About modification and amendments in some orders of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan

I ORDER:

1. Approve the enclosed list of some orders of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan to which changes and additions are made.

2. To department of social security and social insurance of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan, in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on official Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan;

3) within three working days after execution of subitems 1) and 2) of Item 2 of this order to provide provision in Department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

1. Bring in the order of the Deputy prime minister - the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of June 9, 2023 No. 213 "About approval of Rules of subsidizing of compulsory pension contributions to receivers of social payments for case of loss of the income in connection with child care of age of one and a half years on reaching it" (it is registered in the Register of state registration of regulatory legal acts at No. 32776) the following changes:

SMS notifications are registered in the online magazine of SMS notifications which is kept in form according to appendix 15 to these rules.

If required documents for purpose of pensions are submitted within thirty working days, the department of State corporation sends for approval to authorized body to destination of pensions and benefits the electronic draft decision about appointment, recalculation, review of the decision on appointment (renewal or about refusal in appointment) to pension from the date of emergence of the right to payment.

If required documents are submitted after thirty working days, date of the address day of repeated filing of application according to Items 35 and 36 of these rules is considered.

In case of absence in EMD of the missing document for decision making about appointment, recalculation, review of the decision on appointment (renewal or about refusal in appointment) pensions according to the statements including accepted by means of the web portal, the authorized body passes the decision on refusal in appointment.

In the presence of the bases for verification of the submitted documents the authorized body performs their check, including again submitted documents, no more than fifteen working days in time.

The bases for conducting verification of the documents (data) submitted for purpose of pensions are:

1) untimely and (or) incomplete receipt of compulsory pension contributions and social assignments;

2) detection of discrepancies and (or) contradictions in the data containing in the submitted documents;

3) availability of signs of unauthenticity of documents, including corrections and lack of necessary confirmatory data.

For the purpose of confirmation or confutation of the provided data the authorized body sends inquiries to state bodies, the organizations and other sources.

In case of conducting verification of the submitted documents the notification goes in form according to appendix 15-1 to these rules, and SMS notifications are registered in the online magazine of SMS notifications in form according to appendix 15-2 to these rules.

After the direction to the applicant of the notification the department of State corporation creates the electronic draft decision based on the data which are available in EMD, and sends to authorized body to destination of pensions and benefits for decision making about appointment (about refusal in appointment) to pension.

By results of check the authorized body sends the received documents and data to department of the State corporation for familiarizing with EMD and in need of its completion.

The department of the State corporation sends modifed EMD to authorized body which considers it and makes the decision on appointment or on refusal in award of pension.";
