About approval of rules of carrying out the state certification of the organizations of education realizing general education training programs of preschool education and training, primary, main secondary and general secondary education, educational programs of technical and professional, postsecondary education irrespective of patterns of ownership and departmental subordination

According to the subitem 1) of Item 3 of article 55-1 of the Law of the Republic of Kazakhstan "About education" I ORDER:

1. Approve the enclosed Rules of carrying out the state certification of the organizations of education realizing general education training programs of preschool education and training, primary, main secondary and general secondary education, educational programs of technical and professional, postsecondary education irrespective of patterns of ownership and departmental subordination (further – Rules).

2. To provide to committee on quality assurance in the field of formation of the Ministry of Public Education of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Public Education of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order submission to Legal department of the Ministry of Public Education of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of education of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Determine that since July 12, 2026:

the subitem 3) of Item 2, the subitem 7) of Item 16, subitems 2) and 3) of Item 17, Item 48 of Rules are effective in the following edition:

"3) complex testing – the form of assessment of results of training which is carried out at the same time on several subject matters using digital technologies;";

"7) educational and methodical and digital resources;";

"2) the data containing in the National educational database, and also in the digital systems and digital platforms used by the organizations of education;

3) data from digital systems of state bodies and official Internet resources";

"48. Computer testing of students of 4 and 9 classes is carried out in the form of complex testing using digital technologies and use of test tasks, for the purpose of determination of level of development of educational programs on compliance to requirements of GOSO.";

appendices 1, 2 and 3 to Rules are effective in edition according to appendices 2, of 3, and 4 to this order.

Rules of carrying out the state certification of the organizations of education realizing general education training programs of preschool education and training, primary, main secondary and general secondary education, educational programs of technical and professional, postsecondary education irrespective of patterns of ownership and departmental subordination

Chapter 1. General provisions

1. These rules of carrying out the state certification of the organizations of education realizing general education training programs of preschool education and training, primary, main secondary and general secondary education, educational programs of technical and professional, postsecondary education irrespective of patterns of ownership and departmental subordination (further – Rules), are developed according to the subitem 1) of Item 3 of article 55-1 of the Law of the Republic of Kazakhstan "About education" and determine procedure for carrying out the state certification of the organizations of formation of appropriate level.

2. In these rules the following concepts are used:

1) the educational program – the single complex of the main characteristics of education including the purposes, results and content of training, the organization of educational process, methods and methods of their realization, criteria for evaluation of results of training;

2) the state certification of the organizations of education (further – the state certification) – the procedure of complex quality evaluation and availability of education directed to determination of compliance of educational activities to requirements of the state obligatory standard of appropriate level of education.

3) complex testing – the form of assessment of results of training which is carried out at the same time on several subject matters using information and communication technologies;

4) conflict of interest – contradiction between private interests of person offered for inclusion in structure of certifying commission, or the member of certifying commission and its obligations in case of whom private interests can affect objectivity, impartiality and proper execution of the obligations by it;

5) the training program – the program determining content and amount of knowledge, abilities, skills and competences which are subject to development by each subject, each subject matter and (or) the module;

6) the curriculum – the document regulating the list, the sequence I will eat around (labor input) of subjects, subject matters and (or) modules, professional practice, other types of educational activities of students of appropriate level of education and form of control;

7) results of training – the amount of knowledge, abilities, the skills acquired, shown to students on development of the educational program confirmed with assessment and the created values and the relations.

3. The state certification is carried out:

1) Committee on quality assurance in the field of formation of the Ministry of Public Education of the Republic of Kazakhstan (further – Committee) – concerning the republican organizations of education realizing general education training programs of preschool education and training, primary, main secondary and general secondary education, and also educational programs of technical and professional, postsecondary education irrespective of departmental subordination, except for the organizations of education which state certification is carried out by authorized body in the field of health care;

2) territorial subdivisions of Committee (further – territorial subdivisions) – concerning the organizations of education realizing general education training programs of preschool education and training, primary, main secondary and general secondary education, and also educational programs of technical and professional, postsecondary education irrespective of patterns of ownership and departmental subordination, except for the republican organizations of education and the organizations of education which state certification is carried out by authorized body in the field of health care.

4. The state certification is carried out once in five years.

5. The first state certification is carried out in newly created:

1) the organizations of education realizing general education training programs of preschool education and training – after three years from the moment of the beginning of activities;

2) the organizations realizing general education training programs of primary, main secondary and general secondary education – after four years;

3) the organizations realizing educational programs of technical and professional, postsecondary education – not later than one year from the moment of the first release of specialists.

6. When carrying out the state certification processing of personal data of pupils, students, teachers and other persons is performed according to the Law of the Republic of Kazakhstan "About personal data and their protection" and in the amount necessary for goal achievement of the state certification.

