About the technical regulation of the Eurasian Economic Union "About safety of paints and varnishes"
According to article 52 of the Agreement on the Eurasian Economic Union of May 29, 2014 and Item 29 of appendix № 1 to the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 № 98, Council of the Eurasian economic commission decided:
1. Accept the enclosed technical regulation of the Eurasian Economic Union "About safety of paints and varnishes" (TR EEU 053/2026) (further – the technical regulation).
2. Determine that:
a) the technical regulation becomes effective:
in the territories of the Republic of Armenia, the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation since January 1, 2028;
in the territory of the Kyrgyz Republic since January 1, 2032.
During the period from January 1, 2028 to January 1, 2032 the paints and varnishes made and released in the territory of the Kyrgyz Republic according to the legislation of the Kyrgyz Republic are not subject to marking by single market circulation mark of the Eurasian Economic Union;
b) the regulation of content of lead in recalculation on dry remaining balance, stipulated in Item the 12th the technical regulation, becomes effective after 60 months from the date of the introduction of the technical regulation in force, but not earlier than entry into force of the decision of Board of the Eurasian economic commission providing inclusion of the corresponding interstate standards containing rules and methods of researches (testing) and measurements, including the rules of sampling necessary for determination of content of lead in recalculation on dry remaining balance in paints and varnishes in the list of standards determined by item 4 of the Protocol on technical regulation within the Eurasian Economic Union (appendix No. 9 to the Agreement on the Eurasian Economic Union of May 29, 2014).
From the date of the introduction of the technical regulation in force and within 36 months content of lead in recalculation on dry remaining balance in the paints and varnishes specified in Item 12 of the technical regulation shall not exceed percent 0,5.
After 36 months from the date of the introduction of the technical regulation in force and before entry into force of regulation of content of lead in recalculation on dry remaining balance, stipulated in Item the 12th the technical regulation, content of lead in recalculation on dry remaining balance in paints and varnishes shall not exceed percent 0,05;
c) in case of decision making of Council of the Eurasian economic commission about the technical regulation of the Eurasian Economic Union about safety of construction materials and products it is necessary to provide in the specified decision provision regarding non-use of Item 10 of the technical regulation.
3. Ask the governments of state members of the Eurasian Economic Union:
a) together with the Eurasian economic commission to continue work on determination of the single requirements of fire and radiation safety of paints and varnishes and development of the corresponding interstate standards containing rules and methods of researches (testing) and measurements, including the rules of sampling necessary for application and execution of the specified requirements, and also techniques of researches (testing) and measurements certified (validirovanny) and approved according to the legislation of state members of the Eurasian Economic Union for the purpose of modification of the technical regulation regarding establishment of such requirements and inclusion of the corresponding interstate (regional) standards in the list of standards determined by item 4 of the Protocol on technical regulation within the Eurasian Economic Union (appendix No. 9 to the Agreement on the Eurasian Economic Union of May 29, 2014);
b) provide to the Eurasian economic commission till July 1, 2026 data on the state bodies authorized on carrying out state registration of paints and varnishes.
4. This Decision becomes effective after 30 calendar days from the date of its official publication.
