I ORDER:

1. Bring in the order of the Minister of Agriculture of the Republic of Kazakhstan of March 15, 2019 No. 108 "About approval of Rules of subsidizing of development of breeding livestock production, increase in productivity and product quality of livestock production" (registered in the Register of state registration of regulatory legal acts at No. 18404) the following changes and amendments:

"According to the subitem 41) of Item 1 of article 6 of the Law of the Republic of Kazakhstan "About state regulation of development of agro-industrial complex and the rural territories", the subitem 2) of Item 3 of article 16 of the Law of the Republic of Kazakhstan "About the state statistics" and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state and socially responsible services" I ORDER:";

in the Rules of subsidizing of development of breeding livestock production, increase in productivity and product quality of livestock production approved by the specified order:

state Item 1 in the following edition:

"1. These rules of subsidizing of development of breeding livestock production, increase in productivity and product quality of livestock production (further – Rules) are developed according to the subitem 41) of Item 1 of article 6 of the Law of the Republic of Kazakhstan "About state regulation of development of agro-industrial complex and the rural territories", the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state and socially responsible services" (further – the Law) and determine procedure for provision of budget subsidies (further – subsidies) for the account and within the means provided in the local budget for the corresponding financial year, and also procedure for rendering the state service "Subsidizing on Development of Breeding Livestock Production, Increase in Productivity and Product Quality of Livestock Production" (further – the state service).";

in Item 2:

add with subitem 2-1) of the following content:

"2-1) special accounts – the account of financial institution in bank of the second level on which the amount of subsidies is credited;";

add with subitems 4-1) and 4-2) of the following content:

"4-1) agreement of crediting - the agreement signed between financial institution and the borrower (uslugopoluchatel) under the terms of which the financial institution provides the credit/microcredit and include the framework agreement, the agreement on opening of credit line, the credit agreement, the credit agreement, the loan agreement, the agreement on provision of the microcredit, and also other agreements meeting the requirements to the loan agreement;

4-2) financial institution – the financial organizations having licenses for banking operations, and also credit partnerships and the microfinancial organizations in the field of agro-industrial complex;";

4) to state the subitem in the following edition:

"4) digital system of the single State Immovable Property Cadastre – the digital system containing data of land and legal inventories which procedure for maintaining is determined by the Land code of the Republic of Kazakhstan and the Law of the Republic of Kazakhstan "About state registration of the rights to real estate";";

10) and 11) to state subitems in the following edition:

"10) the digital register of requests for subsidizing (further – the register) – set of data on requests for subsidizing, and other data reflected in GTsSS;

11) the state digital system of subsidizing (further – GTsSS) – the organizational arranged set of digital technologies, service personnel and technical documentation intended for rendering services in accomplishment of processes of subsidizing giving interaction opportunity with the web portal of "the digital government", registration of the request for receipt of subsidies, and also its processings by means of automatic verification of the request for compliance to subsidizing conditions;";

14) and 15) to state subitems in the following edition:

"14) the web portal of "the digital government" – the digital object representing "single window" of access to the consolidated information placed by the state bodies and other subjects participating in provision of the state services including the regulatory legal base and also to the state and other services rendered electronically;

15) the digital signature (further – the EDS) – the digital record (set of digital data) created with use of the closed key of the digital signature and means of the digital signature, confirmatory reliability of the electronic document, its accessory and invariance of content.";

4, of 5, 6 and 7 to state Items in the following edition:

"4. The Ministry of Agriculture of the Republic of Kazakhstan (further – the Ministry) within 3 (three) working days from the date of change of these rules staticizes information on procedure for rendering the state service and sends to local executive bodies of areas, cities of republican value and the capital (further – MIO (service provider)), to the operator of "the digital government" and to Single contact center.

5. In case of failure of GTsSS containing necessary data for issue of subsidies, the service provider without delay notifies the Ministry on the arisen situation which starts its elimination.

