About approval of Changes in Regulations on registration of the collection companies

According to Articles 7, of 15, 55-1, 56 of the Law of Ukraine "About the National Bank of Ukraine", articles 18, of 21 Law of Ukraine "About financial services and finance companies", Articles 5, of 22, 24 Laws of Ukraine "About consumer crediting", for the purpose of updating of procedures of the National Bank of Ukraine concerning registration of the collection Board of the National Bank of Ukraine companies decide:

1. Approve the Change in Regulations on registration of the collection companies approved by the resolution of Board of the National Bank of Ukraine of July 09, 2021 No. 75 (with changes) which are applied.

2. To provide to the collection companies within six months from the date of entry into force of this resolution submission to the National Bank of Ukraine:

1) written assurance of any form which contains complete and reliable information about conducting by the collection company check of heads, owners of essential participation in such collection company on their compliance to the requirements for goodwill determined in the Regulations on registration of the collection companies approved by the resolution of Board of the National Bank of Ukraine of July 09, 2021 No. 75 (with changes) (further - No. Provision 75), taking into account the changes approved by this resolution, and on compliance of specified persons to the requirements for goodwill determined in the Provision No. 75;

2) the questionnaire with the description of business intentions constituted in the form established by the administrative act of the National Bank of Ukraine and placed on the page of official Internet representative office of the National Bank of Ukraine (table 8 of this questionnaire is not filled in), in case of identification of any sign of the not irreproachable goodwill specified in Chapters 10, of the 11th Section III of Provisions No. 75 taking into account the changes approved by this resolution.

3. To department of methodology of regulation of activities of non-bank financial institutions (Sergey Savchuk) after official publication to inform the collection companies information on adoption of this resolution.

4. The resolution becomes effective since September 15, 2025.

Changes in Regulations on registration of the collection companies

1. In the Section I:

1) in Item 3 of Chapter 1:

in subitem 1 of the word "the applicant's workers / the collection company or persons involved by the applicant / the collection company based on civil contracts for direct interaction with consumers (further - the involved persons),", "and the regulatory legal act concerning establishment of qualification requirements to employees of the collection companies" to exclude;

exclude subitem 3;

2) in Chapter 5:

to add the subitem 2 of Item 60 with words ", inclusion of data on availability of temporary ban to perform settlement of overdue debt";

add Item 61 with the new paragraph of the following content:

"The National Bank includes in the Register of the data on temporary ban of the collection company to perform settlement of overdue debt, including the period of such prohibition, and about removal/cancellation of such prohibition no later than the next working day from acceptance date of the relevant decision.";

add Item 64 with the new subitem of the following content:

"10) data on temporary ban of the collection company to perform settlement of overdue debt: availability of temporary ban to perform settlement of overdue debt, the period (from what before what date) such prohibition, data on removal/cancellation of such prohibition.";
