About approval of instructions for use electrical energy and natural gas

For the purpose of ensuring execution of the resolution of the President of the Republic of Uzbekistan of February 13, 2023 with No. PP-54 "About measures for increase in efficiency of the state control in the field of use of fuel and energy resources", and also electrical energy and natural gas the Cabinet of Ministers decides increases in energy efficiency of industries of economy and the social sphere by effective and rational use of fuel and energy resources, further strengthening of control of observance by consumers of instructions for use:

1. Approve:

Instructions for use electrical energy according to appendix No. 1, providing:

the rights and obligations, and also responsibility of consumers of electrical energy and the electrosupplying companies;

implementation of the state control of production, transfer, distribution and consumption of electrical energy;

procedure for connection of consumers to power networks;

procedure of calculations for electrical energy;

Instructions for use natural gas according to appendix No. 2, providing:

rights and obligations, and also responsibility of consumers of natural gas and gas supplying companies;

procedure for determination of annual need for natural gas;

procedure for connection of consumers to gas networks;

procedure of calculations for natural gas;

rational, safe use of natural gas and its regulation.

2. To provide to Department of Energy of the Republic of Uzbekistan together with National broadcasting company of Uzbekistan, the Agency of information and mass communications, Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent, and also the relevant organizations of industry extended coverage of this resolution in mass media and social networks.

3. Recognize invalid some decisions of the Government of the Republic of Uzbekistan according to appendix No. 3*.

4. To Department of Energy of the Republic of Uzbekistan together with the interested ministries and departments in two-month time to bring the regulatory legal acts adopted by them into accord with this resolution.

5. To impose control of execution of this resolution on the deputy prime minister of the Republic of Uzbekistan A. Zh. Ramatov and the Minister of Energy of the Republic of Uzbekistan Zh. T. Mirzamakhmudov.

Instructions for use electrical energy

Chapter 1. General provisions

1. These rules determine requirements in the field of production, delivery and consumption of electrical energy.

2. In these rules the following basic concepts are used:

emergency operation - inadmissible variation of technological parameters of work of power generation facilities which can lead to violation of reliable functioning of single electric utility system and restriction of delivery of electrical energy to consumers;

block stations - the power plants of consumers connected directly or through networks of consumers to single electric utility system and which are logging in supervisory control;

illumination and garlands are the light jewelry and chains of lamps hanged by restaurants, cafe, bars, trade enterprises and servicing on surrounding trees and designs;

the attached capacity of the consumer - total capacity of the transformers of the consumer attached to power network transforming electrical energy to working tension and electric motors over 1000B;

control removal of indications (bypass) - removal of indications of the actual expense of electrical energy from the metering device by the authorized employee of PTES with carrying out visual survey of integrity of the established seals and simultaneous execution of the relevant electronic act with its subsequent entering in the relevant base of the software. The data received through the program of the Automated control system and accounting of electrical energy (further - ASKUE), are not bypass;

residential customers - the population using electrical energy for domestic needs;

the mining is activities for maintaining the distributed register of the computing transactions this by accomplishment, creations and integrity checkings of blocks;

consumers to whom the electrical energy is delivered in special procedure, - especially dangerous industrial enterprises with continuous engineering procedure, shutdown of electrical energy in which can lead to technogenic and emergency effects, buildings of the supreme bodies of the government (The senate and Legislative house of Oliy Majlis of the Republic of Uzbekistan, Administration of the President of the Republic of Uzbekistan, the Cabinet of Ministers of the Republic of Uzbekistan, the Supreme Court and others), regional water governments, the organizations for heat supply and providing with drinking water, courts and law enforcement agencies, military units, the centers of emergency medical service and intensive care units of the public medical institutions, the subway and the airports;

survey meters of accounting - metering devices based on which indications the expense of electrical energy of certain workshops, processing lines, the power-intensive equipment and separate family in apartment houses where lives several families used for control of expense of electrical energy is determined;

irrational expenditure - lack of compensation of expense of electrical energy, including reactive capacity, without use of the existing possibility of decrease in expense of electrical energy;

economic value of reactive energy - optimum value of reactive energy which exceeding leads to quality degradation of electrical energy and increase in losses of energy in networks of the electrosupplying company;

reactive energy - the energy spent for formation of the electromagnetic field;