At the same time, after work on elimination of the arisen failure the Ministry within 3 (three) working days constitutes the protocol on technical issue and places it in GTsSS.

6. Forming and distribution of amounts of subsidies are performed by MIO (service providers) according to the types and standard rates of subsidies established in appendix 1 to these rules within the allocated budgetary funds for the corresponding financial year, taking into account:

information provided by local executive bodies of areas and cities about requirement of amounts of subsidies the current year;

total about the mastered amounts of subsidies in previous year;

regional features;

the prevailing specialization of agricultural production in the region, including the import-dependent directions, the determined quantity and share of the companies which are engaged in production of agricultural products.

Amounts of subsidies are determined by multiplication of quantity of units (the heads, kilograms, doses, pieces) on the corresponding standard rate of subsidies established according to appendix 1 to these rules.

In the presence of the debt on unexecuted obligations to producers formed as a result of nonpayment of subsidies according to the submitted and approved applications last financial year(s), the corresponding outstanding amount is subject to inclusion in calculation when planning amount of subsidies for the current financial year.

The total amount of need for subsidies in all directions of subsidizing is determined by summing of requirements by each type of subsidies.

The offered amounts of subsidies with appendix of the decision of maslikhat on approval of the regional budget for the corresponding period no later than January 10 of the corresponding year are signed by the EDS of the head of MIO (service provider) and sent by means of GTsSS for approval in the Ministry.

In the presence of the basis for the adjustment of total amount of means providing redistribution or growth in volumes of financing, allocation of additional resources for types of subsidies, MIO (service provider) makes corresponding changes to GTsSS and sends them by means of GTsSS for approval in the Ministry.

In case of the insufficient number of requests by separate types of the subsidies specified in appendix 1 to these rules and also in the presence of unused means, within financial year of MIO (service provider) redistributes the specified funds for other types of the subsidies specified in appendix 1 to these rules according to which there is shortage of means.

MIO (service provider) for subsidizing monitoring annually, till February 1 of the year following reporting represent to the Ministry:

information on use of subsidies on types of the subsidies established in appendix 1 to these rules on form according to appendix 4-2 to these rules.

7. The ministry within 2 (two) working days considers the provided amounts of subsidies for compliance to appendix 1 to these rules.

In case of compliance to the standard rates of subsidies established according to appendix 1 to these rules, the Ministry by means of GTsSS approves the provided MIO (service provider) amounts of subsidies.

In case of discrepancy to the standard rates of subsidies established according to appendix 1 to these rules, identifications of incorrect calculations in case of distribution of amounts of subsidies, the Ministry by means of GTsSS sends the motivated conclusion to MIO (service provider) with indication of causes of failure.

The term of completion of amounts of subsidies of MIO (service provider) constitutes 3 (three) working days.";

state Item 12 in the following edition:

"12. For application for subsidies, the producer needs to be registered in GTsSS. The producer is registered independently, by means of the EDS.";

state Items 14 and 14-1 in the following edition:

"14. Subsidies are paid in case of observance of the following conditions:

1) applications in electronic form by means of interaction of the web portal of "the digital government" with GTsSS:

on receipt of subsidies for acquisition: breeding uterine number of cattle (the milk, milk and meat, meat and meat-and-milk directions), breeding manufacturing bull (the meat and meat-and-milk directions), breeding sheep, breeding manufacturing ram, breeding manufacturing stallion of the productive direction, breeding manufacturing camel, breeding manufacturing male pig, breeding pigs, breeding uterine livestock of goats, breeding daily young growth parent / прародительской forms of the meat direction of birds and daily young growth of final form of the egg referral got from breeding bird in form 1 according to appendix 3 to these rules;

on receipt of subsidies by the breeding centers, distribyyuterny centers for realization of seed and embryos of breeding animals and technicians-osemenatorami for services in artificial insemination of uterine livestock of the large horned cattle / sheep of producers and in agricultural cooperatives in form 2 according to appendix 3 to these rules;

