About establishment of the moratorium on the address of recovery by enforcement on property of separate categories of farmers

This law establishes the temporary moratorium on the address of recovery by enforcement on the property belonging to separate categories of farmers for the purpose of providing continuity of implementation of agricultural activities for debt repayment before creditors and prevention of bankruptcy, and also for protection of the rural zone.
For the purposes of this law the concept "farmer debtor" means the farmer in the value determined in the Law on subsidizing of agricultural industry and concerning which rural zone No. 71/2023, the enforcement proceeding was initiated and which corresponds to the selection conditions provided by this law.
(1) the Moratorium established by this law is applied to the enforcement proceeding initiated in the relation:
a) the farmer debtor who corresponds to the selection conditions provided by part (1) article 5 of this law, and to whom suspension of forced execution concerning property, stipulated in Item d does not extend) parts (2) Articles 24, parts (1) and (3) Article 81 and part (1) Article 184 of the Insolvency act No. 149/2012, and also Item d) parts (1) article 78 of the Executive code No. 443/2004;
b) the guarantor of the farmer debtor, stipulated in Item a), irrespective of whether such farmer uses protection against the address of claim to property according to provisions of the Insolvency act No. 149/2012;
c) the member of peasant farm or the other person, liable jointly and severally according to obligations of the farmer debtor.
