About modification of some regulations (about provision of social services)

(Extraction)

Based on article 10 of the Law No. 547/2003 on the public assistance (The official monitor of the Republic of Moldova, 2004, Art. No. 42-44, 249), with subsequent changes, and also for the purpose of realization of provisions of the Law No. 123/2010 on social services (The official monitor of the Republic of Moldova, 2010, Art. No. 155-158, 541), with subsequent changes, DECIDES: the Government

2. In the Order of the Government No. 1034/2014 about approval of the Standard regulations on Service of social home care and the Minimum quality standards (Official monitor of the Republic of Moldova, 2015, No. 110, of the Art. 1), with subsequent changes, to make the following changes

2.1. in the resolution:

2.1.1. add with Item 4-1 of the following content:

"4-1. To the central industry body of public management in the field of social protection to approve the regulations necessary for implementation of this resolution.";

2.1.2. in Item 5 the text "Ministry of Labour, Social Protection and Family" shall be replaced with words "Ministry of Labour and Social Protection";

2.2. in appendix No. 1:

2.2.1. in all text of the Standard provision and appendices to it:

2.2.1.1. the words "individual plan of the help" in any grammatical form shall be replaced with words "the individual plan of services" in the corresponding grammatical form;

2.2.1.2. change is made only to the text in Romanian;

2.2.2.punkt 2 to state in the following edition:

"2. The service of social home care (further – Service) represents service within which the public or private suppliers provided in article 7 of the Law No. 123/2010 on social services provide social service in leaving.";

2.2.3. in Item 3 of the word "the order of body of local public authority of the second level" to replace with the text "the decision of the founder on organization of Service accompanied with the relevant acts according to the legislation,";

2.2.4. add item 4 with concepts of the following content:

"the applicant – person / the legal representative submitting the application for provision of service according to the this provision provisions;

the beneficiary – person to whom the right to service according to the this provision provisions is established.";

2.2.5. in Item 5 of the word "Social inspection" shall be replaced with words "The state social inspection";

2.2.6. state Item 8 in the following edition:

"8. The service performs the activities based on the following principles:

a) availability and equal access – Service is available in all geographical regions and equal access, including from the financial point of view is provided to all persons needing its services to them;

b) informing – guaranteeing access to the complete information about the provided services;

c) nondiscrimination – provision of services without discrimination on bases of sex, age, ethnic origin, language, restriction of opportunities, religion, opinion or the social status;

d) respect of the rights and human dignity – the treatment of each beneficiary yours faithfully, advantage, empathy and professionalism;

e) confidentiality – data protection and private life of the beneficiary;

f) orientation per capita and individualized approach – adaptation of interventions to requirements and opportunities of the beneficiary;

g) promotion of autonomy and active participation – involvement of the beneficiaries in decision making concerning the individual plan of services and support in self-service;

h) active and healthy aging – support of social participation, health and wellbeing of elderly persons;

i) accommodation in community – assistance and support of beneficiaries in the conditions of the family and public circle, prevention of isolation and institutionalization;

j) partnership – cooperation between the founder, the service provider, the beneficiary, family and other relevant services for the purpose of provision of care and support at home.";

2.2.7. state Item 40 in the following edition:

"40. The service provider of Service employs personnel according to this Standard provision, the Minimum quality standards and the Labor code of the Republic of Moldova No. 154/2003 based on the individual employment contract or, depending on circumstances, based on the service provision agreement.";

2.2.8. state Item 47 in the following edition:

"47. The service provider performs activities for provision of social service in the rooms corresponding to provisions of the Minimum quality standards.";

2.2.9. in Items 49 and 50 shall be replaced with words the word "Service" "The supplier of service"

2.2.10. add with Chapter V of the following content:

"V. PROCEDURE FOR GIVING AND CONSIDERATION OF CLAIMS/CLAIMS

57. The service provider establishes procedure for giving and consideration of the claims/claims concerning quality of the services provided to the beneficiary and provides informing employees, beneficiaries and/or their legal representatives on procedure for giving and consideration of claims/claims.

58. Messages on cases of violence, neglect, operation and human trafficking concerning beneficiaries are subject to registration and consideration according to the procedure, established by the legislation.

