According to the subitem 8) of article 24 of the Construction code of the Republic of Kazakhstan and with the subitem 2) of Item 3 of article 16 of the Law of the Republic of Kazakhstan "About the state statistics", I ORDER:

1. Approve the enclosed Rules of forming and maintaining the list of the subjects of entrepreneurship performing production (production) and delivery of construction materials, products, designs, the equipment for monitoring of the prices in construction.

2. To provide to committee on cases of construction and housing and communal services of the Industry ministry and construction of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Industry ministry and construction of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Industry and construction of the Republic of Kazakhstan.

4. This order becomes effective since July 1, 2026 and is subject to official publication.

5. Determine that since July 12, 2026:

Item 16 is effective in the following edition:

"16. Department of authorized body considers the application of the producer or supplier with use of the state digital systems and makes the decision on its inclusion in the List or on change of information about him in the List within 10 calendar days from the date of receipt of the corresponding statement.".

Rules of forming and maintaining the list of the subjects of entrepreneurship performing production (production) and delivery of construction materials, products, designs, the equipment for monitoring of the prices in construction

Chapter 1. General provisions

1. These rules of forming and maintaining the list of the subjects of entrepreneurship performing production (production) and delivery of construction materials, products, designs, the equipment for monitoring of the prices in construction (further – Rules) are developed according to the subitem 8) of article 24 of the Construction code of the Republic of Kazakhstan and determine procedure for forming and maintaining the list of the subjects of entrepreneurship performing production (production) and delivery of construction materials, products, designs, the equipment for monitoring of the prices in construction.

2. The list of the subjects of entrepreneurship performing production (production) and delivery of construction materials, products, designs and the equipment for monitoring of the prices in construction (further – the List) is created and kept by department of authorized body for architecture, town planning and construction (further – department of authorized body) in the Kazakh and Russian languages.

3. The list is created for the purpose of providing the most complete scope of the nomenclature of the construction materials, products, designs and the equipment used in estimate standard rates when carrying out monitoring of the prices in construction.

4. In these rules the following basic concepts are used:

1) authorized body for architecture, town planning and construction – the central executive body performing management and also within the competence cross-industry coordination in the field of public administration by architectural, town-planning and construction activities;

2) estimate regulating documents (estimate standard rates) – estimate norms, estimate cost indexes, indexes and other regulating documents on pricing, constructions, necessary for determination of estimated cost, and also benefits and methodical recommendations.

Chapter 2. Procedure for forming and maintaining List

5. The list is created on the basis:

1) the public information provided by subitems 1), 2), 3), 4), 5) and 6) of Item 13 of article 28 of the Entrepreneurial code of the Republic of Kazakhstan received from Bureau of national statistics of the Agency on strategic planning and reforms of the Republic of Kazakhstan (further – Bureau);

2) the information about subjects of entrepreneurship, state revenues of the Ministry of Finance of the Republic of Kazakhstan gained from Committee (further – Committee);

3) the information about subjects of entrepreneurship of the Kazakhstan producers received from the Register;

4) the information about the subjects of entrepreneurship received from subjects of entrepreneurship, performing production (production) of construction materials, products, designs and the equipment for construction in the Republic of Kazakhstan (further – producers);

5) the information about the subjects of entrepreneurship received from subjects of entrepreneurship, performing delivery of construction materials, products, designs and the equipment for construction in the Republic of Kazakhstan, their import from state members of the Eurasian Economic Union, and also import from the third countries of construction materials, products, designs and the equipment to which customs procedure of release is applied to internal consumption (further – suppliers).

6. For the purpose of forming and maintaining the List department of authorized body annually, till October 1 of the current year, provides in Bureau by means of updating in the Digital service "National Reference Information" the list of codes of the construction materials, products, designs and the equipment included in the departmental (industry) national reference information about the materials used in construction, products, designs, the equipment and other construction resources approved according to the Rules of development and approval of elements of national reference information approved by the order of the Chairman of the Agency on strategic planning and reforms of the Republic of Kazakhstan of September 26, 2024 No. 77 (further – the qualifier of construction resources).

7. The bureau annually, till November 1 of the current year, provides in department of authorized body and in Committee the public information provided by subitems 1), 2), 3), 4), 5) and 6) of Item 13 of article 28 of the Entrepreneurial code of the Republic of Kazakhstan.