Fixing audio-, photo and video content is allowed in case of the prior notice of the head of the organization of education and is performed without intervention in educational process.

Chapter 2. Procedure for carrying out the state certification

7. The state certification consists of the following stages:

1) approval of the list of the organizations of education, subjects of the state certification forthcoming calendar year (further – the List);

2) carrying out formation of self-assessment of educational activities by the organization;

3) conducting computer testing of students of 4 and 9 classes;

4) forming of certifying commission;

5) carrying out the state certification and creation of the conclusion;

6) assessment of elimination of the revealed discrepancies with visit of the organization of education (in case of their identification);

7) decision making about recognition of the organization of education which passed or did not undergo the state certification.

8. The committee and its territorial subdivisions annually till November 1 approve the List, with indication of the planned terms (months) of carrying out the state certification for each organization of education.

The list is placed on Internet resources of Committee and its territorial subdivisions within 3 (three) working days from the date of approval.

Modification and amendments in the List is performed in cases of reorganization, liquidation of the organization of education, and also emergence of emergency situations of natural and technogenic nature, introduction of emergency state, origin or threat of emergence of distribution of epidemic, the centers of quarantine objects and especially dangerous harmful organisms, infectious parasitic diseases, poisonings, radiation accidents and related restrictions.

9. The organizations of education included in the List carry out self-assessment of educational activities on the basis of the criteria of estimation established by these rules and place materials of self-assessment of educational activities on the official Internet resources at least in 5 (five) days prior to the starting date of the state certification specified in the List.

10. Materials of self-assessment shall be reliable, complete and urgent at the time of their placement.

Materials of self-assessment contain analytical information on the directions and evaluation criteria provided by these rules with appendix of confirmatory materials.

Non-presentation or representation of incomplete or doubtful materials of self-assessment is considered by certifying commission in case of assessment of educational organization activity of education.

11. Within preparation for the state certification in the organizations of education realizing educational programs of primary, main secondary and general secondary education computer testing of students of 4 and 9 classes is held.

Results of computer testing are used by certifying commission in case of assessment of educational organization activity of education.

The procedure for conducting computer testing is determined by Chapter 5 of these rules.

12. The certifying commission is created by Committee or its territorial subdivision within the competence of structure at least 3 (three) people.

The representative of Committee or its territorial subdivision is appointed the chairman of certifying commission.

From among members of certifying commission the secretary of the commission is determined. The secretary of certifying commission provides the organization of its work and taking the minutes of meeting.

13. Are part of certifying commission:

1) representatives of Committee and (or) its territorial subdivisions;

2) representatives of state bodies under which departmental supervision the organizations of education (are when carrying out the state certification of the state organizations of education), and (or) representatives of the educational and methodical centers which are under authority of governing bodies of education;

3) the representatives of the organizations of education, and also professional associations (associations) in the field of education (under approval) having work experience on profile of activities of the certified organization of education from number:

the teachers having qualification categories "teacher expert", "teacher-researcher", "teacher master" and (or) the master's degree;

methodologists, heads and deputy managers of the organizations of education conforming to the qualification requirements established by the Standard qualification characteristics of positions of teachers approved by the order of the Minister of Education and Science of the Republic of Kazakhstan of July 13, 2009 No. 338 (it is registered in the Register of state registration of regulatory legal acts at No. 5750);

representatives of professional associations (associations) having the corresponding experience and (or) expert competences in the field of education;

4) representatives of National chamber of entrepreneurs of the Republic of Kazakhstan of Atameken, employers and (or) social partners (for the organizations of technical and professional, postsecondary education) (under approval).

14. Certifying commission persons having conflict of interest are not included.

The member of certifying commission in case of availability or emergence of conflict of interest shall notify without delay on it Committee or its territorial subdivision.

In case of identification of conflict of interest the corresponding person is subject to replacement with observance of requirements to structure of certifying commission.

15. The state certification is carried out by certifying commission without visit of the organization of education to the terms provided by the List and does not exceed 7 (seven) working days, except as specified, stipulated in Item 24 these rules.

Organization activity of education for the previous 2 (two) academic years and the current academic year taking into account terms of carrying out the state certification is subject to the state certification.

16. The directions of studying when carrying out the state certification, including by specialties, are determined taking into account the education level and include:

1) general characteristic, including general information about the organization of education;

2) personnel structure, including analysis of personnel potential;

3) contingent of pupils and students;

4) educational and methodical work in the organization of education;

5) educational work;

6) material logistics;

7) educational and methodical and information resources;

8) results of computer testing of students of 4 and 9 classes;

9) organization of work and professional practice.

17. The state certification is carried out by the analysis, studying and comparison of data:

1) the materials of self-assessment of educational activities placed on official Internet resources of the relevant organization of education;

2) the data containing in the National educational database, and also in the information systems and digital platforms used by the organizations of education;

3) data from information systems of state bodies and official Internet resources;

4) results of computer testing of students of 4 and 9 classes.

