This resolution shifts the Delegated regulations (EU) 2023/2104 of the Commission of July 4, 2023 changing the Delegated regulations (EU) 2015/2402 regarding the approved control values of efficiency for separate production of electrical and heat energy, in pursuance of the Directive 2012/27/EU of the European parliament and Council, published in the Official magazine of the European Union of series L 2023/2104 of October 4, 2023 (CELEX: 32023R2104).

1. Approve Methodology of determination of the amounts of electric power made in the mode of highly effective cogeneration for certification by guarantees of origin it (is applied).

2. In the Order of the Government No. 297/2016 about approval of the control approved values of efficiency for separate production of electrical and heat energy (The official monitor of the Republic of Moldova, 2016, No. 68, of the Art. 336) to make the following changes:

3. In the Regulations on provision and payment of utility and not utilities approved by the Order of the Government No. 281/2024 (Official monitor of the Republic of Moldova, 2024, Art. No. 236-237, 482), with subsequent changes, to make the following changes:

3.1. in Item 2 to state the concept "the heated area of unit" of the following edition:

"the heated area of unit – the area of living rooms, kitchens and the area of other utility rooms;";

3.2. 2) and 6) of Item 9 to state subitems in the following edition:

"2) the owner/resident does not transfer the meter reading within more than two months in a row before check of counters by survey by the association/managing director or, depending on circumstances, the supplier/service provider/operator of services, and it does not sign the direct contract with the service provider who shall take readings of the measuring equipment, and water consumption for the first two months of non-presentation is determined on the basis of the average amount used within the last two months preceding the non-presentation period;";

"6) at least one of units of the measuring equipment established in unit does not work or has no valid certificate on initial, periodic metrological checking or on metrological checking after repair, and at the consumer the direct contract with the service provider to which duties providing consumers with the operational measuring equipment belongs is not signed;";

3.3. state Item 118 in the following edition:

"118. In case of the agreements signed directly with suppliers/service providers/operators of services and based on absence in unit more than 15 days owners/residents have the right to demand recalculation of payment for services which are not considered individually and on which invoices are written out on number of people in unit (drinking water, the sewerage, heat energy for water heating, export of waste, the electric power used for operation of elevators) or for which means of individual measurement for the purpose of scoping of the provided service are not established.

Recalculation of payment for the electric power used for operation of elevators is allowed only in case of absence in unit of all residents.

The application is submitted for recalculation within 15 days from the date of return to unit, is followed without fail by the confirmation issued by the administrator to associations/managing directors of condominium, and other documents supporting absence in unit, such as:

a) the proof of temporary stay outside the country, in hotel, medical and sanatorium organization, medical institution, in rest house or other similar organizations;

b) the information issued by body of local public authority, confirming temporary residence in other administrative and territorial unit;

c) the proof of finding of children on study or on vacation in the period of vacation in other settlement;

d) the statement from sentence of degree of jurisdiction or the reference issued by penal institution on imprisonment of this person;

e) the reference issued by military unit or military and administrative commissariat.

If the proving documents are constituted not in Romanian, their transfer is represented, and in case of submission of copies the owner/resident submits the declaration under the personal liability on acceptance on himself to responsibility for reliability and compliance of the filed documents.

At the request of the administrator of the association/managing director/supplier / service provider / operator of services, the owner/resident shall provide originals of documents for check of their authenticity (in case of physical submission of documents) or the scanned version of the original (in case of the request for recalculation of payment by means of electronic means).

