About enhancement of regulatory legal acts concerning activities for transportation of radioactive materials

According to article 24 of the Law of Ukraine "About use of nuclear energy and radiation safety", the paragraph of the fifth subitem 7 of item 4 of the Regulations on the State inspection of the nuclear regulation of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of August 20, 2014 No. 363,

I ORDER:

1. Make changes to Requirements and safety conditions (licensed conditions) of implementation of activities for transportation of the radioactive materials approved by the order of the State committee of nuclear regulation of Ukraine of August 31, 2004 No. 141, registered on September 09, 2004 at No. 1125/9724, having been reworded as follows them which is applied the Ministry of Justice of Ukraine.

2. Make change to appendix 2 to the Regulations on the list and requirements concerning form and content of the documents submitted for receipt of the license for implementation of separate types of activity in the field of use of nuclear energy approved by the order of the State inspection of nuclear regulation of Ukraine of the August 06, 2012 No. 153, registered in the Ministry of Justice of Ukraine on August 29, 2012 at No. 1453/21765, having excluded the Section III.

With respect thereto to consider the Section IV the Section III.

3. (Natalya RYBALKA) to provide to department on safety of radiation technologies and the address from Russian joint stock company submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.

4. This order becomes effective from the date of its official publication.

Requirements and safety conditions (licensed conditions) of implementation of activities for transportation of radioactive materials

I. General provisions

1. These Licensed conditions establish conditions and safety requirements of implementation of activities for transportation of radioactive materials which includes preparation, loading, sending, transportation, including transit storage, unloading and acceptance in final destination of loads with radioactive materials and packagings.

2. These Licensed conditions are obligatory for the subjects of activities in the field of use of nuclear energy performing or planning to perform activities for transportation of radioactive materials (further - subjects of activities).

These Licensed conditions do not extend to activities for transportation of radioactive materials, stipulated in Item 4 Sections I of Rules of safe transportation of radioactive materials (PBPRM-2020), No. approved by the order of the State inspection of nuclear regulation of Ukraine of October 27, 2020 436, registered in the Ministry of Justice of Ukraine on December 30, 2020 at No. 1313/35596 (further - PBPRM-2020).

3. The subject of activities transports radioactive materials according to requirements of regulatory legal acts for nuclear and radiation safety, ecological, fire safety, health care and work, safety of surface, water and/or airborne transportations.

4. In these Licensed conditions terms are used in the values given in the Laws of Ukraine "about use of nuclear energy and radiation safety", "About allowing activities in the field of use of nuclear energy" (further - the Law), "About transportation of dangerous goods", PBPRM-2020.

5. In these Licensed conditions the following reducings are accepted:

STARS - sources of ionizing radiation;

RM - radioactive materials;

YaRB - nuclear and radiation safety.

II. Licensed conditions of implementation of activities for transportation of RM

1. Activities for transportation of RM are performed on the basis and in accordance with the terms of the license for the right of implementation of activities for transportation of RM granted according to the procedure, established by the Law.

2. The subject of activities for obtaining (modification, issue of the duplicate) licenses for activities on transportation of RM (further - the license) submits to Gosatomregulirovaniye the application for receipt (modification, issue of the duplicate) of license for activities on transportation of radioactive materials which form is given in appendix 1 to these Licensed conditions (further - the statement) in electronic or paper form.

Are enclosed to the application:

1) for receipt (modification) of the license:

the documents confirming capability of the applicant to comply with conditions of implementation of activities for transportation of RM which list is given in appendix 2 to these Licensed conditions;

the documents confirming providing requirements of physical protection of RM when implementing activities for transportation of RM which list is given in appendix 3 to these Licensed conditions;

the license to which changes are made;

the documents proving the bases for modification of the license;

the certificate of qualification of personnel of the applicant which form is given in appendix 4 to these Licensed conditions, to which are applied:

copies of the documents confirming training and examinations concerning nuclear and radiation safety according to Procedure for carrying out training and examination concerning radiation safety at personnel and officials of subjects of separate types of activity in the field of use of nuclear energy approved by the order of the State inspection of nuclear regulation of Ukraine of October 02, 2014 No. 143, registered in the Ministry of Justice of Ukraine on December 02, 2014 at No. 1549/26326;

copies of certificates of drivers on the admission to transportation;

the training program of personnel developed according to PBPRM-2020;

2) for issue of the duplicate of the license documents, the stipulated in Article 16-1 Law are enclosed to the application.

