About approval of the Procedure for realization of the arrested assets

According to article 21-6 of the Law of Ukraine "About the National agency of Ukraine concerning identification, search and asset management, received from corruption and other crimes" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for realization of the enclosed arrested assets.

2. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

Procedure for realization of the arrested assets

1. This Procedure determines the procedure of realization of the assets accepted by ARMAGH based on the resolution of the investigative judge, court on transfer of assets of ARMAGH for their realization or with the consent of their owner.

2. In this Procedure terms are used in the following sense:

1) the administrator of electronic trading system (further - the administrator) - the subject of managing of public sector of economy responsible for ensuring functioning of electronic trading system according to the Law of Ukraine "About privatization of the state-owned and utility property";

2) the state of the location of asset - foreign state in the territory of which assets in the form of property, being located abroad, are transferred to ARMAGH for implementation of actions for management, preserving their economic cost based on the resolution of the investigative judge, court recognized and who is subject to execution in the procedure established by the legislation by competent authorities of such state or based on the consent of the owner of asset, authenticity of the signature on which is certified notarially, provided that the realization of such property is enabled in the territory of the corresponding foreign state;

3) electronic auction (biddings) - method of realization of lot on which the participant becomes the winner of electronic auction (biddings), during the auction in electronic trading system offered top price;

4) electronic auction (biddings) by method of step-by-step decrease in the starting price and the subsequent submission of price offers - asset sale method on which the starting price of lot falls step by step during the auction, with the subsequent possibility of additional submission of price offers;

5) the operator of an electronic trading platform - the legal entity having the right to use electronic platform and acting according to the agreement signed with the administrator;

6) organizer - ARMAGH which performs the organization of electronic auction (biddings) for realization of the assets which are in the territory of Ukraine;

7) the starting price - the price (excluding tax on value added) with which the electronic auction (biddings) on each lot begins.

The terms "essential participation" and "final beneficial owner" in this Procedure are used in the value given in the Law of Ukraine "About prevention and counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction".

The terms "resident" and "connected person" in this Procedure are used in the value given in the Tax code of Ukraine.