15-day term is preclusive term, and the applications submitted after its expiration will not be taken into account for recalculation of payments.";

3.4. to add Item 121 after the word "payments" with the text", including in case of absence of the owner/resident,";

3.5. state Item 134 in the following edition:

"134. In case of the statement of the wrong invoice on payment the consumer has the right to demand recalculation of payments till 6 months from the date of the statement of the corresponding invoice, and the service provider shall make recalculation. Recalculation is made including in case of mistake as a result of the wrong transfer or non-presentation of settlement indicators provided that the measuring equipment in the corresponding unit is sealed up, functions according to technical requirements, and on it there is the valid certificate on metrological checking. Recalculation on this basis is made once each 6 months.";

3.6. in appendix No. 3:

3.6.1. add Item 7 with the text", except as specified, when networks of internal distributive system pass through unit floor";

3.6.2. in Item 8-1 of the word of "the current year" shall be replaced with words "years of the beginning of heating season";

3.6.3. in the subitem 2) Item 30:

3.6.3.1. in formulas (2-3) and (to replace 2-4) text of "0,9232" with the text of "0,0092";

3.6.3.2. in formula ("-0,056" to replace 2-4) text with the text "-0,065";

3.6.4. in the subitem 2) Item 32 in formulas (3-3) and (to replace 3-4) text of "4,2928" with the text of "0,0525";

3.6.5. in the subitem 2) Item 33 in formulas (3-7) and (to replace 3-8) text of "6,8458" with the text of "0,1322";

3.6.6. add Item 36 with the offer of the following content:

"In case of passing of uninsulated internal thermal networks through staircase and if on certain floors they are fenced by installation of doors, the staircase is considered not heated.";

3.6.7. add Item 38 with the offer of the following content:

"If the cellar is privatized or is completely used according to agreements, the share of heat energy which is the share of the cellar is not calculated in the course of distribution and inclusion in the invoice of heat energy of the apartment house, and is distributed to exclusively corresponding unit.".

4. For the purpose of certification by guarantees of origin of the electric power made in the mode of highly effective cogeneration to National regulation agency in power to make changes to the regulating regulations according to this resolution.

Methodology of determination of the amounts of electric power made in the mode of highly effective cogeneration

I. General provisions

1. The methodology of determination of the amounts of electric power made in the mode of highly effective cogeneration shifts the Decision 2008/952/EU Commissions of November 19, 2008 providing detailed approximate instructions for execution of appendix II to the Directive 2004/8/EU of the European parliament and Council, published in the Official magazine of the European Union of series L 338 of December 17, 2008 (CELEX: 32008D0952).

2. The methodology of determination of the amounts of electric power made in the mode of highly effective cogeneration (further – Methodology), regulates procedure for determination of the electric power made in the mode of highly effective cogeneration, and also economy of primary energy in case of production of electrical and heat energy in the mode of highly effective cogeneration for certification by origin guarantees.

Provisions of Methodology are applied by National regulation agency in power (further – NARE) and the producers of electrical and heat energy in the cogeneration mode owning cogeneration units from one of the following technologies:

a) the cycle combined with the gas turbine with recuperation of heat energy;

b) the steam turbine with counter-pressure;

c) the condensation steam turbine (it is exclusive with heating and/or industrial selection);

d) the gas turbine with recuperation of heat energy;

e) internal combustion engine;

f) microturbines;

g) engines of Stirlinga;

h) fuel elements;

i) steam engines;

j) Renkin's cycles for organic liquids;

k) any other type of technology of the combined production of electrical and heat energy.

3. The electric power made in the mode of highly effective cogeneration by cogeneration unit is determined on the basis of the operational data obtained by the corresponding unit during the period for which origin guarantees are requested.

4. The origin of the electric power made in the mode of highly effective cogeneration is confirmed by the guarantee of origin issued according to Regulations on guarantee of origin of the electric power made in the mode of highly effective cogeneration, the approved Resolution of the NARE Administrative board No. 201/2017.

5. Production of electricity by cogeneration unit is considered the electric power made in the mode of highly effective cogeneration which can obtain origin guarantees in case of its compliance to the conditions provided in appendices No. 1 and No. 2 to the Law No. 92/2014 on heat energy and promotion of cogeneration (further – the Law No. 92/2014).

