About modification of the Decision of Board of the Eurasian economic commission of May 30, 2023 No. 68

According to Item 30 of the Protocol on information and communication technologies and information exchange within the Eurasian Economic Union (appendix No. 3 to the Agreement on the Eurasian Economic Union of May 29, 2014) the Board of the Eurasian economic commission SOLVED:

1. Bring in the Decision of Board of the Eurasian economic commission of May 30, 2023 No. 68 "About the technological documents regulating information exchange in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming, maintaining and use of the unified register of the registered veterinary medicines, feed additives for animals and the diagnostic, disinfecting, disinsection and disacariasis means of veterinary appointment of the Eurasian Economic Union which are not coming into direct contact with animals" changes according to appendix.

2. This Decision becomes effective after 30 calendar days from the date of its official publication.

1. Rules of information exchange in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming, maintaining and use of the unified register of the registered veterinary medicines, feed additives for animals and the diagnostic, disinfecting, disinsection and disacariasis means of veterinary appointment of the Eurasian Economic Union which are not coming into direct contact with animals", approved by the specified Decision to state in the following edition:

Rules of information exchange in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming, maintaining and use of the unified register of the registered veterinary medicines, feed additives for animals and the diagnostic, disinfecting, disinsection and disacariasis means of veterinary appointment of the Eurasian Economic Union which are not coming into direct contact with animals"

I. General provisions

1. These rules are developed according to the following international treaties and acts constituting the right of the Eurasian Economic Union (further – the Union):

The agreement on the Eurasian Economic Union of May 29, 2014 (further – the Agreement);

The decision of Council of the Eurasian economic commission of January 21, 2022 No. 1 "About Regulations of the address of veterinary medicines on customs area of the Eurasian Economic Union" (in edition of the Decision of Council of the Eurasian economic commission of April 22, 2024 No. 36) (further – Rules of the goods circulation of veterinary appointment);

The decision of Council of the Eurasian economic commission of September 23, 2022 No. 140 "About Regulations of the address of diagnostic means of veterinary appointment on customs area of the Eurasian Economic Union" (further – Rules of the goods circulation of veterinary appointment);

The decision of Council of the Eurasian economic commission of December 12, 2023 No. 150 "About Regulations of the address of disinfecting, disinsection and disacariasis means of veterinary appointment on customs area of the Eurasian Economic Union" (further – Rules of the goods circulation of veterinary appointment);

The decision of the Commission of the Customs union of June 18, 2010 No. 317 "About application of veterinary and sanitary measures in the Eurasian Economic Union";

The decision of Board of the Euroasian economic commission of November 6, 2014 №200 "About the technological documents regulating information exchange in case of realization by means of the integrated information system of foreign and mutual trade of general processes";

The decision of Board of the Eurasian economic commission of January 27, 2015 №5 "About approval of Rules of electronic data exchange in the integrated information system of foreign and mutual trade";

The decision of Board of the Euroasian economic commission of April 14, 2015 № 29 "About the list of general processes within the Eurasian Economic Union and modification of the Decision of Board of the Euroasian economic commission of August 19, 2014 № 132";

The decision of Board of the Euroasian economic commission of June 9, 2015 №63 "About the Analysis technique, optimization, harmonizations and descriptions of general processes within the Eurasian Economic Union";

The decision of Board of the Eurasian economic commission of September 28, 2015 № 125 "About approval of the Regulations on exchange of electronic documents in case of cross-border interaction of public authorities of state members of the Eurasian Economic Union among themselves and with the Eurasian economic commission".

II. Scope

2. These rules forming, maintaining and use of the unified register of the registered veterinary medicines, feed additives for animals and the diagnostic, disinfecting, disinsection and disacariasis means of veterinary appointment of the Eurasian Economic Union which are not coming into direct contact with animals" (further – general process), including the description of the procedures performed within this general process are developed for the purpose of determination of procedure and conditions of information exchange between participants of general process ".

3. These rules are applied by participants of general process in case of control of procedure for performing procedures and transactions within general process, and also during the designing, development and completion of components of the information systems providing realization of general process.

