About enhancement of system of public administration in the field of protection of the rights of investors and return of assets

According to the subitem 5) of article 44 of the Constitution of the Republic of Kazakhstan, subitems 1) and 3) of Item 2 of article 17-1 of the Constitutional law of the Republic of Kazakhstan "About the President of the Republic of Kazakhstan" I DECIDE:

1. For the purpose of increase in level of protection of the rights of investors of function of the investment ombudsman the Attorney-General of the Republic of Kazakhstan performs.

2. Reorganize republican public institution "Committee on return of assets of the Prosecutor General's Office of the Republic of Kazakhstan" (further - Committee on return of assets) by transformation to republican public institution "Committee on protection of the rights of investors of the Prosecutor General's Office of the Republic of Kazakhstan" (further - Committee on protection of the rights of investors) with transfer to the Prosecutor General's Office of the Republic of Kazakhstan of functions and powers of the reorganized Committee on return of assets, the stipulated in Article 11-1 Constitutional law of the Republic of Kazakhstan "About prosecutor's office" and the Law of the Republic of Kazakhstan "About return to the state of illegally acquired assets".

3. Determine the Prosecutor General's Office of the Republic of Kazakhstan the legal successor of the rights and obligations of Committee on return of assets within the transferred functions and powers.

4. Approve enclosed:

1) Regulations on Committee on protection of the rights of investors of the Prosecutor General's Office of the Republic of Kazakhstan;

2) changes and additions which are made to some presidential decrees of the Republic of Kazakhstan.