on receipt of subsidies for the acquired same-sex and bisexual seed of breeding bulls milk / молочно-мясного and the meat/meat-and-milk directions in form 3 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of acquisition value of embryos of cattle and sheep in form 4 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of manufacturing cost of meat of chicken in form 5 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of manufacturing cost of milk (cow, mare's, camel) in form 6 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of manufacturing cost of milk by agricultural production cooperatives in form 7 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of cost of the realized beef by the meat-processing companies, engaged in slaughter and primary conversion of beef in form 8 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of cost of cattle of the men's individuals realized on fattening to feedlots or on slaughter in the meat-processing companies for form 9 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of cost of small cattle of the men's individuals realized on fattening to feedlots or on slaughter in the meat-processing companies for form 10 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of cost of small cattle of the men's individuals realized on fattening to feedlots or on slaughter in the meat-processing companies (seasonal deliveries) for form 11 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of cost of the pigs implemented or moved on slaughter to the meat-processing companies or on lethal Items in form 12 according to appendix 3 to these rules;

on receipt of subsidies for conducting selection and breeding work with breeding uterine livestock of domestic breeds of horses of the riding and riding and draft directions in form 13 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of cost of the thin and semi-thin/rough and semi-rough wool realized for conversion in form 14 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of manufacturing cost of honey in form 15 according to appendix 3 to these rules;

on receipt of subsidies for reduction in cost of costs in case of cultivation of breeding young growth of cattle of the meat direction / small cattle in form 16 according to appendix 3 to these rules;

on transfer of subsidies for the special account on form 17 according to appendix 3 to these rules;

on receivable subsidies for acquisition of breeding uterine number of cattle (the milk, milk and meat, meat and meat-and-milk directions), breeding sheep, breeding manufacturing ram, breeding manufacturing stallion of the productive direction, breeding manufacturing camel, breeding manufacturing male pig, breeding pigs, breeding uterine livestock of goats in form 18 according to appendix 3 to these rules;

2) registration of the submitted application in GTsSS with use of the EDS;

3) request compliance to the criteria established in appendix 2 to these rules.

The list of the main requirements to rendering the state service "Subsidizing on Development of Breeding Livestock Production, Increase in Productivity and Product Quality of Livestock Production" is stated in annex 4 to these rules (further – the List).

Information exchange of the web portal of "the digital government" and GTsSS is performed according to the digital legislation of the Republic of Kazakhstan.

14-1. The producers receiving subsidies need to observe obligations on providing to growth/preserving at the level of previous year of amount of gross output (goods or services) of agro-industrial complex, in terms of money (thousands of tenges).

Counter obligations are assumed by subjects of agro-industrial complex on condition of obtaining in the current financial year of subsidies in total by all types of subsidies by which establishment of similar counter obligations, in the amount of 100 000 000 (hundred million) tenges and is provided above.

Since January 1, 2029 counter obligations extend to all subjects of agro-industrial complex receiving subsidies.

The amount of gross output (goods or services) of agro-industrial complex is determined by the following formula:

amount of gross output (goods or services) of agro-industrial complex for previous year, thousands of tenges = amount of the made products (goods or services) of agro-industrial complex for previous year in kind, tons/heads/pieces/doses x the price for products (goods or service) of agro-industrial complex, thousands of tenges.

In case of non-execution of obligations owing to force majeure (deterioration in climatic conditions, phytosanitary and epizootic situations), the producer places in GTsSS the document confirming this fact (the certificate of weather conditions issued by the republican state company on the right of economic maintaining Kazgidromet of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan and (or) the solution of MIO on establishment of quarantine or restrictive actions and (or) the appraisal certificate (test report) on detection of disease of animals and (or) the act of damage of crops by wreckers, diseases of plants and weeds).

The counter obligation is considered unexecuted in case of negative variance (the column 8 of form 1 of appendix 4-1 to these rules) which is calculated by means of difference between amount of gross output (goods or services) of agro-industrial complex for 2 (two) previous years preceding year of application. In case of primary adoption of counter obligations the variation is equal to zero.