59. The service provider provides consideration of the claims/claims concerning quality of the provided services.

60. The service provider keeps the register of registration of claims/claims which includes data both on procedure for consideration of claims/claims, and on the measures taken for consideration of each claim / claim and on results of consideration.

61. The disputes which are arising in the course of consideration of claims/claims and not subject to settlement on the terms of friendly approval and also cases when administrative acts infringe certain rights or interests of beneficiaries, go for permission to degrees of jurisdiction according to the legislation.";

2.3. state appendix No. 2 in the following edition:

"Appendix № 2

to the Order of the Government No. 1034/2014

The minimum quality standards for the organization and functioning of Service of social home care

Chapter I. Principles of functioning

Availability and equal access – the standard 1

1. The service provider (further – the supplier) provides availability of Service in administrative and territorial unit in which he performs the activities, and also equal access to persons needing leaving to the high-quality services of Service provided free of charge and/or available from the financial point of view.

2. The expected result: The service is available and provides equal access to all persons according to eligibility criterions.

3. Fill rates:

3.1. contact information of the supplier (the address, phone number and the e-mail address) are available to the population;

3.2. the population can contact the supplier in writing, by phone or by e-mail;

3.3. the personnel of Service communicate with applicants or with beneficiaries of Service on Romanian or Russian, depending on language which they speak;

3.4. the number of statements for service provision (on non-paid basis / for a fee);

3.5. level of scope of statements (on non-paid basis / for a fee).

Informing – the standard 2

4. The service provider provides informing potential beneficiaries and any interested persons on the provided services.

5. The expected result: interested persons and potential beneficiaries have information access about procedure for the organization and functioning of Service, acceptance conditions, the provided services, the rights and obligations of beneficiaries.

6. Fill rates:

6.1. the supplier provides the staticized information materials about specifics of service stated in available form;

6.2. information materials contain the location information of Service, the provided services, eligibility criterions, and also other relevant information;

6.3. the image of beneficiaries and their personal data can be promulgated in information materials only in the presence of written consent of beneficiaries or, on circumstances, their legal representatives.

Observance of the rights, advantages and promotion of autonomy of beneficiaries – the standard 3

7. The service provider provides observance of basic rights of beneficiaries, guaranteeing respect of their advantage, personal autonomy and independent life. Also the supplier advances the principle of worthy aging and approach based on human rights, providing necessary conditions in order that each beneficiary could live in the circle in the bosom of the family and communities in safety, at the same time respecting his personal preferences and freedom in decision making.

8. The expected result: beneficiaries use services directed to observance of their rights, respect of advantage and autonomy, support of active and worthy aging, accommodation in community and social activity.

9. Fill rates:

9.1. each beneficiary has individual plan of services developed with its participation which reflects requirements, preferences, the purposes and actions directed to maintenance of autonomy and social integration;

9.2. the personnel of Service are trained on the approach oriented to the personality, promotion of autonomy and independent life, and also on observance of the rights and respect of human dignity;

9.3. the actions supporting autonomy and independent life including management of daily actions and participation in adoption of own decisions are implemented;

9.4. The service provides support of beneficiaries for the purpose of preserving their accommodation in the family and public circle by means of rendering services at home;

9.5. opportunity to express the opinion and preferences concerning type and method of provision of services is provided to beneficiaries, and their opinion is considered in planning process and estimates;

9.6. the supplier performs monitoring of level of satisfaction of beneficiaries with quality of the provided services.

Individualized approach – the standard 4

10. The events held within Service adapt to individual needs of beneficiaries for leaving.

11. The expected result: the help provided to beneficiaries corresponds to the revealed individual needs for leaving.

12. Fill rates:

12.1. the supplier periodically adjusts the events held within Service depending on the estimated / repeatedly estimated needs of beneficiaries for leaving;

12.2. the protocols constituted by results of repeated assessment of provision of services to beneficiaries are drawn up with the frequency provided in the Provision.

Partnership – the standard 5

13. The supplier establishes partnership with bodies of local public authority, organizations, the organizations, and also with other service providers important for rendering additional support to beneficiaries of Service.

14. The expected result: the established partnership promote intensification and diversification of the actions offered beneficiaries.

15. Fill rates:

15.1. the supplier signs agreements on cooperation with bodies of local public authority, organizations, the organizations and other relevant service providers;

15.2. number of the beneficiaries receiving services based on agreements on cooperation.

Participation – the standard 6

16. The supplier provides participation of beneficiaries in planning and provision of Service.

17. The expected result: the opinion of beneficiaries is taken into account.

18. Fill rates: beneficiaries participate in process:

18.1. estimates of needs for leaving;

18.2. developments of the individual plan of services;

18.3. repeated assessment of needs for leaving and review of the individualized plan of services.

Confidentiality – the standard 7

19. The supplier provides confidentiality of personal data.

20. The expected result: confidentiality of personal data is provided according to provisions of the legislation on personal data protection.

21. Fill rates:

21.1. the beneficiary signs consent to processing of personal data;

21.2. consent to processing of personal data is stored in the personal record of the beneficiary.

Nondiscrimination – the standard 8

22. Provision of services is performed on the basis of the principle of nondiscrimination.

23. The expected result: the supplier promotes promotion and respect for human rights irrespective of race, skin color, floor, language, religion, political or other convictions, nationality, ethnic origin or social origin, the inherent status, financial position, degree and type of restriction of opportunities.

24. Fill rates:

24.1. the supplier informs personnel under the signature on legal statuses in the field of nondiscrimination;

24.2. the personnel of Service know legal statuses in the field of nondiscrimination and apply non-discriminatory methods and practicians in the course of provision of services;

24.3. beneficiaries are informed under the signature on legal statuses in the field of nondiscrimination.

Chapter II. Organization and functioning of service

Equipment of Service – the standard 9

25. The service has the respective rooms for activities of personnel for leaving implementation

26. The expected result: arrangement and equipping of premises of Service facilitate activities of personnel.

27. Fill rates:

27.1. the administrative personnel of Service accommodates in territorial structure of the public assistance;

27.2. the area allocated for arrangement of workplaces of administrative personnel constitutes 6 sq.m;

27.3. rooms in which the administrative personnel performs activities are:

27.3.1. soundproofed;

27.3.2. connected to system of heat supply;

27.3.3. equipped with the air conditioning system;

27.3.4. properly lit;

27.3.5. equipped with furniture (cases, racks, etc.);

27.3.6. with the neutral color scale used for interior decor of rooms;

27.4. The service is equipped with the following technical equipment (or has to it access):

27.4.1. network printer;

27.4.2. copier;

27.4.3. scanner;

27.5. each workplace of administrative personnel is equipped:

27.5.1. desktop;

27.5.2. chair;

27.5.3. the computer with the licensed software and connection to the Internet;

27.5.4. phone;

27.6. The service has the hall for meetings equipped with necessary furniture and the equipment (or has access to it);

27.7. The service has proper vehicles for activities implementation;

27.8. The service has the financial resources necessary for acquisition of tickets on public transport or for compensation for expenses on office trips.

Equipment of social workers – the standard 10

28. The supplier provides social workers with the equipment necessary for implementation of activities for home care, and also, if necessary, individual protection equipment.

29. The expected result: equipment of social workers the equipment promotes high-quality provision to beneficiaries of services in home care

30. Fill rates: the social worker is provided:

30.1. winter and demi-season jackets;

30.2. overalls/dressing gown;

30.3. protective gloves from rubber and fabric;

30.4. footwear (winter and summer);

30.5. bag (two bags a year);

30.6. the cart for transportation of food and the industrial cart;

30.7. protective masks, one-time gloves, disinfectant - according to the established standard rates.

Acceptance of the receiver of services - the standard 11

31. Acceptance of the beneficiary in Service is performed based on the Standard provision.

32. The expected result: beneficiaries are accepted based on eligibility criterions.

33. Fill rates:

33.1. The service performs activities based on the approved domestic situation about the organization and functioning developed according to the Standard provision and which is turning on all mechanisms used in case of acceptance;

33.2. the supplier provides adjustment, according to requirements, domestic situation and mechanisms of work;

33.3. the procedure of acceptance includes the identification/direction of person, submission of the documents necessary for forming of the personal record and assessment of needs of the applicant for leaving by multi-profile group based on which need of acceptance in Service is established;

33.4. assessment of needs for leaving is performed according to appendix No. 3 to the Standard provision;

33.5. the decision on acceptance is made by results of consideration of the personal record, compliance to eligibility criterions and recommendations of multi-profile group.

