About modification of the Order of the Government No. 548/2018 about the organization and functioning of Inspectorate for environmental protection

1. In the Order of the Government No. 548/2018 about the organization and functioning of Inspectorate for environmental protection (Official monitor of the Republic of Moldova, 2018, Art. No. 210-223, 602), with subsequent changes, to make the following changes:

1.1. 3) of Item 1 to declare the subitem invalid;

1.2. state Item 2 in the following edition:

"2. Establish the extreme number of Inspectorate for environmental protection in number of 273 units with the annual salary fund according to legislation provisions.";

Regulations on the organization and functioning of Inspectorate for environmental protection

I. General provisions

1. The regulations on the organization and functioning of Inspectorate for environmental protection (further - the Provision) regulate the mission, functions, powers, the rights and procedure for its organization.

2. The inspectorate for environmental protection (further - Inspection) is the administrative authority subordinated to the Ministry of the environment with the status of the legal entity of the public law, with the location in municipium of Chisinau which has the name, seal with the image of the State Emblem of the Republic of Moldova, treasurer accounts, and also other characteristic attributes of bodies of the public power established by the legislation.

3. Financing and material logistics of activities of Inspection are performed at the expense of the means provided in the government budget and the means arriving from other sources according to the legislation.

4. In the spheres of activity the Inspectorate cooperates with bodies of the public power, bodies of local public authority, public organizations, bodies, the equipped control functions, with non-profit organizations, educational and research organizations, mass media, and also with profile foreign organizations - in the areas specified in Item 7.

5. In the activities Inspection is guided by the Constitution of the Republic of Moldova, the Law No. 98/2012 on the central branch public management, the Law No. 136/2017 on the Government, the Law No. 1515/1993 on environmental protection and the Law No. 131/2012 on the state control and other regulations.

6. Planning, implementation and registration of the state control of persons who are engaged in business activity is made according to provisions of the Law No. 131/2012 on the state control.

II. Mission, spheres of activity, main functions and rights of inspection

7. The mission of Inspectorate is ensuring realization of state policy in the field of environment protection and rational use of natural resources, implementation of the state control and supervision, the prevention of violations and counteraction by it in the competences provided in Item 8.

8. Inspection performs the functions established in the Provision, in the following competences:

8.1. implementation of policy in the field of environmental protection;

8.2. protection of atmospheric air;

8.3. protection of water resources;

8.4. protection of flora, fauna and the protected natural territories;

8.5. protection of the earth and subsoil;

8.6. waste management and chemicals;

8.7. rational use of natural resources;

8.8. control of genetically modified organisms;

8.9. state control;

8.10. management of ecological incidents.

9. According to the spheres of activity established in Item 7, Inspection performs the following main functions:
