Some questions of registration (including instead of lost or stolen), exchange of the passport of the citizen of Ukraine and the passport of the citizen of Ukraine for trip abroad, including abroad

According to part one of article 16 of the Law of Ukraine "About the Unified state demographic register and documents confirming citizenship of Ukraine, proving the identity or her special status" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for simultaneous registration (including instead of lost or stolen), exchange of the passport of the citizen of Ukraine and passports/passports of the citizen of Ukraine for trip abroad which is applied.

2. Determine that registration (including instead of lost or stolen), the exchanges of the passport of the citizen of Ukraine and the passport of the citizen of Ukraine for trip abroad begun before entry into force of the Law of Ukraine of April 11, 2024 with No. 3633-IX "About modification of some legal acts of Ukraine of rather single questions of passing of military service, mobilization and military accounting" including their issue, are performed according to the legislation existing on acceptance date of documents for their registration.

3. Bring in resolutions of the Cabinet of Ministers of Ukraine of May 7, 2014 No. 152 "About approval of sample of the form, technical description and the Procedure for registration, issue, exchange, transfer, withdrawal, return to the state, recognitions invalid and destructions of the passport of the citizen of Ukraine for trip abroad" (The Official Bulletin of Ukraine, 2014, No. 45, Art. 1188; 2017, No. 2, Art. 38; 2022, No. 31, Art. 1648, No. 87, Art. 5397; 2023, No. 58, the Art. 3273) and of March 25, 2015 No. 302 "About approval of sample of the form, technical description and procedure for registration, issue, exchange, transfer, withdrawal, return to the state, recognitions invalid and destructions of the passport of the citizen of Ukraine" (The Official Bulletin of Ukraine, 2015, No. 40, Art. 1188; 2016, No. 87, Art. 2829; 2018, No. 80, Art. 2669; 2020, No. 23, Art. 855; 2021, No. 86, Art. 5479; 2022, No. 4, Art. 207, No. 12, Art. 662, No. 87, Art. 5397; 2023, No. 58, Art. 3273; 2024, No. 51, the Art. 3093) the enclosed changes.

Procedure for simultaneous registration (including instead of lost or stolen), exchange of the passport of the citizen of Ukraine and passports/passports of the citizen of Ukraine for trip abroad

1. This Procedure determines the procedure:

simultaneous registration (including instead of lost or stolen), exchange of the passport of the citizen of Ukraine (further - the passport) and passports/passports of the citizen of Ukraine for trip abroad (further - passports/passports for trip abroad); or

simultaneous registration (including instead of lost or stolen), exchange of the passport and passports/passports for trip abroad to one of parents (adoptive parents), guardians, custodians or other legal representatives of the child (further - the legal representative of the child), and also passports/passports for trip abroad to child(children), not reached reached 14-year age; or

simultaneous registration (including instead of lost or stolen), exchange of the passport to one of legal representatives of the child and passports/passports for trip abroad to child(children) which reached / did not reach 14-year age (further - simultaneous registration (including instead of lost or stolen), exchange of the passport and passports/passports for trip abroad).

2. Submission of documents by person or his legal representative (further - the applicant), actions of employees of territorial bodies / GMS territorial subdivisions, centers of provision of administrative services, the state company belonging to the sphere of management of GMS, or its separate divisions (branches, representations) including placed outside Ukraine during adoption of documents, decision making about simultaneous registration (including instead of lost or stolen), exchange of the passport and passports/passports for trip abroad, leaving of the statement questionnaire without movement or about refusal in simultaneous registration (including instead of lost or stolen), the passport and passports/passports for trip abroad or their issue, informing applicants, appeal and review of the made decisions, personalisation of at the same time drawn up passports and passports/passports for trip abroad, the organization of their issue recognitions invalid and destructions of the passport of the citizen of Ukraine for the trip abroad approved by the resolution of the Cabinet of Ministers of Ukraine of May 7, 2014 No. 152 are performed according to Procedure for registration, issue, exchange, transfer, withdrawal, return to the state (The Official Bulletin of Ukraine, 2014, No. 45, Art. 1188; 2017, No. 2, the Art. 38), and the Procedure for registration, issue, exchange, transfer, withdrawal, return to the state, recognition invalid and destructions of the passport of the citizen of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of March 25, 2015 No. 302 (The Official Bulletin of Ukraine, 2015, No. 40, Art. 1188; 2016, No. 87, the Art. 2829), taking into account requirements of this Procedure.

3. Documents for simultaneous registration (including instead of lost or stolen), exchange of the passport and passports/passports for trip abroad move in territorial body / GMS territorial subdivision, the center of provision of administrative services, the state company belonging to the sphere of management of GMS, or its separate division (branch, representation) including placed outside Ukraine in the place of the address.