8. The committee annually, till December 1 of the current year, provides in department of authorized body:

1) the list of the subjects of entrepreneurship which are at stage of bankruptcy or liquidation (the activities termination) and subject to exception of lists, created by Bureau according to Item 7 of these rules;

2) the list of the subjects of entrepreneurship performing activities for import from the third countries to the Republic of Kazakhstan of the construction materials, products, designs and the equipment with codes on products Qualifier by types of economic activity corresponding to codes of the General qualifier of types of economic activity: 02 – "Forestry and logging", 08 – "Production of other minerals", 16 – "Production of wooden and pith products, except furniture; production of products from straws and materials for weaving", 19 – "Production of coke and products of oil processing", 20 – "Production of products of the chemical industry", 22 – "Production of rubber and plastic products", 23 – "Production of other not metal mineral products", 24 – "Metallurgical production", 25 – "Production of finished metal goods, except machines and the equipment", 26 – "Production of computers, the electronic and optical equipment", 27 "Production of the electric equipment", 28 – "Production of the machines and the equipment which is not switched on in other groups", 31 – "Production of furniture", 35 – "Supply with the electric power, gas, vapor, hot water and the conditioned air", 46 – "Wholesale trade, except for trade in cars and motorcycles" to which customs procedure of release is applied to internal consumption, except for being at stage of bankruptcy or liquidation (the activities termination).

The lists of subjects of entrepreneurship created by Committee include information on the name, identification number of subjects of entrepreneurship. On the subjects of entrepreneurship specified in the subitem 2) of this Item, the list of subjects of entrepreneurship includes in addition information on their residence and the location (in the presence).

9. Information specified in Items 7 and 8 of these rules is created as of October 1 of the current year and is provided in electronic form.

10. Information on the subjects of entrepreneurship consisting in the register of the Kazakhstan producers is created as of December 1 of the current year.

11. Department of authorized body creates the List in form according to appendix 1 to these rules and places it on the Internet resource annually, no later than December 31 of the current year.

12. Department of authorized body performs updating of the List based on information of producers and suppliers.

13. Producers and suppliers direct to department of authorized body the application for their inclusion in the List with appendix:

1) information on the supplier (producer) in form according to appendix 2 to these rules;

2) the information about the registered legal entity, branch or its representation.

14. Department of authorized body includes the producer or the supplier in the List in case of compliance to its following criteria:

1) concerning it the court does not initiate proceeedings about bankruptcy or liquidation;

2) absence it in the register of unfair participants of public procurements and (or) in the register of unfair participants of purchases, and (or) in the list of unreliable potential suppliers (suppliers) of National welfare fund;

3) implementation of activities for production (production) and (or) delivery of construction materials, products, designs and the equipment which codes are included in the qualifier of construction resources, for construction in the Republic of Kazakhstan by it.

15. Department of authorized body makes changes to the List based on the subject of entrepreneurship of the application for modification of information on him reflected in the List. received from

In case of change of the name, form of business, the location of the subject of entrepreneurship the information about the registered legal entity, branch or its representation is enclosed to the application.

16. Department of authorized body considers the application of the producer or supplier with use of the state information systems and makes the decision on its inclusion in the List or on change of information about him in the List within 10 calendar days from the date of receipt of the corresponding statement.

17. Department of authorized body sends to the subjects of entrepreneurship included in the List, except for case, stipulated in Item 13 these rules, the notification on provision of information on the supplier (producer) provided by appendix 2 to these rules (further – the notification on provision of information). The notification on provision of information goes annually not later than in 25 calendar days from the date of placement of the List on Internet resource of department of authorized body.

18. The notification on provision of information goes the registered mail with the notification on its delivery either the telephone message or the telegram, the text message on subscriber number of cellular communication or on the e-mail address.

The notification on provision of information goes in the place of registration and (or) the actual stay specified in the List.

19. The notification on provision of information is considered delivered properly in cases:

deliveries of the notification on provision of information to the head or the worker of the subject of entrepreneurship who undersigns for its obtaining on the assurance of receipt with indication of the surname, initials and position;

fixings of delivery of the notification on provision of information in case of its direction with use of other means of communication.

In case of refusal of the addressee to accept the notification on provision of information the person delivering or handing it does the corresponding mark in the notification on provision of information which returns to department of authorized body.