The regulator - Agency on development and regulation of energy market of the Republic of Uzbekistan;

inefficient expenditure - real loss of energy as a result of unproductive or wasteful functioning of the equipment in the absence of need for operation of electroinstallations and engines;

the subconsumer - the legal entity or physical person which is directly attached to power networks of the consumer with the consent of PTES and the agreement of electric utility service which signed with the consumer. By transfer of electrical energy to the subconsumer responsibility for observance of these rules is born by the consumer;

designs of outdoor advertizing and information objects - the video screens, electronic displays, media facades and devices displaying information in the form of advertizing, established on the special, shoddy or fixed constructions placed on the open areas, and also on front part, walls, roofs of buildings, constructions, fences, elements of the street equipment, on streets and the carriageway of roads, gas stations;

the system operator - the authorized structure exercising supervisory control of the technological mode of functioning of single electric utility system, the high-level power networks, and also providing its interaction with electric utility systems of other states (State unitary enterprise "National Dispatch Center");

the payment document - payment request, the payment order or the electronic payment document having the structure established by rules of payment system, format of its details and containing necessary information for implementation of electronic payment, confirmed with the digital signature based on which money of PTES is transfered to account. When implementing clearing settlements by means of electronic payment documents the possibility of their reproduction on paper with preserving the details necessary for implementation of electronic payment shall be provided;

restriction - decrease in contractual size of delivery of electrical energy to the consumer for certain period owing to implementation of the actions provided in the agreement, and also in case of emergency operation in power networks of PTES which arose on force majeur circumstances;

objects of electric grid economy - power line, transformer substations, distribution points intended for implementation of transfer and delivery of electrical energy;

limit of the Section of balance sheet accessory of power network - the point of the Section of power network between PTES and the consumer determined by balance sheet accessory of power network;

the electrosupplying company - the division of PTES performing distribution and sale of electrical energy to consumers within the area, the city, economic (industrial) zone or the private enterprise performing these functions;

the agreement of electric utility service - the agreement according to which PTES shall deliver to the consumer through the attached power network electrical energy in the presence at the consumer of the necessary equipment and metering devices of consumption of electrical energy and the consumer shall make payment for electrical energy, and also perform the relevant activities, including observance of the electric utility service of the mode of consumption of electrical energy provided by the agreement, safety of operation of the power networks which are under its authority and operability of the equipments and devices connected with consumption of electrical energy used by it;

technological reservation of electric utility service - the amount of electrical energy or capacity necessary for completion of engineering procedure, production cycle;

the contractual size of consumption of electrical energy - established in the agreement of electric utility service I will eat around electrical energy (active, reactive), calculated proceeding from the capacity permitted by specifications, the most optimum number of hours of use of electroinstallations and number of the working days during the corresponding settlement period;

the consumer of electrical energy - the legal entity or physical person using electrical energy for production and (or) domestic needs according to the agreement of electric utility service;

the metering device of amount of expense of electrical energy (further - the metering device) - the technical tool based on which indications the amount of the consumed electrical energy which is subject to payment is determined;

quality of electrical energy - compliance of parameters of electrical energy to the requirements established by national standards;

having rummaged in electric utility service (shutdown) - suspension of delivery of electrical energy to the consumer, except for the break caused by successful operation of automatic devices or shutdown of one or several utility lines for the consumers receiving electrical energy at the same time on several power lines, the consumption of electrical energy which is not leading to restriction;

the mode of consumption of electrical energy - maintenance of admissible power factor, preserving normative tension, ensuring not exceeding of normative losses of electrical energy in network;

the receiver of electrical energy (electroreceiver) - the installation (electric equipment) intended for transformation of electrical energy to other type of energy. Power transformers are not the electroreceiver;

electroinstallation - set of the machines, devices, power lines and the service equipment (together with constructions and rooms, in which they are established) intended for production, transformation, transfer, distribution of electrical energy and its transformation to other type of energy;

emergency reservation of electric utility service - the smallest level of electric power or amount of electrical energy in case of partial or complete stop of activities of consumers for safety of the equipment, safety of life of people, preserving emergency and security lighting, ventilation, water disposal, water supply, heating, means of fire safety;

the metering devices compatible to ASKUE, - the metering devices corresponding to single system of CAS (Central AMI Systems - the central system of advanced measuring infrastructure) implemented in each region of the republic;

the ASKUE system equipment - the set of devices consisting of communication modules, antennas, modems, sim cards, concentrators;

single electric utility system - set of the companies for production of electrical energy, the high-level power networks, territorial power networks and operational dispatch center;

accounting point - point of the scheme of electric utility service in which by means of the measuring device (or systems of accounting) the amount of expense of electrical energy is determined;

system of accounting - set of the devices consisting of measuring transformers, secondary chains, test blocks, transitional klemmnik and metering devices;

settlement period - period of time (month) for which the expense (amount) of consumption of electrical energy shall be determined settlement between the consumer and PTES for the consumed electrical energy is made;

verification of the scheme of connection of the metering device - check by the authorized employee of PTES and (or) Uzenergoinspektion of correctness of the scheme of connection of the metering device and measuring transformers of the consumer by tool method, with simultaneous execution of the relevant electronic act and its subsequent entering in the relevant bases of the software, and in case of execution of the act by Uzenergoinspektion's employee - with submission of the act in PTES for entering into the relevant bases of the software;

these memories of the metering device or ASKUE base - set of all data which are stored in memory of the metering device, and also in base (server) of data storage of ASKUE;