III. Basic concepts

4. For the purposes of these rules concepts which mean the following are used:

"the national information resource" – information resource which creates and conducts the body of state member of the Union authorized in the field of the goods circulation of veterinary appointment (further – state member of the Union) and (or) expert organization of state member of the Union subordinated to this body (further – authorized body), containing data on the goods of veterinary appointment registered in state member of the Union according to Rules of the goods circulation of veterinary appointment;

"general information resource of goods of veterinary appointment" – the general information resource which creates and is conducted by the Eurasian economic commission (further – the Commission), containing data on goods of veterinary appointment concerning which the registration or other procedures connected with registration according to Rules of the goods circulation of veterinary appointment, including the data of the unified register of the registered veterinary medicines, feed additives for animals and the diagnostic, disinfecting, disinsection and disacariasis means of veterinary appointment of the Union which are not coming into direct contact with animals are performed (further – general information resource);

"goods of veterinary appointment, TVN" – the object of general process determined as veterinary medicine, feed additive for animals, diagnostic means of veterinary appointment, the disinfecting, disinsection or disacariasis means of veterinary appointment which is not coming into direct contact with animals.

The concepts "group of procedures of general process", "information object of general process", "contractor", "transaction of general process", "procedure of general process" and "participant of general process" used in these rules are applied in the values determined by the Analysis technique, optimizations, the harmonization and the description of general processes within the Eurasian Economic Union approved by the Decision of Board of the Eurasian economic commission of June 9, 2015 № 63.

IV. Main data on general process

5. Full name of general process: "Forming, maintaining and use of the unified register of the registered veterinary medicines, feed additives for animals and the diagnostic, disinfecting, disinsection and disacariasis means of veterinary appointment of the Eurasian Economic Union which are not coming into direct contact with animals".

1. Purpose and tasks of general process

7. The purpose of general process is increase in efficiency of accomplishment of functions of authorized bodies in the field of control (supervision) of the address of TVN due to ensuring single approaches to registration of TVN, unity of mandatory requirements to quality, safety and efficiency of TVN in the territories of state members of the Union and their observance.

8. For goal achievement of general process it is necessary to solve the following problems:

a) provide creation, forming, maintaining in full, and also timely updating of general information resource based on information obtained from national information resource;

b) provide authorized bodies at the request of data from general information resource;

c) provide publication on information portal of the Union of urgent and authentic data from general information resource for all interested persons with possibility of search and provision of data in the set parameters, viewing, unloading and preserving data in certain formats, registrations of subscription to updates of data of information portal of the Union and operational informing interested persons;

d) provide operational information exchange between authorized bodies of the documents and data transferred within holding procedures of registration of TVN, registration confirmation of TVN, modification of the registration file of TVN (further – the registration file), reductions of registration files in compliance with Rules of the goods circulation of veterinary appointment, recognition of registration of TVN registered according to Rules of the goods circulation of veterinary appointment, cancellation of registration of TVN and suspension of the address of TVN (further respectively – procedures of registration, registration confirmation, modification of the registration file, reductions of registration files in compliance, recognitions of registration, cancellation of registration, suspension of the address, the procedure of registration and other procedures connected with registration);

e) develop, harmonize and staticize the lists, qualifiers and reference books applied at the moment by authorized bodies and necessary for forming and maintaining national information resource, exchange of the documents and data transferred within registration and other procedures connected with registration and also to develop their electronic forms;

e) provide the differentiated access to data of general information resource.

2. Participants of general process

9. The list of participants of general process is provided in table 1.

3. Structure of general process

10. General process represents set of the procedures grouped according to the destination:

a) procedures of forming and maintaining general information resource;

b) procedures of receipt of data from general information resource;

c) procedures of exchange of the data and documents necessary for exchange during registration or other procedures connected with registration;

d) procedures of the notification in case of cancellation of registration and suspension of the address of goods of veterinary appointment;

e) procedures of provision of the documents necessary for exchange during registration or other procedures connected with registration on demand.

11. In case of performing procedures of general process authorized bodies provide forming and maintaining the national information resource containing data on TVN, and submission of the specified data in the Commission for the purpose of forming and maintaining complete and urgent general information resource, and also publication of data from general information resource on information portal of the Union for interested persons. The commission provides provision of data from general information resource to authorized bodies on demand.

Authorized bodies perform information exchange of the data and documents transferred within registration or other procedures connected with registration.

12. The provided description of structure of general process is provided in the figure 1.

13. The procedure for performing procedures of general process, grouped according to the destination, including the disaggregated activity description, is given in the Section VIII of these rules.

14. For each group of procedures the general scheme showing bonds between procedures of general process and procedure for their accomplishment is provided. The general scheme of procedures is constructed with use of the graphical notation of UML (unified modeling language – Unified Modeling Language) and supplied with the text description.