The individual plan of services - the standard 12

34. Services according to the individual plan of services are provided to beneficiaries.

35. The expected result: the individual plan of services is constituted on the basis of assessment of needs of the beneficiary for leaving.

36. Fill rates:

36.1. the domestic situation of Service developed on the basis of the Standard provision turns on the mechanism used in planning process, realization and review of the individual plan of services;

36.2. the individual plan of services is drawn up in duplicate and signed by the beneficiary, the social worker and the head of Service of social home care;

36.3. the schedule of visits on the house is drawn up in duplicate and signed by the beneficiary, the social worker and the head of Service of social home care;

36.4. in the course of review of services of social home care the protocols concerning (repeated) assessment of provision of services to beneficiaries and also protocols of review of the individual plan of services are developed and filed;

36.5. lack of instructions of control facilities about elimination of violations of the provisions concerning planning and provision of services of social home care.

The agreement or the service provision agreement - the standard 13

37. Based on the individual plan of services the supplier signs the agreement or the service provision agreement with the beneficiary.

38. The expected result: all actions performed in the course of social care of the beneficiary correspond to provisions of the agreement or service provision agreement.

39. Fill rates:

39.1. beneficiaries have the copy of the agreement or the agreement signed by both parties;

39.2. contents of the agreement or agreement are reviewed in case of change of the individual plan of services.

Ensuring home care - the standard 14

40. The services provided to beneficiaries by the social worker at home correspond to the individual plan of services.

41. The expected result: beneficiaries receive in full all services in leaving provided in the individual plan of services.

42. Fill rates:

42.1. social workers have the schedule of visits on the house for each beneficiary approved with the beneficiary and approved by the head of Service;

42.2. the services in leaving provided by the social worker within each visit are reflected in the card of provision of care;

42.3. the card of provision of care is drawn up in duplicate and signed by the social worker and the beneficiary at the end of each visit;

42.4. the monthly activities report is constituted by the social worker on the basis of cards of provision of care.

Suspension and the termination of leaving - the standard 15

43. The supplier stops or stops provision of services according to the legislation.

44. The expected result: suspension or the termination of provision of services is performed in safety conditions for the beneficiary.

45. Fill rates:

45.1. suspension or the termination of provision of services is performed according to the internal regulations of Service developed on the basis of the Framework provision in which conditions are accurately determined;

45.2. quantity of the cases established by control facilities, concerning non-compliance with process at law of the suspension/termination of provision of services.

Monitoring and assessment of the services provided to beneficiaries - the standard 16

46. The supplier has and applies the procedure of monitoring and assessment of the services provided to beneficiaries within which the beneficiary plays active role.

47. The expected result: the beneficiary receives care according to the individual plan of services.

48. Fill rates:

48.1. the head of Service knows and applies the procedure of monitoring and assessment of the services provided to beneficiaries;

48.2. the head of Service performs monitoring and assessment of the care given to beneficiaries by means of visits in the place of their accommodation;

48.3. data of the reports on monitoring and assessment of the care given to beneficiaries prepared by the head of Service correspond to data of the monthly activities reports constituted by social workers;

48.4. the reports on monitoring and assessment prepared by the head of Service affirm the founder.

Protection of the beneficiary and personnel of Service against abuses, neglects, operation, cruel, brutal or degrading treatment - the standard 17

49. The supplier provides holding actions for informing and increase in awareness of the beneficiary and personnel of Service for the purpose of prevention of any forms of abuses, neglects, operation, cruel, brutal or degrading treatment.

50. The expected result: the beneficiary and personnel of Service are protected from any forms of abuses, neglect, operation, cruel, brutal or degrading treatment.

51. Fill rates:

51.1. the supplier informs, under list, personnel and beneficiaries of Service on mechanisms of the prevention, identification, the message, assessment and permission of suspicions or accusations in abuses, neglect, operation, cruel, brutal or degrading treatment concerning beneficiaries or personnel;

51.2. the supplier encourages and supports the beneficiary and personnel in the message on any forms of abuses, neglect, operation, cruel, brutal or degrading treatment from personnel, beneficiaries or, if necessary, other persons out of Service;
