1. 2. To provide to committee of civil aviation of the Ministry of transport of the Republic of Kazakhstan in the established legislative procedure:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of transport of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Transport of the Republic of Kazakhstan.

4. This order becomes effective after sixty calendar days after day of its first official publication.

Rules of state registration of civil aircrafts of the Republic of Kazakhstan and rights to them

Chapter 1. General provisions

1. These rules of state registration of civil aircrafts of the Republic of Kazakhstan and the rights to them (further - Rules) are developed according to requirements of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further - the Law) and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state and socially responsible services" (further - the Law on the state services), determine procedure for state registration of civil aircrafts and the rights to them and rendering the state service "Issue of Certificates on State Registration of Civil Aircrafts of the Republic of Kazakhstan", and also the document forms certifying the rights to them both order of registration and accounting of pilotless aviation systems and rendering the state service "Registration of Pilotless Aviation System".

2. The meteorological spheres pilots used only in the meteorological purposes and also pilotless uncontrollable aerostats without payload are not subject to state registration in the State register of civil aircrafts of the Republic of Kazakhstan according to these rules.

3. The civil aircraft is registered in the State register at the request of the owner or with the consent of the owner, his operator only under condition if:

1) the aircraft is not registered in other state;

2) owner or the operator of the aircraft is the physical person or legal entity of the Republic of Kazakhstan;

3) owner or the operator of the aircraft is not person included in the list of the organizations and faces tied with financing of distribution of weapons of mass destruction and (or) in the list of the organizations and faces tied with financing of terrorism and extremism according to the legislation of the Republic of Kazakhstan, except for the aircraft confiscated and (or) collected by a court decision;

4) the certificate of type or other similar document was issued or acknowledged valid authorized organization in the field of civil aviation;

5) calendar useful life of the aircrafts intended for transportation of goods (the term estimated from date of issue of the aircraft before day of registration) does not exceed twenty five years;

6) the resource of the aircraft intended for transportation of goods, estimated by quantity of cycles of flights and on hours no more than two thirds of part of the established factory resource (with official confirmation of manufacturer or design office);

7) availability of the equipment providing data transmission about condition and location of the board intended for transportation of goods by means of land and satellite channels.

The aircraft included in the State register meets airworthiness standards of the civil aircrafts of the Republic of Kazakhstan approved by the order of the acting minister on investments and development of the Republic of Kazakhstan of March 27, 2015 No. 367 (it is registered in the Register of state registration of regulatory legal acts for No. 12038) (further - airworthiness standards).

4. From the moment of entering into the State register the civil aircraft acquires national identity of the Republic of Kazakhstan.

5. The certificate on state registration of the civil aircraft is onboard the aircraft.

6. The civil aircraft entered in the State register is allowed to flights both in airspace of the Republic of Kazakhstan, and beyond its limits, in case of the valid certificate of the flight validity.

7. In these rules the following terms and determinations are used:

1) authorized organization in the field of civil aviation (further - authorized organization) - the joint-stock company with absolute participation of the state in the authorized capital performing the activities aimed at providing sustainable development of industry of civil aviation of the Republic of Kazakhstan, safety of flights and aviation safety;

2) the aircraft address - the individual combination from 24 bits appropriated to the aircraft for the purposes of ensuring communication "air - the earth", navigation and observation. It is used as synonyms and it is interchangeable with the terms "24-bit address of the aircraft" and "address in the mode S", at the same time has identical value;

4) deregistration - exception of the aircraft or withdrawal of record about registration of the aircraft of the State Register according to the Convention on International civil aviation;

5) the Certificate on aircraft exception of the State register (further - the Certificate on exception) - the document issued by authorized organization, confirming exception (deregistration) of the civil aircraft of the State register;

6) the debtor - the operator or the owner of the aircraft who issued Irrevocable power;

7) the State register of civil aircrafts of the Republic of Kazakhstan (further - the State register) - the document in which state registration of civil aircrafts of the Republic of Kazakhstan, the rights to them is made;

8) The aircraft without state registration - the aircraft to which supervision and jurisdiction of the state, and also process of establishment of such supervision does not extend;

9) irrevocable power on deregistration and export (further - irrevocable power) - power of physical person or legal entity for benefit of which the right to impose requirements of exception of the State register (deregistration) and export of the aircraft according to the Protocol on aeronautical equipment to the Convention on the international guarantees concerning mobile equipment is granted;

10) the owner (owner) - physical person or legal entity of the Republic of Kazakhstan which possesses the aircraft on the property right or other legal causes;