4. The applicant for simultaneous registration (including instead of lost or stolen), exchange of the passport and passports/passports for trip abroad files the documents determined by Procedure for registration, issue, exchange, transfer, withdrawal, return to the state, recognitions invalid and destructions of the passport of the citizen of Ukraine, the approved resolution of the Cabinet of Ministers of Ukraine of March 25, 2015 No. 302.

In case of submission of documents for simultaneous registration (including instead of lost or stolen), exchange of the passport and passports/passports for trip abroad by the applicant the passport and passports/passports for trip abroad which / subject/subject to exchange are given.

5. For entering of information into the Unified state demographic register in case of simultaneous registration (including instead of lost or stolen), exchange of the passport and passports/passports for trip abroad the employee of territorial body / GMS territorial subdivision, center of provision of administrative services, the state company belonging to the sphere of management of GMS, or its separate division (branch, representation) including placed outside Ukraine based on the documents filed by the applicant creates the statement questionnaire which sample affirms the Ministry of Internal Affairs using means of the Unified state demographic register.

For simultaneous registration (including instead of lost or stolen), exchange of the passport and passports/passports for trip abroad in the statement questionnaire are specified:

for simultaneous execution of the passport for the first time and passports/passports for trip abroad - the details of the certificate of birth or data containing in the document confirming the birth fact, issued by competent authorities of foreign state or in the statement from the State register of acts of civil status of citizens about state registration of the birth of physical person.

In case of simultaneous execution of the passport for the first time and passports/passports for trip abroad details of the certificate of registration of person by the citizen of Ukraine issued by territorial authority of GMS are in addition specified to person who acquired citizenship of Ukraine in the territory of Ukraine;

for simultaneous execution of the passport and passports/passports for departure out of limit details of the passport which is given for exchange or is declared lost or stolen;

for simultaneous execution of the passport and the passport for trip abroad to one of legal representatives, and also the passport for trip abroad to child(children) which reached / did not reach 14-year age, - details of the passport which is submitted for exchange or is declared lost or stolen, and for child(children) which reached / did not reach 14-year age, - the details of the certificate of birth or data containing in the document confirming the birth fact, issued by competent authorities of foreign state or in the statement from the State register of acts of civil status of citizens about state registration of the birth of physical person;

for simultaneous execution of the passport to one of legal representatives of the child and passports/passports for trip abroad to child(children) which reached / did not reach 14-year age, - details of the passport which is submitted for exchange or is declared lost or stolen, and for child(children) which reached / did not reach 14-year age, - the details of the certificate of birth or data containing in the document confirming the birth fact, issued by competent authorities of foreign state or in the statement from the State register of acts of civil status of citizens about state registration of the birth of physical person;

for simultaneous execution of the passport and the passport for trip abroad to the person who is constantly living abroad or constantly living abroad and came back on permanent residence to Ukraine, or obtained citizenship of Ukraine abroad - passport details for trip abroad which is given for exchange (including passports which effective period expired) or is declared lost or stolen.

In case of absence at the applicant of details of the passport, passports/passports for trip abroad which are declared lost or stolen such details are established according to the Unified state demographic register or departmental information system GMS.

6. In case of simultaneous registration (including instead of lost or stolen), exchange of the passport and passports/passports for trip abroad the specified documents are issued:

not later than in 20 working days from the date of execution of the statement questionnaire for their obtaining;

not later than in seven working days from the date of execution of the statement questionnaire for their urgent obtaining.

The passport which is drawn up for the first time is issued not later than in seven working days from the date of execution of the statement questionnaire.

In case of registration by the separate division of the statement questionnaire placed outside Ukraine for simultaneous registration (including instead of lost or stolen), exchange of the passport and passports/passports for trip abroad the specified documents are issued to the applicant in time who cannot exceed three months.

In case of need holding procedure of establishment of person by consideration of the statement questionnaire the term of consideration of such statement questionnaire is prolonged for the term of holding such procedure. The decision on execution of the passport for trip abroad is made after decision making on execution of such passport.

In case of decision making about leaving of the statement questionnaire for registration (including instead of lost or stolen), exchange of the passport without movement the decision on leaving without movement of the statement questionnaire for registration (including instead of lost or stolen), exchange of passports/passports for trip abroad, including passports/passports for trip abroad which/which are at the same time drawn up/are drawn up to child(children), not reached reached 14-year age is made.

In case of decision making the decision on refusal in registration or issue of passports/passports for trip abroad, including passports/passports for trip abroad which/which are at the same time drawn up/are drawn up to child(children), not reached reached 14-year age is made on refusal in registration or issue of the passport.

The applicant has the right to address repeatedly to territorial body / GMS territorial subdivision, the center of provision of administrative services, the state company belonging to the sphere of management of GMS, or its separate division (branch, representation) including placed outside Ukraine in case of change or elimination of circumstances in connection with which to it it was refused simultaneous registration (including instead of lost or stolen), exchange of the passport and passports/passports for trip abroad.