PTES - the legal entity having the right to sell and distribute electrical energy to consumers within area, the area (city), economic (industrial) zone based on the agreement of electric utility service.

3. The metering devices compatible to ASKUE having the certificate on carrying out metrological checking of gage are used to accounting of the consumed electrical energy.

The authorized employee of JSC Regionalnye elektricheskiye seti and PTES together with consumers for determination of the actual amount of consumption of electrical energy at consumers (except residential customers) if necessary check indicators of their metering devices and the scheme of connection of metering devices. The basis for determination of the actual amount of the consumed electrical energy for legal entities, and also for the physical persons performing business activity is the consumption report of electrical energy of the established form provided by the consumer to PTES purposely by means of fax, electronic or mail service.

In process of implementation of ASKUE removal of indications from metering devices of consumers is made according to technical parameters of the automated system or according to the request of the consumer.

PTES on permanent basis provide forming and transfer in real time to system of interdepartmental electronic interaction of the disaggregated information on condition of personal account and metering devices.

4. The consumer can attach to the power networks belonging to him additional electroinstallations up to 1 000B within the permitted capacity.

5. In case of identification of the facts of the unproductive and irrational use of electrical energy, the non-compliance with the mode of consumption of electrical energy and unsatisfactory technical condition of electroinstallations creating risk of emergence of accident or creating threat of life of people, illegal connection to power networks and also the facts of intentional damage of metering devices, external interference for the purpose of change of indicators of metering devices the staff of Inspectorate for control of electricity use, oil products and gas under the Cabinet of Ministers (further - Uzenergoinspektion) has the right to issue to the corresponding PTES or the consumer the obligatory instruction about suspension of power supply of these electroinstallations.

In case of identification by Uzenergoinspektion at the consumer of the facts of irrational use of electrical energy, failure to carry out of organizational and technical actions for economy of electrical energy, lack of the implemented renewable energy resources according to requirements of specifications (according to the relevant signed act) PTES has the right to reduce the contractual size of consumption of electrical energy, proceeding from the elicited facts.

6. The break or restriction in transfer of electrical energy without approval and without the prevention of the consumer, but with its immediate notification in case of need of acceptance of PTES of the urgent measures connected with prevention and accident elimination on objects of electric grid economy or safety of people is allowed.

7. The suspension of delivery of electrical energy (regardless of the reasons) for the period of automatic implementation of the reserve power supply, repeated connection or automatic frequency unloading of the power supply provided by the project of electric utility service of object is not considered break in electric utility service.

8. Energy supervision of the electroinstallations operated by special rules is performed by authorized state bodies according to acts of the legislation.

Requirements to technical condition and operation of power networks, the equipment, devices and devices, and also procedure of control of their observance are determined by the legislation in the field of power industry.

9. Implementation of the state supervision by Uzenergoinspektion and its territorial administrations does not exempt consumers from liability for ensuring proper technical condition and safety of the operated power networks, the equipment and devices, observance of the set mode of consumption of electrical energy, and also from obligation immediately to notify PTES on accidents, the fires, defects of the metering devices and other violations arising when using electrical energy.

10. The consumers who committed theft, allowed irrational expenditure of electrical energy by unauthorized connection to power networks or metering devices, including the external interference for the purpose of intentional damage of their seals or change of indicators of metering devices and which did not execute Uzenergoinspektion's instruction bear responsibility according to the procedure, established by the legislation.

Chapter 2. Rights and obligations of consumers of electrical energy

11. Consumers of electrical energy have the right:

attach the electroinstallations to power networks according to specifications;

receive electrical energy which indicators of quality conform to state standards;

obtain in accordance with the established procedure information on the reasons of suspension of delivery of electrical energy;

make in accordance with the established procedure in PTES offers on changes of amounts of the electrical energy consumed by them. At the same time the proposal on change of contractual amounts of electrical energy shall be submitted no later than 10 days before expected start date of month under report in time;

require compensation in accordance with the established procedure of the losses caused to PTES or the electrosupplying company owing to underdelivery of electrical energy or delivery of electrical energy which indicators of quality do not conform to national standards;

require return of paid amount for unused amount of electrical energy in case of electric utility service agreement cancelation;

terminate the agreement of electric utility service unilaterally according to acts of the legislation;

require compensation of the caused damage in case of unreasonable interruption in supply of electrical energy;

take a legal action or the organization, higher according to the procedure of subordination, to the official for the dispute resolution, arising in case of the conclusion and execution of agreements of electric utility service.

