About change of orders of Operational analytical center in case of the President of the Republic of Belarus

Based on paragraphs two and third subitem 6. 4, the paragraph of third subitem 6.6 of Item 6, subitems 7.7 and 7.8 of Item 7 of the Regulations on technical and cryptographic information security approved by the Presidential decree of the Republic of Belarus of April 16, 2013 No. 196, of paragraphs of the second or fifth subitem 3. 1, subitem 3 parts three. 2, subitem 3.7 and the paragraph of the fifth subitem 3.8 of Item 3 of the Presidential decree of the Republic of Belarus of February 14, 2023 "About cyber security" I ORDER to No. 40:

1. Make changes to the following orders of Operational analytical center in case of the President of the Republic of Belarus:

1.1. from Item 8 of the Regulations on procedure for the conducting state examination of means of technical and cryptographic information security approved by the order of Operational analytical center in case of the President of the Republic of Belarus of August 26, 2013 No. 60, the second offer to exclude;

1.2. in the order of Operational analytical center in case of the President of the Republic of Belarus of February 20, 2020 No. 66 "About measures for implementation of the Presidential decree of the Republic of Belarus of December 9, 2019 No. 449":

in Regulations on procedure for technical and cryptographic information security in the information systems intended for information processing, distribution and (or) provision of which is limited, approved by this order:

the second Item 1 to state part in the following edition:

"This Provision can not be applied by operators of telecommunication - owners (owners) of the information systems providing management of engineering procedures and intended only for transfer of personal data on technological networks of telecommunication to such information systems. For the purposes of application of this part operators of telecommunication approve with Operational analytical center in case of the President of the Republic of Belarus (further - OATs) lists of the specified information systems to which structural and logical schemes of each information system included in the list shall be attached.";

to exclude paragraphs of the fifth and sixth of Item 3;

the fourth parts two of Item 12 to exclude the paragraph;

in Regulations on procedure for certification of systems of information security of the information systems intended for information processing, distribution and (or) provision of which is limited, approved by this order:

"This Provision can not be applied by operators of telecommunication - owners (owners) of the information systems providing management of engineering procedures and intended only for transfer of personal data on technological networks of telecommunication to such information systems. For the purposes of application of this part operators of telecommunication approve with Operational analytical center in case of the President of the Republic of Belarus (further - OATs) lists of the specified information systems to which structural and logical schemes of each information system included in the list shall be attached.";

"Data on events of information security, condition of technical and cryptographic information security according to this Provision can not be represented to OATs by operators of telecommunication - owners (owners) of the information systems providing management of engineering procedures and intended only for transfer of personal data on technological networks of telecommunication concerning such information systems. For the purposes of application of this part operators of telecommunication approve with OATs lists of the specified information systems to which structural and logical schemes of each information system included in the list shall be attached.";

state Item 5 in the following edition:

"5. The data provided in subitems 4.1-4.3 of item 4 of this provision are represented by means of receipt of electronic services of the nation-wide automated information system with use of personal electronic accounts.";

1.3. in the order of Operational analytical center in case of the President of the Republic of Belarus of July 25, 2023 No. 130 "About measures for implementation of the Presidential decree of the Republic of Belarus of February 14, 2023 No. 40":

To be reworded as follows the regulations on procedure for carrying out certification of the centers of ensuring cyber security and response to cyberincidents of objects of information infrastructure of state bodies and other organizations approved by this order it (is applied);

be reworded as follows appendices 1-4 (are applied).

2. The service provision agreements on ensuring cyber security signed before entry into force of this order till December 31, 2026 are subject to reduction in compliance with this order.

3. Certification of the centers of ensuring cyber security and response to cyberincidents of objects of information infrastructure of state bodies and other organizations for the applications submitted before entry into force of this order is performed according to the procedure, established by the legislation existing for date of submission of these statements.

4. The state bodies and other organizations which created the centers of ensuring cyber security and response to cyberincidents of objects of information infrastructure of state bodies and other organizations, decisions on which certification are made before entry into force of this order or based on the statements specified in Item 3 of this order provide reduction of these centers, including their structures, in compliance with this order and inform on it Operational analytical center in case of the President of the Republic of Belarus in the following terms:

state bodies and state-financed organizations - till July 1, 2027;

other organizations - till December 31, 2026.

5. This order becomes effective since July 1, 2026.
