About approval of Rules of marking of separate types of fertilizers in consumer packaging by means of identification and the features of implementation of the state information system of monitoring of turnover of goods which are subject to obligatory marking by means of identification concerning separate types of fertilizers in consumer packaging

The government of the Russian Federation decides:

1. Approve the enclosed Rules of marking of separate types of fertilizers in consumer packaging by means of identification (further - Rules).

2. Determine that participants of turnover of separate types of fertilizers in consumer packaging (further - fertilizers) according to Rules:

a) give to the state information system of monitoring of turnover of goods, subject to obligatory marking by means of identification (further - information system of monitoring), the statement for registration in information system of monitoring since September 1, 2026, but no later than 7 calendar days from the date of emergence of need of implementation by the participant of turnover of fertilizers of the activities connected with input in turnover and (or) turnover, and (or) conclusion from turnover of fertilizers concerning which the input prohibition in turnover, and (or) turnover, and (or) conclusion from turnover not marked by means of identification (except for participants of turnover of the fertilizers falling under action of provisions of Items 3 and 7 of article 2 of the Federal law "About Use of the Control and Cash Equipment when Implementing Calculations in the Russian Federation" is established (further - participants of turnover of fertilizers in the remote or hardly accessible areas). At the same time participants of turnover of fertilizers in the remote or hardly accessible areas submit to information system of monitoring the application for registration in information system of monitoring within 30 calendar days from the date of emergence of need of implementation of the activities connected with input in turnover by them and (or) turnover, and (or) conclusion from turnover of fertilizers;

b) provide no later than 15 calendar days from the date of registration in information system of monitoring readiness of own software and hardware for information exchange with information system of monitoring and direct to the operator of information system of monitoring the request electronically to passing of testing of information exchange of own software and hardware and information system of monitoring;

c) for work on ensuring readiness of own software and hardware for information exchange with information system of monitoring and passing of testing of information exchange electronically after registration in information system of monitoring direct to the operator of information system of monitoring the request electronically to provision of remote access to the issue registration device placed in infrastructure of information system of monitoring;

d) pass test of information exchange of own software and hardware and information system of monitoring according to the procedure posted on the official site of the operator of information system of monitoring on the Internet concerning the transactions connected with marking of fertilizers means of identification, their input in turnover, turnover and conclusion from turnover according to Rules no later than 15 calendar days from the date of the direction to the operator of information system of monitoring of the notification of the readiness of own software and hardware to information exchange with information system of monitoring and the direction of the request according to the subitem "b" of this Item.

3. Determine that:

a) participants of turnover of fertilizers concerning the fertilizers relating at the same time to code of the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union 3105 and to codes of the All-Russian Product Classifier by types of economic activity 20.15.6 and 20.15. 7, performing input in turnover of the specified fertilizers, is put by means of identification and represent to information system of monitoring of the data on drawing means of identification and input in turnover of the specified fertilizers according to Rules since November 1, 2026;

b) the participants of turnover of fertilizers performing turnover and (or) conclusion from turnover of fertilizers (as in case of conclusion from turnover when implementing calculations using the control and cash equipment, and different ways), represent to information system of monitoring of the data on turnover and about conclusion from turnover of fertilizers according to Rules since November 1, 2027;

c) participants of turnover of fertilizers till November 30, 2026 perform marking of the fertilizers acquired till October 31, 2026 and issued by customs authorities since November 1, 2026, imported (imported) and placed under customs procedures of release for internal consumption or reimport, to the offer of the specified fertilizers for realization (sale) and enter into information system of monitoring of the data on marking of such fertilizers means of identification according to Rules;

d) participants of turnover of fertilizers in the remote or hardly accessible areas have the right to represent the data specified in the Section VIII of Rules within 30 calendar days:

from the date of shipment (transfer or acceptance) fertilizers by transfer (acceptance) of fertilizers within the transactions providing transition of the property right to fertilizers and also within commission agreements, and (or) agency agreements, and (or) works agreements, and (or) agreements of the order;

