unilateral external economic transactions - the documents expressing contents of such transactions;
