About modification and amendments in the joint order of the acting minister of national economy of December 30, 2015 No. 835 and the Minister of Energy of the Republic of Kazakhstan of December 15, 2015 No. 721 "About approval of Criteria for evaluation of risk degree and checking sheets in the field of environmental protection, reproduction and use of natural resources"

WE ORDER:

1. Bring in the joint order of the acting minister of national economy of the Republic of Kazakhstan of December 30, 2015 No. 835 and the Minister of Energy of the Republic of Kazakhstan of December 15, 2015 No. 721 "About approval of criteria for evaluation of risk degree and checking leaf in the field of environmental protection, reproduction and use of natural resources", (it is registered in the Register of state registration of regulatory legal acts for No. 12779) the following changes and amendments:

in Criteria for evaluation of risk degree and risk management in the field of environmental protection, reproduction and use of natural resources for selection of subjects (objects) of control (further – Criteria) approved by the specified order:

the paragraph one of Item 7 to state in the following edition:

"7. For assessment of risk degree of preventive control with visit of subjects (objects) of control the following sources of information are used.";

paragraph the fourth Item 7:

add with subitems 3), 4) and 5) of the following content:

"3) results of monitoring of the reporting and the data represented by the subject of control;

4) availability of the adverse incidents which arose because of the subject of control including the fires, accidents, incidents and incidents;

5) availability and the number of the confirmed claims and addresses.";

state Item 10 in the following edition:

"10. Subjects (objects) of control are transferred using digital system from high risk in average risk degree or from average risk degree in low risk degree if subjects are members of the self-regulatory organization based on voluntary membership (participation) according to the Law of the Republic of Kazakhstan "About self-regulation" with which the agreement on recognition of results of activities of self-regulatory organization is signed.";

state Item 12 in the following edition:

"12. The system of assessment and risk management is conducted with use of the digital systems carrying subjects (objects) of control to specific risk degrees and creating schedules or lists of holding control actions and also is based on the state statistics, results of departmental statistical observation, and also information tools.

In the absence of digital system of assessment and risk management minimum admissible threshold of amount of subjects (objects) of control concerning which are performed preventive control with visit of subject (object) of control and (or) check on compliance to requirements shall not exceed five percent from total quantity of such subjects of control.

Degrees violation of requirements to subjects (objects) of control when carrying out preventive control and check on compliance to requirements, are given in appendix 1 to these Criteria.";

to be reworded as follows appendix 1 and 2 to the specified Criteria according to appendix 1 and 2 to this joint order;

to be reworded as follows appendices 2 and 3 to the joint order according to appendices 3 and 4 to this joint order.

2. To provide to committee of ecological regulation and control of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this joint order on Internet resource of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan after its official publication;

3) within sixty working days after state registration of this joint order submission to Department of legal service of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this joint order on the supervising vice-minister of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan.

4. This joint order becomes effective after sixty calendar days after day of its first official publication.

5. After five working days after state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan its direction in Committee on legal statistics and special accounting of the Prosecutor General's Office of the Republic of Kazakhstan for placement in the information system "Unified Register of Subjects and Objects of Checks".