from the date of conclusion of fertilizers from turnover in case of such conclusion;

from the date of return of fertilizers to turnover in case of such return;

from the date of modification of the data provided by Sections III, IV and VIII of Rules, according to the procedure, provided by the Section IX of Rules (if changes were made to such data);

e) participants of turnover of fertilizers have the right to put means of identification and to represent to information system of monitoring of the data on drawing means of identification, input in turnover, about turnover and about conclusion from turnover of fertilizers according to Rules from the date of entry into force of this resolution.

4. Till November 30, 2026 release by customs authorities imported (imported) into the Russian Federation and placed under customs procedures of release for internal consumption or reimport of the unmarked fertilizers specified in the subitem "v" of Item 3 of this resolution is allowed.

5. Participants of turnover of fertilizers in the presence as of November 1, 2026 in the territory of the Russian Federation the unrealized fertilizers made or imported into the Russian Federation before the specified date, having the right to perform marking of the specified fertilizers and to represent data on marking of fertilizers means of identification to information system of monitoring according to Rules till November 1, 2027.

At the same time delivery by producers and importers of the fertilizers which are not marked by means of identification specified in paragraph one of this Item is allowed till April 1, 2027.

6. Registration in the information system used for the purpose of carrying out experiment on marking by means of identification of separate types of fertilizers in consumer packaging according to the order of the Government of the Russian Federation of October 21, 2025 No. 1621 "About carrying out in the territory of the Russian Federation experiment on marking by means of identification of separate types of fertilizers in consumer packaging" (further - experiment), legal entities and individual entrepreneurs who as of August 31, 2026 were participants of experiment is equated to registration in information system of monitoring according to the subitem "an" of Item 2 of this resolution.

If the data provided within the experiment by participants of turnover of fertilizers to the information system used for the purpose of carrying out experiment do not meet the requirements of Rules, participants of turnover of fertilizers represent to information system of monitoring missing and (or) urgent data before the date established by the subitem "an" of Item 3 of this resolution with which drawing means of identification becomes obligatory.

7. Determine that the operator of information system of monitoring provides:

a) the organization of testing of information exchange of software and hardware of participants of turnover of fertilizers and information system of monitoring no later than 15 calendar days from the date of obtaining from participants of turnover of the fertilizers registered in information system of monitoring, the notification of the readiness to information exchange of the specified software and hardware with information system of monitoring;

b) provision to participants of turnover of fertilizers of remote access to the issue registration devices placed in infrastructure of information system of monitoring on the conditions provided by Rules no later than 30 calendar days from the date of obtaining from participants of turnover of the fertilizers registered in information system of monitoring, the request electronically for provision of remote access to the issue registration device placed in infrastructure of information system of monitoring.

8. Determine that in the territory of the Russian Federation input of fertilizers in turnover without drawing means of identification and representation in information system of monitoring of data on marking of fertilizers is allowed by means of identification before the date established by the subitem "an" of Item 3 of this resolution with which drawing means of identification becomes obligatory, except for the case specified in Item 5 of this resolution.

Turnover and conclusion from turnover of the unmarked fertilizers made in the territory of the Russian Federation or imported (imported) on the territory of the Russian Federation (including in case of import from the territory of the Eurasian Economic Union) within cross-border trade or release by customs authorities in case of their room under customs procedures of release for internal consumption or reimport (in case of their production out of the territory of the Russian Federation) till October 31, 2026, are allowed till October 31, 2027.

9. Operation of this resolution does not extend to fertilizers to which according to Rules and international treaties of the Russian Federation requirements about obligatory marking by means of identification do not extend.

10. Determine that with approach of the date established by the subitem "an" of Item 3 of this resolution with which drawing means of identification becomes obligatory provision to the participant of turnover of fertilizers of the codes of marking necessary for forming of means of identification, is performed by the operator of information system of monitoring on paid basis according to Rules.

