According to the subitem 10) of article 24 of the Construction code of the Republic of Kazakhstan, I ORDER:
1) Rules of conducting complex non-departmental examination of the construction projects intended for construction new, and also changes (reconstruction, expansions, modernization, upgrade and capital repairs) the existing buildings and constructions, their complexes, engineering and transport communications (further - Rules), according to appendix 1 to this order;
2) the List of invalid some orders, according to appendix 2 to this order.
2. To provide to committee on cases of construction and housing and communal services of the Industry ministry and construction of the Republic of Kazakhstan in the procedure established by the legislation:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) placement of this order on Internet resource of the Industry ministry and construction of the Republic of Kazakhstan after its official publication.
3. To impose control of execution of this order on the supervising vice-Minister of Industry and construction of the Republic of Kazakhstan.
4. This order becomes effective since July 1, 2026 and is subject to official publication.
5. Determine that Item 38 of Rules since July 1, 2028 is effective in the following edition:
"38. By consideration of construction projects with security classification or marked "for office use" the final version of the design and estimate documentation in paper form makes sure seal of experts with indication of surname, name, middle name (in case of its availability), positions, certificate numbers and dates of its issue and returns to the customer after completion of complex non-departmental project appraisal of construction as control archive copy.".

1. These rules of conducting complex non-departmental examination of the construction projects intended for construction new, and also changes (reconstruction, expansions, modernization, upgrade and capital repairs) the existing buildings and constructions, their complexes, engineering and transport communications (further – Rules) are developed according to the subitem 10) of article 24 of the Construction code of the Republic of Kazakhstan (further – the Code).
2. These rules determine:
procedure for conducting complex non-departmental examination of the construction projects intended for construction new, and also changes (reconstruction, expansions, modernization, upgrade and capital repairs) the existing buildings and constructions, their complexes, engineering and transport communications;
conducting complex non-departmental examination of construction projects on objects of construction in progress or unauthorized construction;
procedure for development and approval of individual plans of step-by-step development and approval of the design estimates for construction of the separate construction objects requiring special regulation and town-planning regulation;
implementation of complex non-departmental examination of construction projects in the mode of expert maintenance.
3. Rules extend to conducting complex non-departmental examination of the construction projects provided by subitems 1) and 2) of Item 1 of article 103 of the Code.
4. The construction objects specified in item 4 of article 98 of the Code, and also feasibility statements intended for construction of buildings and constructions, their complexes, engineering and transport communications are not subject to complex non-departmental examination of construction projects.
5. The sanitary and epidemiologic examination of projects which is the Section (part) of complex non-departmental examination of construction projects is performed by experts in the field of designing.
6. Development of the design estimates (further – the design and estimate documentation) is considered complete after receipt of the positive conclusion of complex non-departmental examination of construction projects and statement of the design and estimate documentation.
The construction projects which are subject to complex non-departmental examination, but did not undergo it and did not receive the positive decision of complex non-departmental examination of construction projects with the recommendation on its approval are not subject to further realization.
7. Complex non-departmental examination of construction projects consists in carrying out the analysis and quality evaluation of construction projects, by establishment of compliance (discrepancy) of project decisions to conditions of initial materials and allowing documents for designing, stipulated by the legislation the Republic of Kazakhstan, to design assignment, and also observance in project solutions and calculations of provisions of town-planning and technical regulations, regulations and provisions of the state and interstate regulating documents, including on observance of provisions of energy saving and increase in energy efficiency, regarding heat-shielding according to construction projects of the unique objects which are not provided with availability of the existing state or interstate standard rates and developed on the special specifications (special regulations) replacing them and (or) on objects which project consumption of energy resources exceeds equivalent indicator in five hundred tons of conditional fuel a year.
When conducting complex non-departmental examination of construction projects the state expert organization and the expert organizations do not establish:
reliability of information on the project organization and other physical persons or legal entities involved in project development of construction provided by the customer;
legitimacy of assignment of rights on development or adjustment of the construction project between the project organizations.
8. Representation and acceptance of construction projects together with its initial materials and allowing documents for conducting complex non-departmental examination of construction projects goes the customer by means of the portal for the organization of development and examination of projects for the principle of "one window" (further - the Portal), except for the construction projects specified in Item 9 of these rules.
9. Complex non-departmental examination of the construction projects having security classification or mark "for office use" is carried out by the state expert organization and it is represented the customer in the following procedure:
1) submission of the request - on paper;
2) submission of the construction project together with its initial materials and allowing documents - on the electronic medium.
10. The project orderer of construction, the construction projects which are subject to complex non-departmental examination but not relating to the state monopoly and which are not subject of public procurements at discretion chooses any expert organization for conducting complex non-departmental examination of construction projects.
11. Completeness and structure of the construction project, and also the initial materials and (or) allowing documents submitted for complex non-departmental examination of construction projects is determined:
1) for construction projects of new buildings and constructions, their complexes, engineering and transport communications - according to appendix 1 to these rules;
2) for projects of reconstruction, expansion, upgrade, modernization of the existing buildings and constructions, their complexes, engineering and transport communications - according to appendix 2 to these rules;
3) for projects of capital repairs of the existing buildings and constructions, their complexes, engineering and transport communications - according to appendix 3 to these rules;
4) for the projects assuming value addition of earlier approved estimate documentation without change of project decisions - according to appendix 4 to these rules;
5) for the projects assuming change of earlier approved project decisions - according to appendix 5 to these rules;
6) for projects on objects of construction in progress or unauthorized constructions - according to appendix 6 to these rules.
12. Completeness and structure of the introduced draft of construction, and also initial materials and allowing documents, according to construction projects, provided by the subitem 2) of article 104 of the Code, is checked by the state expert organization for compliance to provisions of these rules, within 5 (five) working days from next working day after receipt of the request.
