I ORDER:

1. Bring in the order of the acting minister of the industry and infrastructure development of the Republic of Kazakhstan of May 5, 2020 No. 269 "About approval of Rules of rendering the state services of the mining and metallurgical industry" (it is registered in the Register of state registration of regulatory legal acts at No. 20611) the following changes:

"According to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state and socially responsible services" I ORDER:";

in the Rules of rendering the state service "Issue of the Conclusion about Opportunity (Impossibility) and Economic Feasibility (Inexpediency) of Industrial Extraction of Precious Metals from Primary Goods in the Republic of Kazakhstan" approved by the specified order:

state Item 1 in the following edition:

"1. These rules of rendering the state service "Issue of the Conclusion about Opportunity (Impossibility) and Economic Feasibility (Inexpediency) of Industrial Extraction of Precious Metals from Primary Goods in the Republic of Kazakhstan" (further - Rules) are developed according to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state and socially responsible services" (further - the Law) and determine procedure for issue of the conclusion about opportunity (impossibility) and economic feasibility (inexpediency) of industrial extraction of precious metals from primary goods in the Republic of Kazakhstan.";

state Item 3 in the following edition:

"3. For receipt of the state service physical persons and legal entities (further - uslugopoluchatel) send to the service provider by means of the web portal of "the digital government" www.egov.kz (further - the portal):

1) the statement in electronic form, certified by the digital signature (further – the EDS) uslugopoluchatel, in form, agrees appendix 2 to these rules;

2) for subjects of production of the primary goods containing precious metals – the electronic copy of the contract for the subsurface use rights. At the same time submission of the contract for the subsurface use rights if the electronic copy of such document was provided earlier, except as specified, when changes and additions were made to such document is not required;

3) other organizations having the right according to the legislation of the Republic of Kazakhstan to perform transactions with primary goods, containing precious metals – the electronic copy of the document confirming legality of ownership (acquisition) of goods, or the copy of the intermediary agreement;

4) the electronic copy of the agreement in foreign trade (contract), appendix and (or) amendment to it in the state and/or Russian languages, and in case of lack of the agreement in foreign trade (contract) – the electronic copy of other document confirming intentions of the parties. If the contract (the agreement, the agreement) in the state and/or Russian languages is absent, to the electronic copy of the contract (the agreement, the agreement) the translation fastened and certified by the applicant is applied (with indication of position and date, the sign and seal of the applicant);

5) the electronic copy of the document issued by accredited test laboratory, on content of precious metals and the accompanying extracted metals in which data on specific content of all precious metals in the primary goods containing precious metals shall be specified;

6) the electronic copy of refusal of conversion and (or) refining of goods from all subjects of production of the precious metals or confirmation of authorized body about availability of such refusal received according to the procedure, the approved authorized body.";

"4. The list of the main requirements to rendering the state service, the including names of the state service, the name of subspecies (in the presence) the state service, the name of the service provider, souslugodatel, methods of provision of the state service and its subspecies (in the presence), the term of rendering the state service and its subspecies (in the presence), form of rendering the state service and its subspecies (in the presence), result of rendering the state service and its subspecies (in the presence), the amount of the payment levied from uslugopoluchatel when rendering the state service and its subspecies (in the presence) and methods of its collection in cases, stipulated by the legislation the Republic of Kazakhstan, the working schedule of the service provider, the State corporation and subjects of information, the list of the documents and data requested at uslugopoluchatel for rendering the state service and its subspecies (in the presence) the bases for refusal in rendering the state service and its subspecies (in the presence) established by the laws of the Republic of Kazakhstan are stated according to appendix 2 to these rules in the form of the List of the main requirements to rendering the state service.

When giving the uslugopoluchatel of all necessary documents by means of the portal – in "personal account" of uslugopoluchatel displays the status about acceptance of request for rendering the state service with indication of the date of receipt of result of the state service.

Aggregate term of consideration of documents and issue of result of the state service constitutes 3 (three) working days.";

state Item 7 in the following edition:

"7. In case of representation by uslugopoluchatel of complete document package the contractor by results of check of completeness of the submitted documents and data issues result of rendering the state service - the conclusion about opportunity (impossibility) and economic feasibility (inexpediency) of industrial extraction of precious metals from primary goods in the Republic of Kazakhstan (further - the conclusion), according to appendix 4 to these rules.

In cases of detection of mistakes or inaccuracies in the statement and (or) documents submitted by uslugopoluchatel, their discrepancies to requirements for form and content, representations of incomplete document package according to Item 10 of the List, the service provider adopts the statement by means of the digital waiting list.

On the basis provided by part one of this Item the documents submitted by uslugopoluchatel (including originals) are subject to return to uslugopoluchatel without their acceptance on storage by the service provider or souslugodatel, except as specified filing of application and (or) documents by means of the web portal of "the digital government", the stationary subscriber structure, the subscriber structure of cellular communication, and also other digital objects.

At the same time to uslugopoluchatel reasonable time for elimination of the revealed shortcomings which does not join in aggregate term of rendering the corresponding state service is established, and shall not exceed it.

In case of remedial action day of the initial address of uslugopoluchatel is considered day of reception of an application and (or) documents for receipt of the state service.

The current of term of rendering the state service renews from the moment of elimination of the revealed shortcomings.

In case of not elimination of the revealed shortcomings at the scheduled time the service provider refuses reception of an application and documents.

The bases for refusal in rendering the state service established by the legislation of the Republic of Kazakhstan are stated in annex 2 to these rules.

The result of rendering the state service goes and kept in "personal account" of the uslugopoluchatel in electronic form signed by the EDS of the head of the service provider or replacement his face.";

"8. The service provider provides entering of data into digital monitoring system of rendering the state services on stage of their rendering.

When rendering the state service by means of the state digital system of permissions and notifications data on stage of rendering the state service arrive in the automatic mode in digital monitoring system of rendering the state services.";

appendix 1 to the specified Rules to be reworded as follows according to appendix 1 to this order;

appendix 2 to the specified Rules to be reworded as follows according to appendix 2 to this order;