7. Receipt of the passport, passports/passports for trip abroad if the decision on execution of the passport was made by results of the procedure of identification according to Item 97-2 of the Procedure for registration, issues, exchange, transfer, withdrawal, return to the state, recognitions invalid and destructions of the passport of the citizen of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of March 25, 2015 No. 302, is performed by the applicant in territorial body / GMS territorial subdivision. Transfer of such passports, passports for trip abroad in the separate division placed outside Ukraine or foreign diplomatic organization of Ukraine for the organization of their issue is not performed.

8. For simultaneous registration (including instead of lost or stolen), exchange of the passport and passports/passports for trip abroad is levied administrative collection according to the procedure and the sizes established by the legislation.

For simultaneous execution of the passport for the first time and passports/passports for trip abroad only administrative collection for execution of the passport for trip abroad is levied.

Changes which are made to Resolutions of the Cabinet of Ministers of Ukraine of May 7, 2014 No. 152 and of March 25, 2015 No. 302

1. According to the procedure of registration, issue, exchange, transfer, withdrawal, return to the state, recognitions invalid and destructions of the passport of the citizen of Ukraine for trip abroad, No. 152 approved by the resolution of the Cabinet of Ministers of Ukraine of May 7, 2014:

Item 7 to state 1) in the following edition:

"7. Registration (including instead of lost or stolen), exchange and issue of the passport for trip abroad are performed:

1) to person which reached 14-year age, - based on the statement questionnaire, given them personally;

2) to person which did not reach 14-year age, or person recognized by court incapacitated or civil capacity to act of which is limited to court, - based on the statement - the questionnaire of one of parents (adoptive parents), guardians, custodians or other legal representatives (further - legal representatives);

3) to person who cannot independently move and samoobsluzhivatsya because of availability of violation of functions of organism that proves to be true including the conclusion of healthcare institution or other medical documentation which is drawn up in accordance with the established procedure and which requires urgent medical treatment abroad that is confirmed by the document issued by healthcare institution, including the statement from the medical record of the ambulatory (stationary) patient or other medical documentation which is drawn up in accordance with the established procedure or to person, concerning which there is conclusion about need of the direction of person from the constituting forces of defense or security forces which was injured in connection with military aggression of the Russian Federation against Ukraine on treatment abroad, - based on the statement questionnaire of person or his legal representative.";

Item 8 to state 2) in the following edition:

"8. The passport for trip abroad is issued:

1) not later than in 20 working days from the date of execution of the statement questionnaire for its obtaining;

2) not later than in seven working days from the date of execution of the statement questionnaire for its urgent obtaining;

3) till three working days - due to the need of urgent trip abroad, connected with compelling need in treatment driving off, departure of person accompanying the seriously ill patient or the death of the relative living abroad;

4) not later than in 10 working days from the date of execution of the statement questionnaire for its obtaining, given within one year from the date of dismissal of person, concerning which according to the Law of Ukraine "About social and legal protection of persons, concerning which established fact of deprivation of personal liberty owing to the armed aggression against Ukraine, and members of their families" established fact of deprivation of personal liberty owing to the armed aggression against Ukraine. In case of execution of the statement questionnaire in foreign diplomatic organization the passport for trip abroad is drawn up within three working days.

In case of execution of the statement questionnaire in the foreign diplomatic organization placed outside Ukraine separate division (branch, representation) of the state company belonging to the sphere of management of GMS (further - the separate division placed outside Ukraine), the passport for trip abroad is issued to person taking into account the term necessary for its transfer which cannot exceed three months.";

Item 9 to add 3) with paragraphs of the following content:

"For registration to person, concerning which according to the Law of Ukraine "About social and legal protection of persons concerning whom established fact of deprivation of personal liberty owing to the armed aggression against Ukraine, and members of their families" established fact of deprivation of personal liberty owing to the armed aggression against Ukraine, the passport for trip abroad administrative collection (consular fee) is not levied if such person submits the statement questionnaire on execution of the passport for trip abroad within one year from the date of its release.

In case of acceptance by the separate division of documents placed outside Ukraine for registration (including instead of lost or stolen), exchange of the passport for trip abroad, the decision on registration or exchange of which is accepted by territorial body / GMS territorial subdivision, administrative collection is levied.";

4) in Item 14:

state subitems 8-10 in the following edition:

"8) the digitized signature of person (except persons who in the procedure established by the law are acknowledged incapacitated, and persons which did not reach 14-year age). The signature of persons with physical defects is introduced at will. The signature of persons who cannot independently move and samoobsluzhivatsya because of availability of violation of functions of organism that proves to be true including the conclusion of healthcare institution or other medical documentation which is drawn up in accordance with the established procedure - is introduced using means of the Register by scanning;
