About introduction of amendments to some orders

I ORDER:

1. Approve the enclosed list of some orders to which changes are made (further – the List).

2. To provide to department of policy of management of the state assets of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and its placement on Internet resource of the Ministry of national economy of the Republic of Kazakhstan after day of its first official publication.

3. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

4. This order becomes effective after day of its first official publication.

The list of some orders to which changes are made

1. Bring in the order of the Minister of national economy of the Republic of Kazakhstan of January 16, 2015 No. 17 "About approval of Rules of transfer of state-owned property to trust management and the Standard agreement of trust management of state-owned property" (registered in the Register of state registration of regulatory legal acts for No. 10111) the following changes:

in the Rules of transfer of state-owned property to trust management approved by the specified order:

in Item 2:

15) to state the subitem in following edition:

"15) the web portal of the register – the Internet resource placed on the Internet to the address: www.e-qazyna.kz providing single point of access to the digital database on trust management agreements;";

17) and 18) to state subitems in following edition:

"17) the electronic document – digital record, confirmation of reliability to which accessory and invariance it is provided by means of the digital signature;

18) the digital signature (further – the EDS) – the digital record (set of digital data) created with use of the closed key of the digital signature and means of the digital signature, confirmatory reliability of the electronic document, its accessory and invariance of content;";

"3. The decision on transfer of object to trust management is made by the founder, data on whom join the founder in the digital database on trust management agreements within 10 (ten) working days from decision date.

Prolongation of the duration of the agreement is performed in case of proper accomplishment by the trustee of terms of the contract.

The trustee no later than 10 (ten) working days to agreement completion in writing directs to the founder the application for intention to extend the duration of the agreement with appendix of the activities report on trust management of state-owned property for the entire period of the agreement.

Prolongation of the duration of the agreement is performed by the conclusion of the supplementary agreement to the basic agreement. The supplementary agreement on prolongation of the duration of the agreement is signed for the new term which is not exceeding the term of the basic agreement.

The supplementary agreement to the agreement is signed in digital format on the web portal of the register and signed by the founder, the asset holder or governing body and the trustee with use of the EDS before expiration of the contract.";

be reworded as follows appendix 1 according to appendix 1 to this List;

in the Standard agreement of trust management of the state-owned property approved by the specified order:

Bring in the order of the Minister of national economy of the Republic of Kazakhstan of March 17, 2015 No. 211 "About approval of the standard agreement of property hiring (lease) of state-owned property" (registered in the Register of state registration of regulatory legal acts for No. 10479) the following changes:
