WE ORDER:

1. Bring in the joint order of the Minister of Agriculture of the Republic of Kazakhstan of April 5, 2019 No. 135 and the Minister of national economy of the Republic of Kazakhstan of April 24, 2019 No. 30 "About approval of criteria for evaluation of degree of risks and checking sheets in the field of use and protection of water fund of the Republic of Kazakhstan, safety of dikes" (it is registered in the Register of state registration of regulatory legal acts for No. 18616), the following changes:

1) criteria for evaluation of degree of risks in the field of protection and use of water fund of the Republic of Kazakhstan (further – Criteria) according to appendix 1 to this joint order;

2) checking leaf in the field of protection and use of water fund of the Republic of Kazakhstan in respect of the subjects of control and supervision which are carrying out intake and (or) use of water resources and operation of hydraulic engineering constructions and also in respect of the certified organizations on the work right in the field of safety of hydraulic engineering constructions according to appendix 2 to this joint order;

3) checking leaf in the field of protection and use of water fund of the Republic of Kazakhstan in respect of the subjects of control and supervision performing placement, design and construction, reconstruction of the constructions and other objects influencing condition of water objects, and also the conditions of work connected with construction activities, afforestation, transactions for subsurface use, well-drilling, sanitation of superficial water objects, fishery melioration of water objects, agricultural and other works on water objects in the water protection zones and strips according to appendix 3 to this joint order;

4) checking leaf in the field of protection and use of water fund of the Republic of Kazakhstan in respect of the subjects of control and supervision which are carrying out intake and (or) use of water resources and operation of hydraulic engineering constructions and also in respect of the certified organizations on the work right in the field of safety of hydraulic engineering constructions according to appendix 4 to this joint order;

5) checking leaf in the field of protection and use of water fund of the Republic of Kazakhstan in respect of subjects of control and supervision performing placement, design and construction, reconstruction of the constructions and other objects influencing condition of water objects, and also the conditions of work connected with construction activities, afforestation, transactions for subsurface use, well-drilling, sanitation of superficial water objects, fishery melioration of water objects, agricultural and other works on water objects in the water protection zones and strips according to appendix 5 to this joint order.";

2. To provide to committee on regulation, protection and use of water resources of the Ministry of Water Resources and Irrigation of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this joint order on Internet resource of the Ministry of Water Resources and Irrigation of the Republic of Kazakhstan after its official publication;

3) within five working days after state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan its direction in Committee on legal statistics and special accounting of the Prosecutor General's Office of the Republic of Kazakhstan for placement in the information system "Unified Register of Subjects and Objects of Checks".

3. To impose control of execution of this joint order on the supervising vice-Minister of Water Resources and Irrigation of the Republic of Kazakhstan.

4. This joint order becomes effective after ten calendar days after day of its first official publication, except for Items 19 and 25 of appendix 3 to the Criteria for evaluation of degree of risks in the field of protection and use of water fund of the Republic of Kazakhstan approved by the specified joint order, Items 19 and 25 of appendix 4 to this joint order which become effective since January 1, 2027.

Criteria for evaluation of degree of risks in the field of protection and use of water fund of the Republic of Kazakhstan

Chapter 1. General provisions

These Criteria for evaluation of degree of risks in the field of protection and use of water fund of the Republic of Kazakhstan (further – Criteria) are developed in compliance with Items 5 and 6 of Article 141, Item 1 of article 143 of the Entrepreneurial code of the Republic of Kazakhstan (further – the Code) and Rules of forming by the regulatory state agencies of system of assessment and risk management approved by the order of the acting minister of national economy of the Republic of Kazakhstan of June 22, 2022 No. 48 (it is registered in the Register of state registration of regulatory legal acts at No. 28577).