4. Group of procedures of forming and maintaining general information resource

15. Performing procedures of forming and maintaining general information resource is performed on the facts of registration of TVN and (or) inclusion of data and documents on them in national information resource, and also changes of data or documents on them in national information resource.

In case of registration of TVN the "Inclusion of Data in General Information Resource" procedure is performed (P.SS.06.PRC.001), during the course of performance which the reference body for registration creates and sends to the Commission of the data and (or) documents on the registered TVN.

In case of change of data on the registered TVN, including in case of cancellation of registration and suspension of the address, the "Change of Data in General Information Resource" procedure is performed (P.SS.06.PRC.002), during the course of performance which the reference body for registration creates and sends the changed data and (or) documents on the registered TVN to the Commission.

Submission of the specified data and documents is performed according to Regulations of information exchange between authorized bodies of state members of the Eurasian Economic Union and the Eurasian economic commission in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming, maintaining and use of the unified register of the registered veterinary medicines, feed additives for animals and the diagnostic, disinfecting, disinsection and disacariasis means of veterinary appointment of the Eurasian Economic Union which are not coming into direct contact with animals", the approved Decision of Board of the Eurasian economic commission of May 30, 2023 No. 68 (further – Regulations of information exchange between authorized bodies and the Commission). The format and structure of the represented data shall match the Description of formats and structures of the electronic documents and data used for realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming, maintaining and use of the unified register of the registered veterinary medicines, feed additives for animals and the diagnostic, disinfecting, disinsection and disacariasis means of veterinary appointment of the Eurasian Economic Union which are not coming into direct contact with animals", to No. 68 approved by the Decision of Board of the Eurasian economic commission of May 30, 2023 (further – the Description of formats and structures of electronic documents and data).

16. The provided description of group of procedures of forming and maintaining general information resource is provided in the figure 2.

17. The list of the procedures of general process entering into group of procedures of forming and maintaining general information resource is provided in table 2.

5. Group of procedures of receipt of data of general information resource

18. Procedures of receipt of data and documents are carried out from general information resource in case of receipt of the corresponding request by the Commission from authorized bodies.

Within performing procedures of receipt of data from general information resource the following types of requests are processed:

information request about date and time of updating of general information resource;

request of data from general information resource;

request of changes of data from general information resource.

Information request about date and time of updating of general information resource is carried out for the purpose of assessment of need of synchronization of data on TVN which are stored in national information resource with the data containing in general information resource. When implementing request for provision of information on date and time of updating of general information resource the "Receipt of Information on Date and Time of Updating of General Information Resource" procedure is performed (P.SS.06.PRC.003).

The request of data and documents is carried out from general information resource for the purpose of receipt by authorized body of all data on TVN containing in general information resource. The data and (or) documents containing in general information resource are requested or in full, or as of certain date and time. When implementing request of data and (or) documents on TVN from general information resource the "Receipt of Data from General Information Resource" procedure is performed (P.SS.06.PRC.004).

In case of request of changes of data and (or) documents from general information resource the information and (or) documents which were added to general information resource, or to which changes, since the moment specified in request until accomplishment of this request were made are provided. When implementing request of changes of data from general information resource the "Receipt of Changes of Data from General Information Resource" procedure is performed (P.SS.06.PRC.005).

Provision of the specified data and (or) documents is performed according to Regulations of information exchange between authorized bodies and the Commission. The format and structure of the provided information and documents on TVN shall match the Description of formats and structures of electronic documents and data.

19. The provided description of group of procedures of receipt of data of general information resource is provided in the figure 3.

6. Group of procedures of exchange of the data and documents necessary for exchange during registration or other procedures connected with registration

21. Performing procedures of exchange of the data and documents transferred within registration or other procedures connected with registration is performed on number of the facts arising in the course of registration or other procedures connected with registration.

After obtaining by reference body for registration from the applicant of set of documents and the corresponding statement for holding procedures of registration, registration confirmation, modification of the registration file, reduction of registration files in compliance or statements for recognition of TVN within holding procedure of recognition of registration the "Notification on the Beginning of Conducting Examination" procedure is performed (P.SS.06.PRC.006), during the course of performance which the reference body for registration creates and sends the notification on the beginning of conducting examination to authorized body of the state of recognition.

In need of ensuring access to authorized body of the state of recognition to the documents provided by the applicant in reference body for registration and also created by reference body for registration within registration or other procedures connected with registration including to expert opinions, protocols of researches (testing), answers from the applicant to requests of the reference organizations for registration or authorized bodies on provision of missing (additional) information (in case of their obtaining from the applicant) and to other documents, the Provision of Set of Documents procedure is performed (P.SS.06.PRC.007), during the course of performance which the reference body for registration creates and sends for consideration in authorized body of the state of recognition set of documents or metadata of the documents submitted during registration or other procedures connected with registration.

