About introduction of amendments to some laws of Ukraine concerning harmonization of the sphere of accreditation of conformity assessment bodies and system of technical regulation with provisions of the right of the European Union

The Verkhovna Rada of Ukraine decides:

I. Make changes to such laws of Ukraine:

1. In the Law of Ukraine "About accreditation of conformity assessment bodies" (Sheets of the Verkhovna Rada of Ukraine, 2001, No. 32, Art. 170 with the following changes):

Preamble to add 1) with the paragraph of the following content:

"This Law is directed to accomplishment of obligations of Ukraine in the field of the European integration on implementation of Regulations of the European Parliament and Council (EU) to No. 765/2008 of July 9, 2008 about establishment of requirements to accreditation and about cancellation of Regulations (EEC) No. 339/93";

2) in Article 1:

state paragraph two in the following edition:

"accreditation of conformity assessment bodies (further - accreditation) - the certificate national authority on accreditation of the fact that the conformity assessment body for implementation of certain activities for assessment of conformity conforms to requirements";

after paragraph two to add with two new paragraphs of the following content:

"the national standards accepted on the basis of the corresponding harmonized European standards, and also in case of need to any additional requirements in the respective spheres - in sectors which are covered by the agreement between Ukraine and the European Union on assessment of conformity and the acceptability of industrial output;

the standards accepted on the basis of the corresponding international or European standards, including the harmonized European standards, or to requirements of the international or European standards, including the harmonized European standards (further - standards for the accreditation purposes), and also in case of need to any additional requirements in the respective spheres - in the sectors which are not covered by the agreement between Ukraine and the European Union on assessment of conformity and the acceptability of industrial output".

With respect thereto the third or tenth to consider paragraphs respectively paragraphs the fifth or twelfth;

the fifth to state the paragraph in the following edition:

"mutual assessment process of assessment of national authority on accreditation by other national authorities on accreditation, performed according to requirements of the European regional organization for the accreditation recognized by the European Commission, and in applicable cases - additional sectoral technical specifications";

in paragraph ten to exclude the word "Ukraine", and after the word of "standards" to add with the words "for the purposes of accreditation";

in the paragraph the twelfth to exclude the word "Ukraine";

add with part of the following content:

"Terms" the harmonized European standard ", " the European Union law on harmonization", "conformity assessment body", "assessment of conformity" and" the technical specification "are used in the value determined by the Law of Ukraine "About technical regulations and assessment of conformity";

Article 2 to state 3) in the following edition:

"Article 2. Law coverage

Whether this Law governs the relations connected with accreditation of conformity assessment bodies irrespective of accreditation or activities for assessment of conformity obligatory is (which obligation is stipulated by the legislation) or voluntary, and extends to executive bodies, national authority of Ukraine on accreditations and conformity assessment bodies irrespective of pattern of ownership";

Article 3 to add 4) with part of the following content:

"Subjects of powers of authority, including courts, in case of application of regulations of the legislation specified in part one of this Article consider law-enforcement practice of the European Union, including apply by hearing of cases as source of the national right of the judgment of the European Union, practice of the European Commission on application of provisions of Regulations of the European Parliament and Council (EU) No. 765/2008 of July 09, 2008 about establishment of requirements to accreditation and about cancellation of Regulations (EEC) No. 339/93";

"The national standards concerning accreditation harmonized with the corresponding international and European standards" shall be replaced with words 5) in the first offer of part two of Article 5 of the word "standards for the accreditation purposes";

6) in Article 6:

to add part one after the word "Accreditation" with words" in Ukraine";

after part three to add with new part of the following content:

"The central executive body providing forming of state policy in the field of economic development provides to the European Commission and the European regional organization for the accreditation recognized by the European Commission, information on national authority of Ukraine on accreditation and on all types of activity on assessment of conformity concerning which it performs accreditation for the purposes of the European Union law on harmonization, and also about any corresponding changes".