3. The authorized officer of Gosatomregulirovaniya performs preliminary consideration of the statement and the documents filed together with it for the purpose of assessment of their form and content and in case of availability of the bases, the stipulated in Article 12 Laws, makes the decision on leaving of the statement and the documents attached to it without movement and the notification on leaving directs to the subject of activities applications without movement by the method specified by it in the statement within 10 working days from the date of its obtaining.

In the message on leaving of the statement without movement the revealed shortcomings with reference to the violated requirements of the legislation, method and term of remedial action, and also methods, procedure and terms of appeal of the decision on leaving of the statement without movement are specified.

Gosatomregulirovaniye establishes the term sufficient for elimination by the applicant of the revealed shortcomings which according to the petition of the applicant can be prolonged.

4. Gosatomregulirovaniye refuses to the subject of activities issue (modification) of the license in case:

detection of insolvency of the subject of activities to provide observance of the conditions of implementation of the declared type of activity established by regulations and rules on nuclear and radiation safety;

availability in the documents filed by the subject of activities, the doubtful or distorted information;

not elimination of the revealed shortcomings of the submitted application and documents attached to it during the term specified in the notification on leaving of the statement without movement.

5. The decision on refusal in issue of the license / about refusal in modification of the license can be appealed administratively according to the Law of Ukraine "About ministerial procedure" and/or in administrative court. The claim according to the procedure of administrative appeal is submitted within 30 calendar days from the date of bringing the decision to data of the subject of activities.

6. The subject of activities in case of transportation of RM receives the certificate on approval according to Procedure for issue of certificates on approval in case of transportation of radioactive materials, the State committee of nuclear regulation of Ukraine approved by the order of September 06, 2007 No. 119, registered in the Ministry of Justice of Ukraine on September 20, 2007 at No. 1079/14346 (in edition of the order of the State inspection of nuclear regulation of Ukraine of January 17, 2024 No. 34).

III. Requirements to implementation of activities for transportation of RM

1. Management system activities for transportation of RM

1. The subject of activities develops, estimates and improves management system activities for safe transportation of RM according to Requirements to management system activities in the field of safe transportation of the radioactive materials approved by the order of the State inspection of nuclear regulation of Ukraine of October 31, 2023 No. 564, registered in the Ministry of Justice of Ukraine on December 27, 2023 at No. 2256/41312.

2. The subject of activities develops management system activities for safe transportation of RM taking into account the level of danger of RM and for the purpose of providing the fact that during transportation of RM requirements for YaRB will be observed.

2. Ensuring with resources activities for transportation of RM

1. The subject of activities provides necessary financial, material and human resources for maintenance of level of safety of activities for transportation of RM provided by requirements from YaRB, and also conditions of the issued documents of allowing nature.

2. The subject of activities guarantees indemnification which can be put as a result of accident during transportation of RM, according to article 55 of the Law of Ukraine "About use of nuclear energy and radiation safety".

3. The subject of activities determines and provides the number of personnel sufficient for ensuring accomplishment of activities for transportation of RM, necessary level of its qualification, considering the functions assigned to personnel and experience in the field of use of nuclear energy.

4. The subject of activities, considering characteristics of RM which are subject to transportation determines, proves, provides availability and supports serviceable condition the necessary nomenclature and quantity: packaging sets for transportation of RM, systems, the equipment, transport and other means for performance of works on preparation, loading, sending, transportation, unloading and acceptance in final destination of loads from RM and packagings, and also ensures safety during execution of these works.

By preparation, loading, sending, unloading and acceptance of loads from RM and packagings the corresponding systems, the equipment and other means of the consignor and/or consignee can be applied, and during transportation and transit storage - vehicles of carrier, on condition of compliance of these systems, the equipment, transport and other means to requirements for YaRB and their complete operability.

5. Safety of packaging sets for transportation of RM and condition of their use, are determined by requirements of PBPRM-2020.

The subject of activities confirms compliance to safety requirements of design and degree of protection of packaging sets for transportation of RM by the certificates on approval issued according to the Procedure for issue of certificates on approval in case of transportation of radioactive materials, the approved order of the State committee of nuclear regulation of Ukraine of September 06, 2007 to No. 119, registered in the Ministry of Justice of Ukraine on September 20, 2007 at No. 1079/14346 (in edition of the order of the State inspection of nuclear regulation of Ukraine of January 17, 2024 No. 34).

For packaging sets which do not require receipt of the certificate on approval the subject of activities provides for consideration and approval to Gosatomregulirovaniyu the report on the analysis of safety of design of packaging sets according to Item 1 of the Section IX PBPRM-2020 and Requirements to structure and contents of the reports on the analysis of safety of design of packaging set approved by the order of the State inspection of nuclear regulation of Ukraine of November 14, 2023 No. 587, registered in the Ministry of Justice of Ukraine on January 09, 2024 at No. 49/41394.