6. The electric power made in the cogeneration mode is calculated according to the following stages:

6.1. stage 1. Determination of general efficiency of cogeneration unit;

6.2. stage 2. Determination of energy production in the cogeneration mode in case of accomplishment of condition of Item 7 and observance of condition of Item 2 of appendix No. 2 to the Law No. 92/2014;

6.3. stage 3. Determination of energy production in the cogeneration mode in case of failure of consideration of Item 7 and observance of condition of Item 2 of appendix No. 2 to the Law No. 92/2014;

6.4. stage 4. Determination of ratio by default electrical and heat energy, made in the cogeneration mode;

6.5. stage 5. Determination of the electric power made in the mode of highly effective cogeneration and amount of electric power which can obtain origin guarantees.

II. Determination of general efficiency of cogeneration units

7. For each cogeneration unit of k included in the production Configuration in the cogeneration mode, overall effectiveness is determined by formula:

EEK – the electric power made by cogeneration unit of k of the Configuration during the period for which origin guarantees are requested [MW · w];

ETK – the useful heat energy made by cogeneration unit of k of the Configuration during the period for which origin guarantees are requested [MW · w];

Vk, i – the energy included in fuel, determined on the basis of the lowest heat of combustion, consumed by cogeneration unit of Configuration k during the period for which origin guarantees are requested [MW · w].

8. For each cogeneration unit of k included in the production Configuration in the cogeneration mode performance indicators of production of electrical and heat energyФ.13, respectivelyФ.14, are determined by formula:

III. Determination of the electric power made in the cogeneration mode

9. Production of electricity of cogeneration unit of k included in the production Configuration in the mode of cogeneration which is estimated as the electric power made in the cogeneration mode Ф.15is determined as follows:  

a) in case of cogeneration units for which the value of overall effectiveness determined according to Item 7, corresponds to condition of Item 2 of appendix No. 2 to the Law No. 92/2014:

b) in case of cogeneration units for which the value of overall effectiveness determined according to Item 7, does not correspond to condition of Item 2 of appendix No. 2 to the Law No. 92/2014:

where:

Ck – the actual value of ratio electric energy / heat energy corresponding to cogeneration unit of the Configuration in case of availability of newer data on operation of units of the this Configuration in the mode of the maximum cogeneration. In justified cases when the producer could not determine it, temporarily, before elimination of this discrepancy, the Ck value equal to the minimum value is accepted in calculations from:

i) average value of the ratio of C calculated on the basis of data on production of electricity and deliveries of heat energy from cogeneration unit of k to working hours in case of the greatest thermal loadings and in case of the minimum expense of the taken-away (thrown-out) heat at condensers/cooling systems, and

ii) preset value of the ratio of C chosen depending on circumstances, from the values provided in Item 15, proceeding from the type of cogeneration technology used by k unit or according to Item 16.

10. In case of cogeneration units of k included in the production Configuration in the cogeneration mode for which the value of overall effectiveness determined according to Item 7, does not correspond to condition of Item 2 of appendix No. 2 to the Law No. 92/2014, production efficiency of the electric power which cannot be estimated as made in the cogeneration modeФ.16, it is determined as follows:  

a) for the cogeneration units which do not have the condensation steam turbine:

where:

 Ф.17 – the production efficiency in the condensation mode corresponding to cogeneration unit of k of the Configuration which contains the condensation steam turbine. ValueФ.17 is determined on the basis of operational data or measurements of performance indicators during the work of unit in the mode of the maximum condensation.

In justified cases when the producer cannot determine it, temporarily, before elimination of this discrepancy, value is taken into consideration,Ф.18 can be calculated on the basis of the consumer characteristics included in documentation on registration.  

