About acceptance in citizenship of the Russian Federation residents of Transnistria

For the purpose of protection of rights and freedoms of man and citizen, being guided by the conventional principles and rules of international law, according to part 14, item 4 of part 1 of article 28 of the Federal Law of April 28, 2023 No. 138-FZ "About citizenship of the Russian Federation" I decide 3 Articles:

1. Determine that the foreign citizens and stateless persons which reached age of 18 years, having capacity to act and permanent living on the date of entry into force of this Decree in Transnistria, have the right to file the application for admission in citizenship of the Russian Federation according to part 9 of article 16 of the Federal Law of April 28, 2023 No. 138-FZ "About citizenship of the Russian Federation" without observance of the requirements provided by Items 1 - 3 parts 1 of article 15 of the called Federal Law.

2. Orphan children and children without parental support, incapacitated persons, permanent living on the date of entry into force of this Decree in Transnistria, have the right to acquire citizenship of the Russian Federation according to part 9 of article 16 of the Federal Law of April 28, 2023 No. 138-FZ "About citizenship of the Russian Federation".

3. With the application for admission in citizenship of the Russian Federation the children and incapacitated persons called in Item 2 of this Decree having the right to address:

a) the guardian or the custodian of the child or the guardian of incapacitated person who are the foreign citizens or stateless persons called in Item 1 of this Decree, except for case of establishment of guardianship or custody based on the joint statement of parents on appointment to their child of the guardian or the custodian for the period during which on reasonable excuses they will not be able to fulfill the parental responsibilities;

b) the head of the organization for orphan children and children without parental support which is in Transnistria and in which under supervision the child, the head of the educational organization which is in Transnistria, the medical organization or the organization rendering social services is placed if incapacitated person is placed under supervision in such organization, except for the case provided by part 4 of article 11 of the Federal Law of April 24, 2008 No. 48-FZ "About guardianship and custody";

c) the head of guardianship and custody body, the acting as the guardian or the custodian concerning the child or incapacitated person.

4. The application for admission in citizenship of the Russian Federation is submitted respectively in forms according to appendices No. 1 and 2 to diplomatic representation or consular establishment of the Russian Federation which list is conducted and supported in urgent condition by the Ministry of Foreign Affairs of the Russian Federation on its official site on the Internet.

5. The application for admission is submitted to citizenship of the Russian Federation taking into account the requirements provided by Items 7 - 11, 18 and 25 Regulations on procedure for consideration of questions of the citizenship of the Russian Federation approved by the Presidential decree of the Russian Federation of November 22, 2023 No. 889 "Questions of citizenship of the Russian Federation".

6. The foreign citizens and stateless persons called in Item 1 of this Decree together with the application for admission represent to citizenship of the Russian Federation:

a) the identity document and nationality of the applicant or absence of nationality at it;

b) the document confirming the registration fact at the place of residence in Transnistria on the date of entry into force of this Decree issued actually acting in Transnistria on the date of entry into force of this Decree by authorized body of the public power;