3. Ensuring qualification and training of personnel

1. The subject of activities establishes requirements to qualification of personnel according to its job responsibilities, develops and realizes system of professional training, retraining and certification of personnel.

2. The subject of activities provides carrying out training and examination of personnel concerning radiation safety according to Procedure for carrying out training and examination concerning radiation safety at personnel and officials of subjects of separate types of activity in the field of use of nuclear energy approved by the order of the State inspection of nuclear regulation of Ukraine of October 02, 2014 No. 143, registered in the Ministry of Justice of Ukraine on December 02, 2014 at No. 1549/26326.

3. The subject of activities develops and approves with Gosatomregulirovany the training program for the personnel which are directly involved in performance of works on transportation of RM according to requirements of Item 13 of the Section III PBPRM-2020.

4. On transportation of RM the subject of activities involves the personnel which had professional training and certification, training and examination concerning radiation safety including safety issues of transportation of RM in performance of works.

5. The subject of activities records also storage of results of passing by personnel and management of professional training and certification, primary, periodic doctrines, advanced training.

6. The subject of activities documentary determines the purposes of forming and maintenance of culture of safety, takes measures for their achievement according to General requirements to management system activities in the field of use of nuclear energy, No. approved by the order of the State inspection of nuclear regulation of Ukraine of December 19, 2011 190, registered in the Ministry of Justice of Ukraine on January 10, 2012 at No. 17/20330.

4. Accomplishment of estimates of safety

1. The subject of activities during planning and preparation for implementation of activities for transportation of RM carries out assessment of safety of these activities which covers all work types on transportation, considering accomplishment them in case of usual, normal conditions of transportation, and also in case of emergencies.

2. The subject of activities applies the differentiated approach to accomplishment of assessment of safety, considering degree of danger, the characteristic of the transported RM, work types and transactions.

3. The subject of activities carries out assessment of safety of activities for transportation of RM with use of reasonable basic data and assumptions on reasonable models and scenarios.

4. For evaluating safety the subject of activities determines:

specific purposes of evaluating safety;

requirements and criteria of safety which respect is proved when evaluating safety;

analyses and calculations which will be made for demonstration of observance of certain requirements and criteria of safety;

scenarios of usual and normal conditions of transportations, and also emergencies;

list and characteristics of dangers;

approaches to accomplishment of assessment of safety, in particular conservative and/or realistic approach;

approaches to the analysis of uncertainty and comparison of the received results with evaluation criteria.

5. The subject of activities periodically, but at least time in five years, carries out revaluation of safety of activities for transportation of RM, taking into account experience of implementation of such activities, and also upon the demand of Gosatomregulirovaniya in case:

modification in acting or entry into force by new regulatory legal acts which action extends to activities for transportation of RM;

identification of essential shortcomings of provisional estimate;

essential changes of technology when implementing activities for transportation of RM which can influence safety level;

essential differences of the actual amounts and/or characteristics of the transported RM from the data used in the previous assessment;

emergence of emergencies.

6. The subject of activities documents results of assessment and revaluation of safety in the report on the analysis of safety of implementation of activities for transportation of radioactive materials which is drawn up according to Requirements to the report on the analysis of safety of implementation of activities for transportation of the radioactive materials approved by the order of the State committee of nuclear regulation of Ukraine of August 31, 2004 No. 141, registered in the Ministry of Justice of Ukraine on September 09, 2004 at No. 1127/9726.

5. Ensuring safe operation of packaging sets for transportation of RM, systems, the equipment and other means

1. The subject of activities provides safe operation of packaging sets for transportation of RM, systems, the equipment, the transport and other means applied by it when implementing activities for transportation of RM.

2. The subject of activities develops documentation set (managements, instructions, procedures) on operation of packaging sets for transportation of RM, systems, the equipment, transport and other means which contains technical characteristics, operational restrictions, the operation modes, specific orders on accomplishment of transactions by personnel during usual, normal conditions of transportations, and also in case of emergencies.

3. The subject of activities establishes procedure for development, maintaining, review, accounting and storage of documentation on operation of packaging sets for transportation of RM, systems, the equipment, transport and other means.

The subject of activities determines the list of documentation on operation of the equipment which is on personnel workplaces.

4. The subject of activities carries out maintenance and repair of packaging sets for transportation of RM, systems, the equipment, the transport and other means applied when implementing activities for transportation of RM for the purpose of maintenance of operability of the equipment.

The subject of activities carries out maintenance and repair of the equipment used when implementing activities for transportation of RM according to the developed and approved working programs, instructions for work for maintenance and repair.

