Based on part (3) article 10 of the Law No. 547/2003 on the public assistance (The official monitor of the Republic of Moldova, 2004, Art. No. 42-44, 249), with subsequent changes, the Law No. 123/2010 on social services (The official monitor of the Republic of Moldova, 2010, Art. No. 155-158, 541), with subsequent changes, the Law No. 60/2012 on social integration of persons with limited opportunities (The official monitor of the Republic of Moldova, 2012, Art. No. 155-159, 508), with subsequent changes, DECIDES: the Government

1. The order of the Government No. 824/2008 about approval of the Minimum quality standards of the social services provided in the day centers for children with limited opportunities (2008, Art. No. 122-124, 831), with subsequent changes, to declare the official monitor of the Republic of Moldova invalid.

4. In the Order of the Government No. 314/2012 about approval of the Standard regulations on the organization and functioning of Social service "Personal assistant" and the Minimum quality standards (Official monitor of the Republic of Moldova, 2012, Art. No. 104-108, 366), with subsequent changes, to make the following changes:

4.1. in all text of the resolution and appendices to exclude the word "acting", and to replace the word "integration" in any grammatical form with the word "inklyuziya" in the corresponding grammatical form;

4.2. in item 4 of the resolution the text "to territorial structure of social security, and Agency on management of highly specialized social services -" to exclude;

4.3. in the Standard provision:

4.3.1. state Item 2 in the following edition:

"2. The social service "Personal assistant" (further - Service) is social service on home care behind persons with severe forms of restrictions of opportunities, aimed at the development or maintenance of their personal independence, and also at prevention of their institutionalization and assistance of their social integration.";

4.3.2. in Item 2-1 "highly specialized" to exclude the word;

4.3.5. in Item 8:

4.3.5.1. 1) to state the subitem in the following edition:

"1) considers within the Commission the application and the personal record of the applicant for assessment of conformity to its selection criteria and acceptance in Service, according to requirements of this Standard provision;";

4.3.5.2. in the subitem 2) of the word of "transfer of the beneficiary in Service" to replace "renderings of services of Service";

4.3.5.3. 9) after the words "makes the decision" to add the subitem with the text "within the Commission";

4.3.5.4. add with Items 8-1 and 8-2 of the following content:

"8-1. The service provider controls and periodically reports before body of the central public management on condition of beneficiaries and extent of implementation of individual plans of the help.

8-2. The service provider cooperates with local social and health services for coordination of the support provided to beneficiaries.";

4.3.7. add with Item 15-1 of the following content:

"15-1. The supplier of Service cooperates with National employment agency of the population for the purpose of enrollment, selection and training of personal assistants.";

4.3.8. in Item 19:

4.3.8.1. 2) to add the subitem with the text: "and, in appropriate cases, the individual program of rehabilitation and social integration";

4.3.8.2. change concerns only the text in Romanian;

4.3.9. add Item 20 with the text: ", on condition of compliance in total to all selection criteria provided in appendix to this Standard provision";

34-2. In case of acceptance in Service the following criteria of prioritization which include are applied, but not limited:

1) high level of dependence of the applicant;

2) urgent need in leaving and support;

3) lack of access to other social services or services of support;

4) residence in the isolated areas or areas with limited access to social services;

5) lack of support from family, with direct threat of social isolation.

34-3. Priority access to Service on the terms of this Standard provision is guaranteed to persons who in total answer the criteria listed in Item 342,.";

4.3.15. declare Item 39-1 invalid;

4.3.16. state Item 44 in the following edition:

"44. The personal assistant and the beneficiary / the legal representative under the supervision of the head of Service provide implementation of actions, provided by the individual plan of the help, making the corresponding records in leaf of monitoring and the program of provision of services of the personal help approved by the order/order of the Minister of Labour and Social Protection.";

4.3.17. in Item 48:
