1. Approve the enclosed Rules of management of single digital platform in the field of collective management of the rights and provision of single point of access to its use.

2. To provide to committee on intellectual property rights of the Ministry of Justice of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on official Internet resource of the Ministry of Justice of the Republic of Kazakhstan after its first official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Justice of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of management of single digital platform in the field of collective management of the rights and provision of single point of access to its use

Chapter 1. General provisions

1. Rules of management of single digital platform in the field of collective management of the rights and provision of single point of access to its use (further – Rules) are developed according to article 45-1 of the Law of the Republic of Kazakhstan "About copyright and the related rights" (further – the Law) and determine procedure for management of single digital platform in the field of collective management of the rights of provision of single point of access to its use.

2. In these rules the following determinations are used:

1) single digital platform in the field of collective management of the rights (further – single digital platform) – the digital system of the expert organization providing single point of access to its use in the field of collective management of the rights according to the Law;

2) registers in the field of management of property rights on collective basis – the registers of single digital platform necessary for ensuring its functioning, the stipulated in Article 45-1 Law;

3) authorized body – the state body determined by the Government of the Republic of Kazakhstan and performing state regulation in the field of copyright and the related rights;

4) the subject of single digital platform – the owner, the organization for collective management of the rights (further – OKUP), the user, the expert organization;

5) the expert organization – the organization created according to the decision of the Government of the Republic of Kazakhstan in form of business of the republican state company on the right of economic maintaining subordinated in the activities to authorized body according to the Law;

6) personal account of the subject of single digital platform (further – personal account) – the electronic office of the subject of single digital platform intended for interaction with single digital platform and other subjects and also accomplishment of other actions provided by the Law and Rules;

7) the digital signature (further – the EDS) – set of electronic digital symbols created by means of the digital signature and confirming reliability of the digital document, its accessory and invariance of content;

8) personal data – the data relating to the subject of personal data determined or determined on their basis, fixed on electronic, paper and (or) other material medium.

Chapter 2. Procedure for management of single digital platform in the field of collective management of the rights

Paragraph 1. Order of interaction of subjects of single digital platform

3. The owner within collective management of the rights signs by means of single digital platform the contract with OKUP on transfer of implementation of the property rights which contains data for filling according to appendix 1 to these rules.

4. The owner can delegate such powers only of one OKUP.

5. Under the agreements signed and existing before enforcement of the Law, OKUP provides placement of the scanned copies of such agreements on single digital platform.

6. OKUP based on the application of the owner submitted by means of single digital platform which contains data for filling according to appendix 2 to these rules excludes its objects author's and (or) the related rights from the permissions granted to this OKUP to users.

7. OKUP signs by means of single digital platform the contract on mutual representation of interests with other Kazakhstan OKUP which contains data for filling according to appendix 3 to these rules.

8. OKUP signs agreements on mutual representation of interests with foreign OKUP on paper with the subsequent placement on single digital platform within five working days from the date of the conclusion of such agreement.

9. OKUP signs by means of single digital platform the license agreement with the user on the corresponding methods of use of objects of the author's and (or) related rights which contains data for filling according to appendix 4 to these rules.

10. OKUP signs by means of single digital platform the contract on payment of remuneration with the user for the corresponding methods of use of the soundtrack published for commercial purposes without the consent of the producer of soundtrack and the contractor who contains data for filling according to appendix 5 to these rules.

11. OKUP signs by means of single digital platform the contract with the expert organization on use of single digital platform which contains data for filling according to appendix 6 to these rules.

12. Interaction of subjects of single digital platform in the field of collective management of the rights is performed by means of personal account.

13. The personal account contains the information about the owner, OKUP or the user, including identification, registration, contact information and bank details, information on objects of the author's and (or) related rights, shares of property rights, agreements, accreditation, field of activity, governing bodies and other data necessary for functioning of single digital platform.

Paragraph 2. Registers of single digital platform

14. For ensuring functioning of single digital platform the expert organization performs forming and maintaining registers in the field of management of property rights on collective basis (further – registers):

1) register of works;

2) register of authors and owners;

3) register of OKUP;

4) register of users;

5) register of agreements.

Section 1. Register of works

15. The register of works represents the list of objects of the author's and (or) related rights concerning which control of property rights on collective basis is exercised.

16. Entering of data into the register of works is performed by the owner and (or) OKUP which transfers such property rights.

17. The register of works contains the following data:

1) name of object of the author's and (or) related rights;

2) copy of object of the author's and (or) related rights (audio recording in the WAV format);

3) identification codes of the work, including international identifiers (ISRC, ISWC and others) in the presence;

4) surname, name, middle name (in the presence) and pseudonym (in the presence) the author or other owner with indication of category of right possession;

5) data on legal relationship of the owner with OKUP.

Section 2. Register of authors and owners

18. The register of authors and owners represents the list of the physical persons and legal entities which placed on single digital platform of the data on the objects of the author's and (or) related rights belonging to them, and also property rights of which are transferred in collective management.

19. The register of authors and owners contains the following data:

1) surname, name, middle name (in the presence) and pseudonym (in the presence) the author or other owner with indication of category of right possession;

2) quantity and list of works;

3) data on legal relationship of the owner with OKUP;

4) region.

Section 3. Register of OKUP

20. The register of OKUP represents the list of the organizations performing activities in the field of collective management of the rights according to the Law.

21. The register of OKUP contains the following data:

1) name OKUP;

2) BING OKUP;

3) legal address;

4) contact information (phone, e-mail address);

5) quantity and list of members of OKUP.

Section 4. Register of users

22. The register of users represents the list of the physical persons and legal entities using works based on the license agreement and on other bases provided by the Law.

23. The register of users contains the following data:

1) name of the user;

2) IIN or user's BIN;

3) type of activity;

4) registration address or legal address;

5) data on object of accounting (place of use of objects of the author's and (or) related rights);

6) data on legal relationship of the user with OKUP;

7) contact information (phone, e-mail address).

Section 5. Register of agreements

24. The register of agreements contains data about:

1) agreements on collective management of the rights;

2) agreements on mutual representation of interests;

3) license agreements;

4) agreements on remuneration payment.

25. The register of agreements on collective management of the rights contains the following data:

1) identification number;

2) agreement number;

3) the name of the owner with indication of category of right possession;

4) name OKUP;

5) right type (author's and (or) related rights);

6) duration of the agreement;

7) form of the conclusion of the agreement.

26. The register of agreements on mutual representation of interests contains the following data:

1) identification number;

2) agreement number;

3) agreement on mutual representation of interests;

4) name of one OKUP;

5) name of the second OKUP;