11. For each cogeneration unit of k included in the Configuration of production of electrical and heat energy in the cogeneration mode, fuel consumption connected with production of electrical and heat energy in the cogeneration modeФ.19, is determined as follows:

12. For each cogeneration unit of k of the cogeneration included in the production Configuration in the mode, new performance indicators of production of electrical and heat energy in the cogeneration mode,Ф.20 are determined as follows:

13. Value of overall effectiveness of production of electrical and heat energy in the mode of cogeneration of unit of k of the Configuration makes:

IV. Determination of ratio by default electrical and heat energy, made in the cogeneration mode

14. If "the actual ratio of electrical and heat energy" of cogeneration unit is not known, the operator of power plant can use "ratio by default of electrical and heat energy".

15. Values by default ratios electric energy / heat energy following:

15.1. for cogeneration units with the cycle combined with the gas turbine with recuperation of heat energy, C = 0,95;

15.2. for cogeneration units with the steam turbine with counter-pressure, C = 0,45;

15.3. for cogeneration units with the condensation steam turbine (it is exclusive with heating and/or industrial selection), C = 0,45;

15.4. for cogeneration units with the gas turbine, with recuperation of heat energy, C = 0,55;

15.5. for cogeneration units with the internal combustion engine, C = 0,75.

16. For the cogeneration units which are in the first year of operation or at the intermediate stages of expansion/development, project values (determined on the basis of project data) the ratios electric energy / heat energy can be considered as preset values.

V. Determination of the electric power made in the mode of highly effective cogeneration, and economy of primary energy in case of production of electrical and heat energy in the mode of highly effective cogeneration

17. For each cogeneration unit of the cogeneration included in the production Configuration in the mode, economy of primary energyФ.21 of production of electrical and heat energy in the cogeneration mode, is determined by the formula given in Item 2 of appendix No. 1 to the Law No. 92/2014:

Ф.22 – the approved control value of efficiency of separate production of electricity corresponding to cogeneration unit of k of the Configuration is also determined according to the table 1 of appendix No. 1 to the Order of the Government No. 297/2016 about approval of the control approved values of efficiency for separate production of electrical and heat energy, with refining that in case of gaseous fuel the correction coefficient of variation of external annual average temperature in the Republic of Moldova from ISO conditions (15 °C) is applied. For the Republic of Moldova external annual average temperature constitutes 11 °C.

Ф.23 – the approved control value of efficiency of separate production of heat energy corresponding to cogeneration unit of k of the Configuration which is determined according to appendix No. 2 to the Order of the Government No. 297/2016 about approval of the control approved values of efficiency for separate production of electrical and heat energy.  

18. ValuesФ.24 andФ.21 for each cogeneration unit included in the production Configuration in the cogeneration mode are used for check of observance of conditions of Item 2 of application No. 2 to the Law No. 92/2014. In case of certification of the electric power made in the mode of highly effective cogeneration arrive thus:

a) in case of accomplishment of both conditions the amountФ.25 will be certified as the electric power made in the mode of highly effective cogeneration;

b) in case of failure to carry out of one or both conditions the made electric power will not be certified as the electric power made in the mode of highly effective cogeneration.

19. For the cogeneration units included in the production Configuration in the cogeneration mode which certified amountФ.25 as the electric power made in the mode of highly effective cogeneration PES in absolute values as follows is determined:

VI. Scoping of the certified electric power which can obtain origin guarantees

20. For all production units in the cogeneration mode which certified amountФ.25 as the electric power made in the mode of highly effective cogeneration according to provisions of the subitem and) Item 18, the amount of the certified electric power which can obtain guarantees of origin is determined as follows:

 Ф.27 – the amount on all cogeneration units included in the production Configuration in the cogeneration mode which certified amountФ.25 as the electric power made in the mode of highly effective cogeneration according to provisions of the subitem and) Item 18.

VII. Data management for issue of guarantees of origin

21. Results of the calculations which are carried out separately for every month of the period for which origin guarantees are requested are represented to NARE according to the table which is stated below:

22. Responsible for the Configuration is responsible for correctness represented to data / information and provides storage within at least five years of all measured values, and also data/information transferred to NARE for the issue of guarantees of origin for amounts of electric power made in the mode of highly effective cogeneration.