11) the applicant - physical person or legal entity, being the owner (owner) or the operator of the civil aircraft;

12) the operator - the physical person or legal entity which is engaged in operation of civil aircrafts or offering the services in this area;

13) pilotless aviation system - the pilotless aircraft and the related elements (including the communication channels and components managing the pilotless aircraft) which are necessary for safe and effective operation of the pilotless aircraft in airspace;

14) the pilotless aircraft - the aircraft which is operated or is intended for autonomous work and (or) for remote control without pilot onboard;

15) the register of pilotless aviation systems of civil aviation of the Republic of Kazakhstan (further - the Register of pilotless aviation systems) - the document in which accounting of pilotless aviation systems is made;

16) the Certificate on registration of pilotless aviation system (further - the Certificate on registration the BASS) - the document issued by authorized organization, confirming entering of pilotless aviation system into the Register of pilotless aviation systems;

17) the Certificate on exception of pilotless aviation system of the Register of pilotless aviation systems (further - the Certificate on exception the BASS) - the document issued by authorized organization, confirming exception of pilotless aviation system from the Register of pilotless aviation systems and the termination of its accounting;

18) the declaration of conformity - the document of single form by which execution and signing the applicant confirms individual responsibility for safe operation and compliance of pilotless aviation system to requirements of Rules of use of pilotless aviation systems in airspace of the Republic of Kazakhstan, approved by the order of the acting minister on the industry and infrastructure development of the Republic of Kazakhstan of December 31, 2020 No. 706 (it is registered in the Register of state registration of regulatory legal acts No. 22031) (further - Rules of use the BASS);

19) the registered international guarantee - the appropriate right of the creditor concerning the aircraft, record about which is included in the International register;

20) the authorized party - person for benefit of whom irrevocable power on deregistration and export (IDERA) is issued;

21) the certificate of type - the document issued by authorized organization in the field of civil aviation or the aviation authorities of foreign state - developer, performing certification of aircrafts for determination of design like the aircraft, Item of remote piloting, the engine or the air screw and confirmation of the fact that this design answers the relevant standards of the flight validity of this state;

22) the international register - the international service of registration created according to the Cape Town convention and the Aviation protocol for registration of the rights of creditors for aircrafts.

23) Single contact center - the legal entity determined by authorized body in the field of rendering the state services, performing functions of directory service on provision to uslugopoluchatel of information on questions of rendering the state and other services and also to state bodies - information on questions of rendering information and communication services;

24) the web portal of "the digital government" - the digital object representing "single window" of access to the consolidated information placed by the state bodies and other subjects participating in provision of the state services including the regulatory legal base and also to the state and other services rendered electronically.

For issue of certificates on state registration, registration of the pledge agreement of the aircraft, the supplementary agreement to it, irrevocable power on deregistration and export of the aircraft the payment according to the procedure and the size is levied, No. 177 determined by orders of the acting minister of the industry and infrastructure development of the Republic of Kazakhstan of March 24, 2023 "About approval of Rules of collection of payments in the field of civil aviation of the Republic of Kazakhstan" (it is registered in the Register of state registration of regulatory legal acts No. 32120) (further - Rules of collection of payments in the field of civil aviation) and the Minister of the industry and infrastructure development of the Republic of Kazakhstan of March 17, 2023 No. 167 "About approval of the list of paid services of authorized organization in the field of civil aviation and rates of payments in the field of civil aviation" (it is registered in the Register of state registration of regulatory legal acts No. 32089) (further - the List of paid services of authorized organization in the field of civil aviation and rates of payments in the field of civil aviation).

Issue of the certificate on state registration, registration of the pledge agreement of the aircraft, the supplementary agreement to it, irrevocable power on deregistration and export of the aircraft are performed after receipt of payment in the budget of authorized organization.

9. State registration of the civil aircraft is performed in the following procedure:

1) the stage preceding application;

2) application by the applicant

3) verification of documentation, and decision making;

4) survey of the aircraft, when applicable

5) decision making and issue (refusal in issue) Certificates on state registration.

10. The authorized body in the field of civil aviation within three working days after state registration of the order, sends information on the made changes and (or) additions to the these rules determining procedure for rendering the state service, to the operator of digital infrastructure of "the digital government", authorized organization and in Single contact center.

Chapter 2. Procedure for state registration of civil aircrafts of the Republic of Kazakhstan and rights to them

11. Before application for registration of aircrafts by the applicant studying of the requirements established in the Republic of Kazakhstan including requirements to registration process is carried out.