Consumers of electrical energy can have and other rights according to acts of the legislation.

12. Consumers of electrical energy shall:

observe the mode of consumption of electrical energy set by PTES;

make timely payment for the used electrical energy;

provide proper technical condition of the operated electroinstallations, devices and the equipment and observance of User Safety Rules for Operating Electrical Equipment, to report to PTES or the electrosupplying company about defects of electric equipment, metering devices and measuring transformers, to notify the electrosupplying company in case of identification of the fact of damage of the seals established on them;

develop and approve in accordance with the established procedure consumption rates of electrical energy on production of unit of production and the rendered service (except residential customers);

approve and provide execution of the annual organizational and technical actions for economy of electrical energy (except residential customers);

perform actions for rational use of electrical energy;

to timely carry out Uzenergoinspektion's instructions;

observe requirements of Regulations for electrical installation;

create opportunity to the employee of PTES and Uzenergoinspektion in accordance with the established procedure for free removal of instrument readings of accounting and survey of their condition, their schemes and the equipment at any time, in case of presentation of the official ID to them (except residential customers);

submit the application to PTES for necessary amount of electrical energy at least a month before the beginning of operation of the electroinstallations which are again entered within year (except residential customers);

in case of determination of need for electrical energy the forthcoming year to consider expense of electrical energy on its transfer in power networks, for production needs of engineering procedure of products (work types), on lighting, heating, ventilation of factory and office buildings, and also need of the subconsumers connected to these power networks (except residential customers);

establish devices on compensation of reactive energy for all consumers with the capacity of 50 kW permitted to use and above (except residential customers) and to ensure functioning of these devices in suitable condition;

not exceed the established consumption rates of electrical energy per unit of the made products and the rendered services;

carry out obligatory energy inspection (energy audit) and examination according to the procedure and the terms established by the legislation;

develop and provide execution of the annual organizational and technical actions for economy of electrical energy for ensuring consumption rates of electrical energy per unit of the made products and the rendered services.

Consumers of electrical energy with the attached capacity of 5 megawatts and above also shall consider and report upon the demand of PTES in PTES:

daily, monthly expenses and actual sizes of power consumption;

daily expense of reactive energy and capacity for the periods of the maximum and minimum demands of single electric utility system;

expense of active energy (capacity) each 30 minutes during passing of maximum of loadings of single electric utility system.

13. Consumers whose objects are used as the high-level power networks having no right to sign agreements with PTES on rendering services in transfer of electrical energy.

14. Consumers with the attached capacity of 250 kVA and above along with obligations, stipulated in Item 12 these rules, shall:

develop technically and economically reasonable, progressive consumption rates of electrical energy on production of unit of production (work) - general production and technological; individual and group; annual, quarter and monthly - and to review them in process of enhancement (change) of technologies of production organization and implementation of the new equipment;

establish survey meters of accounting for determination of amount of expense of electrical energy by production enterprises on production of unit of production in each manufacture workshop;

respect the approved consumption rates of electrical energy per unit of products (works, services) and to provide accomplishment of the established actions for their decrease;

constitute balances on production and consumption of electrical energy on the company in general, including the power-intensive equipment, workshops and customer groups and to carry out on their basis efficiency analysis of use of electrical energy in production processes, to reveal non-productive costs and losses of electrical energy, to develop and perform actions for their decrease and elimination;

constitute balances on production and consumption of electrical energy for year and the perspective period (proceeding from the predicted volumes of production, work types and consumption rates of electrical energy taking into account actions for their decrease and economy of electrical energy) for the purpose of determination of need for electrical energy for the perspective period and need of increase in handling capacity of power networks, enhancement of the scheme of electric utility service;

develop and perform organizational and technical actions (annual and for more long-term period) on economy of electrical energy.

Chapter 3. Rights and obligations of PTES

15. PTES have the right:

demand from the consumers of proper execution established in these rules and the agreement of electric utility service of obligations;

require compensation in accordance with the established procedure of the damage caused to them in case of non-execution without valid excuse or violation by consumers of terms of the contract of electric utility service without valid excuse;
