About approval of Rules of rendering the state service "Licensing for Export and (or) Import of Separate Types of Coals"

According to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state and socially responsible services" I ORDER:

1. Approve the enclosed Rules of rendering the state service "Licensing for Export and (or) Import of Separate Types of Coals" (further - Rules).

2. To provide to committee of the state energy supervision and control of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan provision in Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after sixty calendar days after day of its first official publication.

Item 7 of Rules is effective in the following edition:

"7. The physical person or legal entity (further - uslugopoluchatel) for receipt of the state service sends to the service provider through the web portal of "the digital government" (further - the portal) the documents necessary for rendering the state service which list is provided in Item 10 of the List of the main requirements to rendering the state service according to appendix 1 to these rules (further - the List of the main requirements to rendering the state service).

Execution of statements on licensing for export and (or) import of separate types of coals is regulated by the Instruction for execution of statements on issue of export licenses or import of separate types of goods and to execution of such licenses according to appendix 1 to Rules of issue of the licenses and import permits and (or) commodity import included in the single inventory to which measures of non-tariff regulation in trade with the third countries, the approved Decision of Council of the Eurasian economic commission of November 24, 2023 in No. 125 are applied (further - Rules of issue of the licenses and import permits and (or) commodity import included in the single inventory to which measures of non-tariff regulation in trade with the third countries are applied).

When giving the uslugopoluchatel of all necessary documents by means of the portal - in "personal account" of uslugopoluchatel displays the status about acceptance of request for rendering the state service with indication of the date of receipt of result of the state service.";

Item 10 of Rules is effective in the following edition:

"10. The executive in charge within 2 (two) working days from the moment of registration of the documents submitted by uslugopoluchatel checks completeness of such documents and, in case of establishment of incompleteness of the submitted documents, prepares the motivated refusal in form according to appendix 2 to these rules (further - motivated refusal) signed by the digital signature of the head of the service provider or replacement his face and sends it to uslugopoluchatel through the portal in electronic form to personal account of uslugopoluchatel.

The service provider receives data on the identity document, on state registration (re-registration) of the legal entity, the individual entrepreneur, on payment through payment gateway of "the digital government" from the corresponding state digital systems through lock of "the digital government".";

Item 13 of Rules is effective in the following edition:

"13. The service provider provides entering of data on stage of rendering the state service into digital monitoring system of rendering the state services according to the procedure, determined by authorized body in the field of digitalization, according to the subitem 11) of Item 2 of article 5 of the Law.