18. Assessment of organization activity of education is performed on the basis of the criteria of estimation established by appendices 1, 2 and 3 to these rules.

19. By results of complex quality evaluation and availability of education the certifying commission jointly makes the decision on compliance or discrepancy of educational organization activity of education to requirements of the state obligatory standards of preschool education and training, initial, main average and general secondary, technical and professional, postsecondary education approved by the order of the Minister of education of the Republic of Kazakhstan of August 3, 2022 No. 348 (it is registered in the Register of state registration of regulatory legal acts at No. 29031) (further – GOSO).

20. The decision of certifying commission is made by a majority vote her members. In case of equality of votes the voice of the chairman of certifying commission is decisive. The course of meeting of certifying commission and the made decision are drawn up by the protocol which is signed by the chairman and the secretary.

21. By results of the state certification by certifying commission the Conclusion of the state certification (further – the Conclusion) which is signed by the chairman and members of certifying commission is drawn up.

22. In the Conclusion are specified:

1) data on the organization of education;

2) information about structure of certifying commission;

3) results of assessment on the directions, stipulated in Item 16 these rules;

4) decision on compliance or discrepancy of educational organization activity of education to requirements of GOSO;

5) recommendations about education organization activity enhancement.

23. In case of identification by results of the state certification of discrepancies of educational organization activity of education to requirements of GOSO (further – discrepancies) the minutes abstract of meeting of certifying commission with appendix of materials of the state certification goes to Committee or its territorial subdivision no later than 1 (one) working day from the date of signing of the protocol.

24. The committee or its territorial subdivision based on minutes abstract of meeting of certifying commission sends to the organization of education the notification on need of elimination of the revealed discrepancies (further – the Notification) no later than 3 (three) working days from the date of receipt of the statement.

In the Notification the term for elimination of the revealed discrepancies which is not exceeding 3 (three) months from the date of its direction is established.

25. The organization of education concerning which by results of the state certification discrepancies are revealed within 5 (five) working days from the date of receipt of the Notification develops and sends to Committee or its territorial subdivision the actions plan on elimination of the revealed discrepancies (further – the actions plan).

26. The actions plan contains list of actions for elimination of the revealed discrepancies, completion form, terms of their execution and executives in charge.

27. After the term established for elimination of the revealed discrepancies, the organization of education sends information and documents confirming their elimination to Committee or its territorial subdivision.

28. Non-presentation of information and documents confirming elimination of the revealed discrepancies is considered at the scheduled time as their not elimination and is the basis for recognition of the organization of formation of GOSO which is not conforming to requirements.

29. Assessment of elimination of the revealed discrepancies is performed by the certifying commission created according to Item 12 of these rules with visit of the organization of education based on the submitted documents and within earlier revealed discrepancies.

The structure of certifying commission is subject to change in the cases interfering participation of her members in evaluating and also in the presence of conflict of interest.

30. By results of assessment of elimination of the revealed discrepancies the certifying commission makes the decision on compliance or discrepancy of educational organization activity of education to requirements of GOSO and draws up it in the form of the Conclusion according to Item 22 of these rules.

31. The state certification is considered complete from the date of signing of the Conclusion.

32. The conclusion goes the organizations of education by the electronic method providing confirmation of its obtaining including by means of electronic document management system or e-mail.

Date of confirmation of its delivery is considered the date of receipt of the Conclusion.

33. In case of disagreement with the Conclusion the organization of education has the right to send to Committee or its territorial subdivision written notes and (or) objections within 3 (three) working days from the date of receipt of the Conclusion.

The committee or its territorial subdivision considers the arrived notes and (or) objections before decision making by results of the state certification.

In case of receipt of notes and (or) objections Committee or its territorial subdivision notifies the organization of education on time, date and the place (method) of carrying out hearing for provision of opportunity to express line item according to the arrived notes and (or) objections. Hearing is carried out according to the procedure and terms, stipulated in Article 73 Administrative procedural Procedure Codes of the Republic of Kazakhstan.

By results of consideration of notes and (or) objections Committee or its territorial subdivision makes the decision on their satisfaction or directs the motivated answer about refusal.

Chapter 3. Criteria for evaluation of the organizations of education

34. Assessment of educational organization activity of education is performed by criteria using the measuring instruments carried to the following levels:

1) "exemplary" – 5 points;

2) "good" – 4 points;

3) "requiring improvement" – 3 points;

4) "low" – 2 points.

35. Measuring instruments to evaluation criteria are used according to appendices 1, 2 and 3 to these rules.

36. Level of educational organization activity of education is determined as arithmetic average value of estimates by criteria with rounding to the next whole value.

37. Results of assessment of educational organization activity of education are drawn up in form according to appendix 4 to these rules.
