About funds and charity in the field of health care

For the purpose of regulation of the public relations on creation, activities and liquidation of funds, and also charity in the field of health care I decide:

1. Approve Regulations on creation, activities and liquidation of funds it (is applied).

2. Determine that charity in the field of health care are disinterested (non-paid) and voluntary activities for the organization of financing and (or) participation in financing of delivery of health care * to physical persons, acquisition of medicines, clinical nutrition, medical products (products of medical appointment, medical equipment), including outside the Republic of Belarus (further, unless otherwise specified, - medical care).

* The term "medical care" is used in the value determined in the paragraph the fourteenth part one of article 1 of the Law of the Republic of Belarus of June 18, 1993 No. 2435-XII "About health care".

3. Determine that the organization of financing of delivery of health care within charity in the field of health care is performed:

3.1. funds, single or one of the purposes of activities of which implementation of charity in the field of health care, public associations is by means of:

opening in banks, the non-bank credit and financial organizations (further - banks) charitable accounts for collection of money on delivery of health care (further, unless otherwise specified, - the charitable account);

installations and uses of boxes for collection of money on delivery of health care. Requirements to such boxes, procedure for their installation, use and extraction of money from them are established by Council of Ministers of the Republic of Belarus;

3.2. organizations by means of opening in banks of charitable accounts;

3.3. physical persons by means of opening in banks of charitable accounts:

for in view of needs in delivery of health care;

for collection of money on delivery of health care to the spouse (spouse), to close relatives (to parents, adoptive parents (adopters), children including adopted (adopted) to brothers and sisters, the grandfather, the grandma, grandsons), to the minor and (or) full age persons which are under guardianship or custody of these physical persons.

4. Persons determined in Item 3 of this Decree can perform the organization of financing of delivery of health care within charity in the field of health care also by means of personal account of the subscriber * the operator of cellular mobile telecommunication for collection of money on rendering medical the help (further - personal account of the subscriber).

The personal account of the subscriber is used only on the purpose specified in part one of this Item based on the service provision agreement of telecommunication which in addition to the essential conditions established by the legislation shall contain also details of the charitable account into which the money raised by means of use of personal account of the subscriber is subject to daily transfer. Responsibility for reliability of details of such charitable account is born by the subscriber.

Telecommunication fee which rendering is necessary in connection with use of personal account of the subscriber on the purpose specified in part one of this Item is performed at the expense of own means of persons determined in Item 3 of this Decree taking into account the case specified in part four of this Item.

Public institutions perform telecommunication fee which rendering is necessary in connection with use of personal account of the subscriber on the purpose specified in part one of this Item by extrabudgetary funds.

5. The organization of financing of delivery of health care within charity in the field of health care is not allowed:

persons which are not determined in Item 3 of this Decree;

with use of the current (settlement) bank accounts and other bank accounts, including accounts on accounting of deposits (deposits), except charitable accounts.

6. The charitable account is opened by bank based on the agreement of the charitable account.

The purpose of its opening, and in case of opening of the charitable account by physical person - also extreme amount (limit) of collection of money is specified in the statement for opening of the charitable account.

In case of the appeal of physical person with the statement on opening of the charitable account are enclosed to such application:

the medical document confirming availability of disease of person needing delivery of health care, issued according to the legislation on ministerial procedures;

copies of the documents confirming the marriage relations and (or) the relations of relationship, or the copy of the decision (the statement from it) about adoption (adoption), the copy of the decision on establishment of guardianship (guardianship) - in case, the provided in paragraph three of subitem 3.3 of Item 3 of this Decree.

The extreme amount (limit) of collection of money by physical person is determined in the agreement of the charitable account. At the same time the physical person has the right to open no more than one charitable account:

for in view of needs in delivery of health care;

for collection of money on delivery of health care to each of persons determined in paragraph three of subitem 3.3 of Item 3 of this Decree.

At the initiative of the physical person which opened the charitable account, the extreme amount (limit) of collection of money can be changed by means of the conclusion of the supplementary agreement to the agreement of the charitable account.

Banks do not bear responsibility for legitimacy of opening of the charitable account, reliability represented by person for whom the charitable account, documents is opened.