11. From the date of entry into force of this resolution according to the decision of the participant of turnover of fertilizers provision to it codes of marking can be performed by the operator of information system of monitoring before the date installed by the subitem "an" of Item 3 of this resolution with which drawing means of identification becomes obligatory. Such codes of marking are provided by the operator of information system of monitoring on a grant basis. At the same time the participant of turnover of fertilizers who received the specified marking codes on a grant basis provides their transformation to means of identification and submits in information system of monitoring the report on drawing means of identification and data on input of fertilizers in turnover before the date established by the subitem "an" of Item 3 of this resolution with which drawing means of identification becomes obligatory.

The service in provision of codes of marking is recognized the information system of monitoring rendered by the operator at the time of entering of information system of monitoring by the operator into information system of monitoring of information on input of fertilizers into turnover specified by the participant of turnover of fertilizers in data on input of fertilizers in turnover the case provided by paragraph one of this Item.

At the same time the operator of information system of monitoring enters into information system of monitoring information on input of fertilizers in turnover after obtaining from the participant of turnover of fertilizers of the report on drawing means of identification.

If the participant of turnover of fertilizers who received marking codes on a grant basis did not provide their transformation to means of identification and did not submit in information system of monitoring the report on drawing means of identification and data on input of fertilizers in turnover before the date established by the subitem "an" of Item 3 of this resolution with which drawing means of identification becomes obligatory, such codes of marking are paid by the participant of turnover of fertilizers or cancelled according to Rules.

12. This resolution becomes effective since September 1, 2026.

Rules of marking of separate types of fertilizers in consumer packaging by means of identification

I. General provisions

1. These rules determine procedure for marking of separate types of the fertilizers in consumer packaging which are subject to obligatory marking by means of identification, the requirement to participants of turnover of separate types of fertilizers in consumer packaging, procedure for information exchange of participants of turnover of separate types of the fertilizers in consumer packaging with the state information system of monitoring of turnover of goods which are subject to obligatory marking by means of identification (further - information system of monitoring), characteristics of means of identification, and also procedure for representation by participants of turnover of separate types of fertilizers in consumer packaging of data in information system of monitoring on input in turnover, about turnover and about conclusion from turnover of separate types of fertilizers in consumer packaging.

2. The concepts used in these rules mean the following:

"aggregation" - process of consolidation of goods in group packaging, or set, or in shipping package, or group packagings in shipping package or sets in shipping package, or shipping packages in shipping package of higher level of enclosure with preserving information on interrelation of codes of identification of each enclosed commodity unit in consumer packaging with code of identification of the created group packaging and (or) shipping package or with code of identification created set and (or) shipping package, about interrelation of codes of identification of each enclosed group packaging with code of identification of the created shipping package or codes of identification of each enclosed set with code of identification of the created shipping package, and also about interrelation of codes of identification of each enclosed shipping package with code of identification of the created shipping package of higher level of enclosure and drawing appropriate means of identification on group packaging, either set, or code of identification of shipping package on shipping package for the purpose of ensuring traceability of movement of goods on goods distribution chain without the need for opening of the created group packaging and (or) shipping package or set and (or) shipping package;

"aggregative customs code" - the unique sequence of symbols for each separate set of goods representing consolidation of codes of identification of each goods, including codes of identification of the packaging combining goods in the course of aggregation, created by the operator of information system of monitoring for the purpose of identification of goods according to these rules, used by the participant of turnover of goods in case of customs declaration of goods. At the same time consolidation in aggregative customs code of codes of identification which part is already included in code of identification of group packaging, or code of identification of shipping package, or in other aggregative customs code is not allowed;

"validation of means of identification" - quality evaluation of transformation of code of marking to means of identification and drawing means of identification regarding compliance of its structure to requirements of these rules;
