1. Approve Rules of holding the auction and licensing following the results of auction for investigation or production of solid minerals.

2. Recognize invalid some regulatory legal acts of the Republic of Kazakhstan according to the list according to appendix to this order.

3. To provide to department of subsurface use of the Industry ministry and construction of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on official Internet resource of the Industry ministry and construction of the Republic of Kazakhstan after its official publication.

4. To impose control of execution of this order on the supervising vice-Minister of Industry and construction of the Republic of Kazakhstan.

5. This order becomes effective becomes effective after day of its first official publication.

Rules of holding the auction and licensing following the results of auction for investigation or production of solid minerals

Chapter 1. General provisions

1. These rules of holding the auction and licensing following the results of auction for investigation or production of solid minerals (further - Rules) are developed according to Item 1 of article 221-2 of the Code of the Republic of Kazakhstan "About subsoil and subsurface use" (further - the Code) and determine procedure for holding the auction and licensing following the results of auction for investigation or production of solid minerals.

2. For carrying out transactions on investigation or production of solid minerals, except for popular minerals and uranium, based on auction the following subsoil plots are provided:

1) on production of solid minerals on the subsoil plots containing the inventories and (or) resources of solid minerals, except for popular minerals and uranium included in the state accounting of minerals and free from carrying out the transactions on subsurface use provided by subitems 2), 3) and 4) of article 22 of the Code;

2) on investigation of solid minerals on subsoil plots with the revealed perspectives by results of the state geological studying of subsoil;

3) on investigation of solid minerals on the territories of contracts for investigation, the combined exploration and production of the solid minerals recognized invalid, not prolonged or ahead of schedule stopped, except for the territories provided by the subitem 1) of this Item.

In these rules the following basic concepts are used:

1) the auction territory - the territory provided in the management program by the state fund of subsoil within which following the results of auction the site of investigation or production of solid minerals is subject to provision;

2) the salesroom - the Section of the web portal of the register providing possibility of input, storage and the information processing necessary for holding the auction;

3) bid increment - the size by which the size of subscription bonus increases;

4) auction number - number assigned to the participant for participation in auction in the presence of the digital signature;

5) auction object (further - object) - the subsurface use right granted following the results of auction for carrying out transactions for investigation or production of solid minerals;
