This resolution shifts Appendix IV to Regulations (EU) 2019/1009 European parliament and Council of June 5, 2019 about establishment of rules of placement of fertilizers in the market of the EU and about change of regulations (EU) No. 1069/2009 and (EU) No. 1107/2009 and about cancellation of Regulations (EU) No. 2003/2003, CELEX: 32019R1009, published in the Official magazine of the European Union by L 170 of June 25, 2019, with the last changes made by the Delegated regulations (EU) of 2025/1421 Commission of July 17, 2025.

1. Approve Regulations on assessment procedures of compliance of fertilizers it (is applied).

2. The order of the Government No. 268/2012 about approval of the Technical regulation "Mineral fertilizers. The main requirements" (2012, Art. No. 88-91, 309) to declare the official monitor of the Republic of Moldova invalid from the effective date this resolution.

3. This resolution becomes effective after one month from the date of publication in the Official monitor of the Republic of Moldova and voids from the date of accession of the Republic of Moldova to the European Union.

Regulations on assessment procedures of compliance of fertilizers

Chapter I. Application of assessment procedures of compliance

1. This head establishes use of the modules of assessment procedure of compliance established in Chapter II, to the UE fertilizers depending on the corresponding categories of the materials which are part, and also the corresponding functional categories of products according to the procedure provided in categories of the materials which are part for the UE fertilizers (further – KVSM) and functional categories of products for the fertilizers of the EU (further – the PCF) approved by the order of the Minister of Agriculture and the food industry.

Section 1 Application of Internal Control of Production (module A)

2. The module A can be used for the UE fertilizer consisting only of one or several following of the materials which are part as it is specified in KVSM approved by the order of the Minister of Agriculture and the food industry:

2.1. substances or mixes of primary raw materials (further – KVSM 1), except for connections – inhibitor of nitrification, denitrification or urease;

2.2. digestata of fresh cultures (further – KVSM 4);

2.3. offal of the food industry (further – KVSM 6);

2.4. polymeric nutrients (further – KVSM 9);

2.5. offal in value of the Law No. 209/2016 on waste (further – KVSM 11).

3. The module A can be also used for mix of fertilizers of products (further – the PCF 7) as it is specified in the PCF, the approved order of the Minister of Agriculture and the food industry.

4. In departure from Items 2 and 3 the module A shall not be used for:

4.1. simple or compound solid inorganic ammonium and nitrate fertilizer with macrocells with the high content of nitrogen as it is specified in the PCF, the approved order of the Minister of Agriculture and the food industry, simple or compound solid inorganic ammonium and nitrate fertilizer with macrocells with the high content of nitrogen (further – the PCF 1.3.1.1.1.1–1.3.1.1.2.1), or mixes of fertilizers as more from the UE fertilizer relating to the PCF 1.3.1.1.1.1–1.3.1.1.2.1 is specified in the PCF 7, with mass fraction of nitrogen (N) of 28% or;

4.2. inhibitor (further – the PCF 5) as it is specified in the PCF, the approved order of the Minister of Agriculture and the food industry; or

4.3. biostimulator of plants (further – the PCF 6) as it is specified in the PCF, the approved order of the Minister of Agriculture and the food industry.

Section 2 Application of Internal Control of Production and Controlled Testing of Products (Module A 1)

5. The A1 module is used for simple or compound solid inorganic ammonium and nitrate fertilizer with macrocells with the high content of nitrogen as it is specified in the PCF 1.3.1.1.1.1–1.3.1.1.2.1, and also mixes of fertilizers as it is specified in the PCF 7, which contains mass fraction of nitrogen (N) of 28% or more from the UE fertilizer relating to the PCF 1.3.1.1.1.1–1.3.1.1.2.1.

The Section 3 Application of Testing of Standard Product Sample on compliance to the European requirements (Module B) which the compliance to standard product sample based on internal control of production (Module C) follows

6. The module B which the module C follows can be used for the UE fertilizer consisting only of one or several following of the materials which are part:

6.1. connection – the inhibitor of nitrification, denitrification or urease determined in KBCM 1 according to KVSM approved by the order of the Minister of Agriculture and the food industry;

6.2. plants, parts of plants or plant extracts (further – KVSM 2) determined in KVSM approved by the order of the Minister of Agriculture and the food industry;

6.3. microorganisms (further – KVSM 7) determined in KVSM approved by the order of the Minister of Agriculture and the food industry;

6.4. other polymers, except the polymeric nutrients determined in KBCM 9 according to KVSM approved by the order of the Minister of Agriculture and the food industry;

6.5. the derivative products in value of the Law No. 129/2019 on the offal of animal origin and derivative products which are not intended for consumption by the person determined in KBCM 10 according to KVSM approved by the order of the Minister of Agriculture and the food industry;

6.6. KVSM specified in Item 2.

7. The module B which the module C follows can be also used for the mix of fertilizers determined in the PCF 7.

8. In departure from Items 6 and 7 the module B which the module C follows shall not be used for simple or compound solid inorganic ammonium and nitrate fertilizer with macrocells with the high content of the nitrogen determined in the PCF 1.3.1.1.1.1–1.3.1.1.2.1, or the mix of fertilizers determined in the PCF 7, which contains mass fraction of nitrogen (N) of 28% or more from the UE fertilizer relating to the PCF 1.3.1.1.1.1–1.3.1.1.2.1.

Section 4 Application of Quality Assurance of Production Process (Module D 1)

9. The D1 module can be used for any UE fertilizer.

10. In departure from Item 9 the D1 module shall not be used for simple or compound solid inorganic ammonium and nitrate fertilizer with macrocells with the high content of the nitrogen determined in the PCF 1.3.1.1.1.1–1.3.1.1.2.1, or the mix of fertilizers determined in the PCF 7, which contains mass fraction of nitrogen (N) of 28% or more from the UE fertilizer relating to the PCF 1.3.1.1.1.1–1.3.1.1.2.1.

11. Internal control of production represents assessment procedure of compliance by means of which the producer fulfills the obligations provided in Items 12-18, provides and under the sole responsibility declares that the corresponding UE fertilizers meet the requirements of this provision, applicable to them.

12. The producer establishes technical documentation. Documentation allows to estimate the UE fertilizer from the point of view of its compliance to applicable requirements and includes the proper analysis and risk assessment (risks).