5. The subject of activities carries out inspections and testing of operability of packaging sets for transportation of RM, systems, the equipment, the transport and other means applied when implementing activities for transportation of RM during their commissioning, after their repair and periodically during all term of their operation.

In case of impossibility of conducting such checks and testing in full the subject of activities carries out the mediated and/or partial inspections.

In case of receipt of unsatisfactory results of checks and testing or identification by Gosatomregulirovany when conducting inspection checks and inspections of violations or discrepancies in functioning of packaging sets for transportation of RM, systems, the equipment, transport and other means, the subject of activities carries out their extraordinary inspections and testing.

6. The subject of activities documents and keeps results of maintenance and repair, checks and testing of operability of packaging sets for transportation of RM, systems, the equipment, the transport and other means applied when implementing activities for transportation of RM.

6. Ensuring radiation protection

1. The subject of activities adheres to the basic principles of radiation protection correctness, not increase and optimization.

2. Activities for transportation of RM are considered as part of activities in the field of use of nuclear energy. Correctness of transportation of RM is considered within reasons for correctness of activities in the field of use of nuclear energy.

3. Respect for the principle of exceeding when implementing activities for transportation of RM is provided excesses of limits of doses and admissible probabilities of radiation of the person.

4. The subject of activities optimizes radiation protection of any persons which are exposed to radiation during transportation of RM so that the size of individual doses, the number of the irradiated persons and probability of radiation kept so low as far as it is possible taking into account economic and social factors, at the same time the interrelation of transportation with other types of activity is considered.

5. The subject of activities according to requirements of PBPRM-2020 develops the program of radiation protection which covers all activities for transportation of RM that can lead to radiation of people (preparation, loading, sending, transportation, including transit storage, unloading, acceptance in final destination of loads from RM and packagings of RM).

In the program of radiation protection, except other, the subject of activities provides radiation control according to requirements of the basic health regulations of ensuring radiation safety of Ukraine approved by the order of the Ministry of Health of Ukraine of February 02, 2005 No. 54, registered in the Ministry of Justice of Ukraine on May 20, 2005 at No. 552/10832. The amount of measures of radiation control, and also necessary means of the measuring equipment, the subject of activities notes in the program of radiation protection depending on degree of danger of radiation of people in case of regular, normal and emergencies of transportation.

7. Ensuring emergency readiness and reaction

1. The subject of activities when implementing activities for transportation of RM provides the organizational actions and technical means allocated for the prevention of radiation accidents, restriction of their impact and minimization of their effects.

2. The subject of activities provides the prevention of emergencies (and, in particular, radioactive pollution of the circle outside packaging set) thanks to use of system of physical barriers to content and isolation of RM, and also system of organizational actions and technical means which provide protection of these barriers and preserving their efficiency.

3. The subject of activities realizes system of organizational actions and technical means which provides:

timely identification and elimination of factors which lead to violation of safe conditions of transportation;

prevention of development of these violations into emergencies;

restriction of harmful effects of accidents, reduction and liquidation of their effects.

4. The subject of activities determines sales amounts of organizational actions and technical means depending on amounts and degree of danger of RM which are transported within licensed activities, and also from work types and the carried-out transactions.

5. The subject of activities proves in the report on the analysis of safety of implementation of activities for transportation of radioactive materials the complex of organizational actions and technical means directed to the prevention of radiation accidents, restriction of their impact, reduction and liquidations of their effects.

6. The subject of activities develops, claims and approves with Gosatomregulirovany the plan of emergency actions according to the Provision for planning of actions and actions on case of accidents in transit of radioactive materials, the State committee of nuclear regulation of Ukraine approved by the order of April 07, 2005 No. 38, registered in the Ministry of Justice of Ukraine on April 22, 2005 at No. 431/10711.

7. For ensuring emergency reaction the subject of activities creates emergency groups and/or crews which part the personnel which underwent training and trainings in liquidation of emergencies and accidents which can happen during implementation of activities for transportation of RM are.

The subject of activities provides the corresponding equipment of emergency groups and/or crews, including, vehicles for urgent departure to the place where there was emergency and accident.

8. The subject of activities provides the periodic training of personnel necessary for implementation of emergency reaction.

9. The subject of activities develops and realizes programs of scheduled antiemergency exercises and trainings for working off of actions of personnel and interaction with the relevant organizations and organizations in an emergency. After conducting exercises and trainings the subject of activities carries out assessment of their results on the basis of which develops and implements the adjusting measures directed to correction of the revealed shortcomings and maintenance of necessary level of emergency readiness.

