About approval of the size and payment procedure of collection for driving of vehicles through artificial constructions on highways public
For the purpose of ensuring proper maintenance and operation of tunnels on highways public, according to Articles 61, 62 and 63 Codes of the Kyrgyz Republic about the non-tax income, articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:
1. Approve:
- the list of artificial constructions on highways for driving through which collection, according to appendix 1 is levied;
- the amount of payment of collection for journey of vehicles through tunnels on highways public according to appendix 2;
- collection payment procedure for journey of vehicles through tunnels on highways public according to appendix 3.
2. Recognize to invalid:
1) the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About approval of the size and payment procedure of collection for journey of vehicles through tunnels on the highway Bishkek - Osh" of December 5, 2023 No. 638;
2) the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About introduction of amendments to the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About approval of the size and payment procedure of collection for journey of vehicles through tunnels on the highway Bishkek - Osh" of December 5, 2023 No. 638" of November 12, 2024 No. 677.
3. This resolution becomes effective after fifteen days from the date of official publication.

Vehicles with the state registration registration plates of state members of EEU are vehicles of the Republic of Armenia, the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation.
Appendix 3

1. This Payment procedure of collection for journey of vehicles through tunnels on highways public (further - the Procedure) determines procedure and the payment mechanism of collection, its appointment and the purposes of use.
2. Payers are the owners of vehicles both the Kyrgyz Republic, and foreign states performing journey through tunnels on highways public if other is not provided by international treaties of the Kyrgyz Republic.
3. In this Procedure the following terms are used:
tunnel - the underground or underwater construction intended for the highway device through thickness of the earth, the massif or under water obstacle;
collection - the fee levied from the organizations and physical persons which payment is one of conditions of implementation of legally significant actions concerning payers of collection by state bodies, local government bodies, other authorized bodies and officials, including provision of certain rights or issue of permissions (licenses) or payment of which is caused by implementation within the territory in which collection, separate types of business activity is entered.
4. For collection of charges from owners of vehicles for journey of vehicles through tunnels on highways public by authorized state body in the field of transport and communications the automated payment systems of charges or check-points before entrance to tunnel and through Items of the control "Sosnovka", "Karakul" and "Kok-Arth" can be organized.
5. Collection of charges from owners of domestic and foreign vehicles by means of cash/electronic money, bank payment cards and other payment instruments is made in national currency depending on categories of vehicles with obligatory application of cash registers according to requirements of the tax legislation of the Kyrgyz Republic.
6. The amount of charges for journey of vehicles through tunnels on highways public for cars with domestic, foreign and transit registration plates is fixed.
7. Collection from owners of the vehicles which passed customs clearance, but did not undergo state registration is levied as from payers of vehicles of the Kyrgyz Republic and state members of EEU.
8. Appointment and the purposes of use of collection for journey of vehicles through tunnels on highways public are determined by the Law of the Kyrgyz Republic "About Road fund".
9. Control of completeness of receipt of charges and use of means is carried out according to the Budget Code of the Kyrgyz Republic, the Code of the Kyrgyz Republic about the non-tax income, the Law of the Kyrgyz Republic "About Road fund" and this Procedure.
10. Payment for journey in one direction is made once and can be performed in cash or electronic form according to the procedure, established by this Procedure.
11. Vehicles are exempted from payment of collection for journey through tunnels on highways public:
1) emergency medical service;
2) authorized state body in the field of Civil protection;
3) law-enforcement bodies;
4) bodies of homeland security;
5) the authorized state body knowing questions of defense;
6) authorized state body in the field of power;
7) authorized state body in the field of transport and communications;
8) National Bank of the Kyrgyz Republic;
9) managed by persons with limited opportunities of health, and also belonging to the organizations performing rehabilitation of persons with limited opportunities of health in the presence of identification mark "Disabled person" and production of documents confirming the status of person with limited opportunities of health;
10) the transporting loads of the humanitarian assistance according to the relevant documents;
11) transporting the agricultural products which are grown up directly by the producer of agricultural products in case of presentation of the reference of local government bodies containing information on the place of residence and availability of land share.
12. In case of need for refining of category and accessory of the vehicle the payer shall provide on review to the employee of check-point registration documents of the vehicle.