In case of acceptance of the state of recognition of the decision by authorized body concerning TVN, following the results of registration or other procedures connected with registration for the territories of state member of the Union based on the carried-out analysis of the received set of documents the "Notification on Opportunity (or Impossibility) Registration or Other Procedures Connected with Registration" procedure is performed (P.SS.06.PRC.008), during the course of performance which the authorized body of the state of recognition creates and sends to reference body for registration the notification on opportunity (or impossibility) registration or other procedures connected with registration.

In case of decision making by reference body for registration concerning TVN following the results of registration or other procedures connected with registration based on the summary or concluding expert opinion the "Notification on the Made Decision following the results of Registration or Other Procedures Connected with Registration" procedure is performed (P.SS.06.PRC.009), during the course of performance which the reference body for registration creates and sends to authorized body of the state of recognition the notification on the made decision concerning TVN following the results of registration or other procedures connected with registration containing or the notification on the positive decision, or the notification on the negative decision with appendix of the negative summary or concluding expert opinion.

Submission of the specified data to authorized bodies is performed according to Regulations of information exchange between authorized bodies of state members of the Eurasian Economic Union in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming, maintaining and use of the unified register of the registered veterinary medicines, feed additives for animals and the diagnostic, disinfecting, disinsection and disacariasis means of veterinary appointment of the Eurasian Economic Union which are not coming into direct contact with animals", the approved Decision of Board of the Eurasian economic commission of May 30, 2023 No. 68 (further – Regulations of information exchange between authorized bodies). The format and structure of the represented data shall match the Description of formats and structures of electronic documents and data.

22. The provided description of group of procedures of exchange of the data and documents necessary for exchange during registration or other procedures connected with registration is provided in the figure 4.

7. Group of procedures of the notification at cancellation of registration and suspension of the address of goods of veterinary appointment

24. Performing procedures of the notification on cancellation of registration or about suspension of the address of TVN is performed upon decision making by authorized body about cancellation of registration or suspension (renewal) of the address of TVN in the territory of state member of the Union within holding procedure of cancellation of registration or the procedure of suspension of the address respectively.

In case of decision making by authorized body about cancellation of registration of TVN in the territory of state member of the Union within holding procedure of cancellation of registration the "Notification on Registration Cancellation" procedure is performed (P.SS.06.PRC.010), during the course of performance which the authorized body creates and sends the notification on cancellation of registration of TVN to the notified authorized body.

In case of decision making by authorized body about suspension (renewal) of the address of TVN in the territory of state member of the Union within holding procedure of suspension of the address the "Notification on Suspension of the Address" procedure is performed (P.SS.06.PRC.011), during the course of performance which the authorized body creates and sends the notification on suspension (renewal) of the address of TVN to the notified authorized body.

Submission of the specified data is performed according to Regulations of information exchange between authorized bodies. The format and structure of the provided information shall match the Description of formats and structures of electronic documents and data.

25. The provided description of group of procedures of the notification at cancellation of registration and suspension of the address of goods of veterinary appointment is provided in the figure 5.

8. Group of procedures of provision of the documents necessary for exchange during registration or other procedures connected with registration on demand

27. Performing procedures of provision of the documents necessary for exchange during registration or other procedures connected with registration on demand is performed in case of additional need of receipt of documents by authorized body, necessary for exchange during registration or other procedures connected with registration.

In need of receipt of the documents by authorized body necessary for exchange during registration or other procedures connected with registration the "Provision in Authorized Body of the Documents Necessary for Exchange during Registration or Other Procedures Connected with Registration on Demand" procedure is performed (P.SS.06.PRC.012), during the course of performance which the authorized body creates and sends to reference body for registration inquiry for provision to authorized body of the documents necessary for exchange during registration or other procedures connected with registration. The reference body for registration provides required documents or sends the non-availability notice of the data satisfying to request parameters to authorized body.

Provision of the specified documents is performed according to Regulations of information exchange between authorized bodies and Regulations of information exchange between authorized bodies and the Commission. The format and structure of the provided information shall match the Description of formats and structures of electronic documents and data.

28. The provided description of group of procedures of provision of the documents necessary for exchange during registration or other procedures connected with registration on demand is provided in the figure 6.
