About application of the Economic Procedure Code of the Republic of Belarus in case of review of court decrees on newly discovered facts
Plenum of Supreme Economic Court of the Republic of Belarus, being guided by Articles 74, 75 Codes of the Republic of Belarus about judicial system and the status of judges, having considered materials of generalization of court practice, for the purpose of uniform application of the procedural legislation in case of review of the court decrees which took legal effect on newly discovered facts decided to accept the following resolution.
1. According to part one of Article 319 of the Economic Procedure Code of the Republic of Belarus (further - HPK) the court decrees which took legal effect can be reviewed by the economic court which accepted them on newly discovered facts.
In this connection it must be kept in mind that on newly discovered facts after the introduction in legal force court decrees of economic court of the first instance, economic courts of appeal and cassation instances, and also Presidium and the Plenum of Supreme Economic Court of the Republic of Belarus on legal cases can be reviewed.
2. Owing to part two of article 322 HPK review on newly discovered facts of court decrees of economic courts of appeal, cassation and supervising instances by which it is changed or the new court decree is accepted, it is made by that court which changed or accepted the new court decree, without submitting the case on new trial.