In case of non-execution of obligations during 2 (two) previous years in a row for the first time and lack of the documents confirming approach of force majeure circumstances the possibility of application for receipt of subsidies current calendar year for 1 (one) will be stopped. In case of non-execution of obligations during 2 (two) previous years in a row in the second and subsequent times and lack of the documents confirming approach of force majeure circumstances the possibility of application for receipt of subsidies current calendar year for 2 (two) will be stopped.

Quarterly, developer of these rules, in GTsSS data on national average prices for products (goods or service) of agro-industrial complex are placed, the Bureau of national statistics of the Agency on strategic planning and reforms of the Republic of Kazakhstan agrees officially the provided information. In case of new products (goods or service) of agro-industrial complex the national average prices of it are brought in GTsSS till January 20 of the corresponding year. When calculating amount of gross output (goods or services) of agro-industrial complex the fixed price of 2024 is used. In case of lack of data on the prices in official statistical information data from alternative sources or average price of 5 (five) subjects of agro-industrial complex of area, city of republican value, the capital making this type of products will be used.

Information on amount of the made gross output (goods or services) of agro-industrial complex is filled in with producer in the Personal account in form 1 according to appendix 4-1 to these rules (further – the form 1) in time since January 20 and until the end of the current year and is confirmed by the digital signature. Data on counter obligations are reflected in the register of counter obligations in form 2 according to appendix 4-1 to these rules and are public for users.

At the same time the producers who underwent state registration in the current year the amount of gross output for previous year is specified in value "0".

"16. Confirmation of acquisition of breeding products (material), realization of livestock and (or) products is performed electronic accounts invoices by means of the digital system of electronic invoices (further – TsS ESF) integrated with GTsSS.

In case of acquisition by producer of livestock directly at the foreign producer who is not using TsS ESF, purchase costs are confirmed by the customs declaration on goods (from the third countries which are not members of the Eurasian Economic Union) or the statement (statements) for commodity importation and payment of indirect taxes with mark of tax authority according to Item 2 of article 530 of the Tax Code of the Republic of Kazakhstan (from the territory of state members of the Eurasian Economic Union).

17. MIO (service provider) creates the special commission determining production capacity, availability of the corresponding infrastructure, and also performing issue and withdrawal of the conclusions of the special commission on compliance of production capacity and infrastructure of the company applying for receipt of subsidies for form according to appendix 5 to these rules (further – the conclusion).

The special commission is created of representatives of structural division of MIO (service provider), local executive body of areas (cities), and also under approval from representatives: regional chamber of entrepreneurs of National chamber of entrepreneurs of the Republic of Kazakhstan of Atameken, public industry unions, associations, republican chambers.

The head of the structural unit of MIO (service provider) is appointed the chairman of the special commission.

The structure of the special commission is created taking into account exception of conflict of interest in activities of the special commission.

At least 3 (three) specialists determined by the special commission go to each producer.

Survey is performed in the presence of producer or his authorized representative.

Determination of production capacity of the company and infrastructure is performed on a grant basis within 5 (five) working days from the date of receipt of the written notice of producer in MIO (service provider). The term of consideration is prolonged no more than for 5 (five) working days in coordination with producer.

The scanned copy and data from the conclusion, and also photo and (or) video records are introduced by MIO (service provider) in GTsSS within 2 (two) working days from the date of provision of the signed conclusion by the special commission.";

"20. Forming and registration of the request is made by producer in the Personal account in the following procedure:

23-3. Process of rendering the state service stops:

1) in the cases provided by subitems 1) and 2) of Item 23-2 of these rules – before determination of the legal successor of the died person or appointment to incapacitated face of the guardian;

2) in the cases provided by the subitem 3) of Item 23-2 of these rules – before determination of line item by state body or to the introduction in legal force of court resolution.

23-4. The service provider according to the petition of uslugopoluchatel or on the initiative stops process of rendering the state service in cases:
