1. Approve:

1) Rules of the organization of building and passing of allowing procedures in the field of construction according to appendix 1 to this order;

To Recognize 2) invalid some orders according to the list according to appendix 2 to this order.

2. To provide to committee on cases of construction and housing and communal services of the Industry ministry and construction of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Industry ministry and construction of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Industry and construction of the Republic of Kazakhstan.

4. This order becomes effective after sixty calendar days after day of its first official publication.

Rules of the organization of building and passing of allowing procedures in the field of construction

Chapter 1. General provisions

1. These rules of the organization of building and passing of allowing procedures in the field of construction (further – Rules) are developed according to the subitem 25) of article 24 of the Construction code of the Republic of Kazakhstan (further – the Code) and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state and socially responsible services" (further – the Law) and establish procedure and terms: registrations and issues of the documents necessary for construction new and changes of the existing construction objects, functional purpose of rooms; commissioning of construction objects by subjects of architectural, town-planning and construction activities; designings and buildings of the territory of settlements and mezhselenny territory and rendering the state services "Provision of Initial Materials in Case of Project Development of Construction and Reconstruction (Re-planning and Re-equipment)" and "Approval of the Sketch (Outline Sketch)".

2. These rules are applied by local executive bodies (further – MIO), service providers on engineering and utility support, the state bodies exercising the state architectural construction supervision and supervision, subjects of architectural, town-planning and construction activities irrespective of patterns of ownership on construction objects and (or) reconstruction including networks of engineering infrastructure, and also owners of real estate objects regarding their operation and content.

3. Physical persons and legal entities perform building in the territory of the settlement and mezhselenny the territories according to these rules.

4. In these rules the following concepts are used:

1) initial materials – the materials necessary for development of the project documentation;

2) individual housing construction – construction of individual apartment houses by persons on the parcel of land assigned to them in accordance with the established procedure by their own forces or by contract method;

3) the title document on the parcel of land – the document confirming occurrence of dispositive facts (legal structures) based on which arise the rights to the parcel of land, including agreements, decisions of the courts, legal acts of executive bodies, the certificate on the right to inheritance, the transfer act or the separation balance sheet change or stop by reorganization of the non-state legal entities who are owning the parcel of land on the property right or redeemed the right of temporary paid land use (lease), the protocol following the results of the biddings (auctions) selling the parcel of land or the right of lease of the parcel of land;

7) construction – activities for creation of fixed assets of production and non-productive appointment by construction new and (or) changes (expansions, upgrades, modernization, reconstruction, restoration, capital repairs) construction objects (their complexes, communications), installation (dismantle), the related processing and engineering equipment, production (production) of construction materials, products and designs, and also implementation of works on preservation of objects of construction in progress and post-utilization of the construction objects which developed the resource;

8) the building site – the territory used for placement of constructed facility, temporary structures and constructions, the equipment, dumps of soil, warehousing of construction materials, products, the equipment and accomplishment of installation and construction works;

9) construction object – the object of the artificial circle in building image or constructions which is resulting effect of construction activities;

10) unique number of construction object (further – ABLATION) – the identification eighteen-place number created in the automated digital system of the state town-planning inventory for information collection (data) on construction object from receipt of initial materials and allowing documents for project development of construction, reconstruction (re-planning and re-equipment) before acceptance and commissioning of construction object for the purpose of monitoring of its lifecycle;

11) passing of allowing procedures in the field of construction – provision of the right to the subject of architectural, town-planning and construction activities on realization of his intention for construction and (or) change of construction objects (separate parts);

12) the automated digital system of the state town-planning inventory (further – ATsS GGK) – the digital system of the state town-planning inventory providing collection, accounting, registration, introduction (filling), processing, storage, access, provision of information and (or) data, display and distribution of data of the state town-planning inventory;

13) the state architectural construction supervision and supervision – the activities of the state bodies exercising the state architectural construction supervision and supervision, directed to the warning, identification, suppression and elimination of violations of the law of the Republic of Kazakhstan of architectural, town-planning and construction activities, and also control and supervision of their observance;

14) the contractor – the physical and (or) legal entities (including joint businesses) having the license for implementation of separate types of activity in the field of architecture, town planning and construction.
