a) if the parcel of land is not encumbered with the third party rights;

b) if the parcel of land is provided to public authority, either to local government body, or state to either municipal unitary enterprise, or the state company, either the public or local government office provided that agreement party for benefit of which the servitude is established is the public authority, either local government body, or state either municipal unitary enterprise, or the state company, either the public or local government office.