8. Ensuring physical protection

1. For prevention of making of diversion, theft or any other illegal withdrawal of RM the subject of activities creates and provides continued operation of system of physical protection of RM, in particular, during transportation of RM. The subject of activities develops and approves the documents confirming observance of requirements of physical protection of RM when implementing activities for transportation of RM which list is given in appendix 3 to these Licensed requirements.

2. For the purpose of goal achievement of physical protection the subject of activities creates necessary conditions for:

ensuring fulfillment of requirements of physical protection implementation of activities for transportation of RM;

information security, access to which shall be limited;

passing of special check by management and personnel;

organizations and passings of professional training and advanced training of specialists in physical protection.

3. The personnel which are directly involved in performance of works on transportation of RM require execution of the admission to accomplishment of special works of the corresponding category according to the procedure, established by the legislation.

4. According to category RM the subject of activities determines the level of physical protection of implementation of activities for transportation of RM.

9. Ensuring informing and reporting

1. The subject of activities records the executed transportations and provides to Gosatomregulirovaniyu reports in accordance with the terms of the issued documents of allowing nature and Requirements to frequency and contents of the reports provided by licensees in the field of use of nuclear energy, approved by the order of the State committee of nuclear regulation of Ukraine of October 16, 2006 No. 162, registered in the Ministry of Justice of Ukraine on December 06, 2006 at No. 1268/13142.

In case of change of the data specified in the statement, documents and data based on which the license was granted the licensee shall inform in ten-day time on this Gosatomregulirovaniye.

2. In case of any situation or circumstances which brought or can lead to violations of regulations and rules YaRB, or in case of radiation accident which happened during transportation of RM, including in case of their loss or theft, the subject of activities shall:

within hour to inform Gosatomregulirovaniye;

begin first-priority actions for elimination of effects and liquidation of accident;

make office investigation, establish the reasons which led to violations or accident by results of investigation to provide in Gosatomregulirovaniye the report with information on circumstances and the reasons of the taken place event, the taken measures and actions for elimination of its effects.

2. Management on management system (quality manual) developed according to Requirements to management system activities in the field of safe transportation of the radioactive materials approved by the order of the State inspection of nuclear regulation of Ukraine of October 31, 2023 No. 564, registered in the Ministry of Justice of Ukraine on December 27, 2023 at No. 2256/41312.

3. The plan of emergency actions for case of accidents in transit RM developed according to Regulations on planning of actions and actions on case of accidents in transit of radioactive materials, the State committee of nuclear regulation of Ukraine approved by the order of April 07, 2005 No. 38, registered in the Ministry of Justice of Ukraine on April 22, 2005 at No. 431/10711.

4. The program of radiation protection in transit RM developed according to PBPRM-2020.

5. The document confirming guaranteeing damage by the applicant of compensation which can be put as a result of radiation accident during transportation of RM.

6. Copies of the documents (technique, the instruction) regulating actions of personnel by preparation, loading, sending, transportation, transit storage, unloading and acceptance in final destination of RM and packagings according to PBPRM-2020.

Appendix 3

to Requirements and safety conditions (licensed conditions) of production of activities for transportation of radioactive materials (the subitem 1 of Item 2 of the Section II)

The list of the documents confirming providing requirements of physical protection of RM when implementing activities for transportation of RM

1. The copy of the act of determination of level of physical protection of nuclear materials, radioactive waste, other sources of the ionizing radiation which is drawn up in the form given in appendix 6 to the Procedure for determination of level of physical protection of nuclear installations, nuclear materials, radioactive waste, other sources of the ionizing radiation according to their category approved by the resolution of the Cabinet of Ministers of Ukraine of April 26, 2003 No. 625.

2. Copies of the orders on provision of the admission issued in accordance with the established procedure to accomplishment of special works of the head and employees of the company, the list of positions of workers on whom work requires the admission to accomplishment of special works.

3. Copy of the order on appointment of one of deputy managers of the applicant responsible for condition of system of physical protection.

4. The certificate of planned occupational retraining and advanced training on physical protection of specialists to whom implementation of functions of physical protection, according to the program and the list of the issues agreed with Gosatomregulirovaniya or his territorial authority and/or copies of certificates on training in the educational institutions which obtained the corresponding license of Gosatomregulirovaniya is assigned.

5. The plan of interaction in case of making of diversion or the procedure of the notification on violation of the mode of physical protection at the company, instruction sheets of actions for personnel.

6. The certificate of creation by the applicant of conditions for information security with limited access according to the legislation on information security.

7. Management on management system (quality manual) physical protection of the objects intended for the treatment of radioactive waste, MIRACLES (except MIRACLES 4 categories) developed taking into account regulations and rules on physical protection.
