RESOLUTION OF BOARD OF THE NATIONAL BANK OF UKRAINE

of August 25, 2026 No. 96

About approval of Changes in some regulatory legal acts of the National Bank of Ukraine concerning supervision in the markets of non-bank financial services and the payment market

According to Articles 7, of 15, 55-1, 56 of the Law of Ukraine "About the National Bank of Ukraine", Articles 21, of 23, 46-48 Laws of Ukraine "About financial services and finance companies", articles 114-116, 119-122 of the Law of Ukraine "About insurance", Articles 37, of 43, of 44, of 46, 48 Laws of Ukraine "About credit unions", Articles 81, of 83, 84 Laws of Ukraine "About payment services", Articles 5, of 26, 28 Laws of Ukraine "About consumer crediting", Articles 32, of 34, 49 Laws "About Ministerial Procedure", for the purpose of enhancement of procedure of supervision in the markets of non-bank financial services, the payment market and reduction of regulatory legal acts of the National Bank of Ukraine in compliance with requirements of the legislation of Ukraine the board of the National Bank of Ukraine decides:

1. Approve Changes in:

1) Regulations on application of corrective actions by the National Bank of Ukraine for violation of requirements of the legislation regulating activities in the payment market, approved by the resolution of Board of the National Bank of Ukraine of September 22, 2022 No. 206 (with changes) (further - No. Provisions 206) which are applied;

2) Regulations on conducting checks of non-bank payment service providers, suppliers of limited payment services, the Board of the National Bank of Ukraine approved by the resolution of April 06, 2023 No. 47 (in edition of the resolution of Board of the National Bank of Ukraine of December 24, 2024 No. 160) (with changes) which are applied;

3) Regulations on the organization and conducting inspection checks in the markets of non-bank financial services, the Board of the National Bank of Ukraine approved by the resolution of December 20, 2023 No. 167 (with changes) which are applied;

4) Regulations on application by the National Bank of Ukraine of the adjusting measures, measures of early intervention, died influences in the field of the state regulation of activities in the markets of non-bank financial services approved by the resolution of Board of the National Bank of Ukraine of December 25, 2023 No. 183 (with changes) (further - No. Provisions 183) which are applied;

5) Regulations on application of corrective actions by the National Bank of Ukraine for violation by the collection companies of the consumer protection law of financial services approved by the resolution of Board of the National Bank of Ukraine of December 27, 2023 No. 193 (with changes) (further - No. Provisions 193) which are applied.

2. The National Bank of Ukraine no later than three working days from the date of entry into force of this resolution excludes from the State register of financial institutions of record about the set restrictions on implementation of separate transaction types by insurers, including activities for separate class / to separate classes of insurance (risks/risks within the corresponding class).

3. The administrative productions on application by the National Bank of Ukraine No. provided by the Provision 206, No. Provision 183, the Provision No. 193 of actions begun about day of entry into force of this resolution come to the end taking into account the changes approved by this resolution.

4. To department of methodology of regulation of activities of non-bank financial institutions (Sergey Savchuk) after official publication to inform participants of the market of non-bank financial services, non-bank payment service providers, suppliers of limited payment services, the collection companies information on adoption of this resolution.

5. The resolution becomes effective from the date of, its official publication following behind day.

Changes in Regulations on application of corrective actions by the National Bank of Ukraine for violation of requirements of the legislation regulating activities in the payment market

1. To add Item 2 of the Section I after the paragraph of the thirteenth with the new paragraph the fourteenth the following content:

"Term" the head of group of check" is used in this Provision in the value given in Regulations on the conducting checks of non-bank payment service providers, suppliers of limited payment services approved by the resolution of Board of the National Bank of Ukraine of April 06, 2023 No. 47 (in edition of the resolution of Board of the National Bank of Ukraine of December 24, 2024 No. 160) (with changes).".

With respect thereto the fourteenth to consider the paragraph the paragraph the fifteenth.

2. In the Section XIV:

Item 116 to state 1) in the following edition:

"116. The notification on the beginning of administrative production is drawn up in the form of the letter behind the signature:

1) authorized officer of National Bank;

2) the head of group of check if administrative production is begun based on results (materials) of check.

The notification on the beginning of administrative production shall contain the rights and obligations of the participant of administrative production, including procedure for acquaintance with materials of administrative case, and also methods of representation of the explanations and notes to them on case and the term during which the participant of administrative production has the right to give them.";

2) undressed after Item 117 to add with four new Items 117-1-117-4 of the following content:

"117-1. Registration and sending the notification on the beginning of administrative production by results of supervision of observance of requirements of the sanctions legislation is performed with observance of requirements of the Regulations on procedure for the organization and implementation of supervision in the field of the financial monitoring, currency supervision, supervision in the field of realization of special economic and other rationing measures (sanctions) approved by the resolution of Board of the National Bank of Ukraine of June 30, 2020 No. 90 (in edition of the resolution of Board of the National Bank of Ukraine of April 04, 2024 No. 37) (with changes).

117-2. The participant of administrative production no later than the next working day from the date of receipt of the notification on the beginning of the administrative production specified in Item 117-1 of the Section XIV of this provision in writing notifies National Bank about day and time of receipt of such notification (except case of delivery of the notification under the signature).

The participant of administrative production notes on the second copy the notification on the beginning of administrative production in paper form of day and time of receipt of such notification in case of delivery of the notification under the signature.

117-3. The National Bank has the right to place information on the beginning of administrative production (except information with limited access) on the page of Official Internet representative office of National Bank in case of non receipt from the participant of administrative production of confirmation about receipt by it of the notification on the beginning of administrative production in the terms and procedure established in paragraph one of Item 117-2 of the Section Hivnastoyashchego of the Provision.

117-4. Day of receipt by the participant of administrative production of the notification on the beginning of the administrative production specified in Item 117-1 of the Section XIV of this provision is day:

1) the obtaining specified by the participant of administrative production in confirmation about receipt of the notification on the beginning of administrative production from the participant of administrative production, certain in paragraph one of Item 117-2 of the Section XIV of this provision (in case of receipt of such notification by National Bank);

2) the obtaining specified in the assurance of receipt of the notification to the participant of administrative production (in case of sending the notification by mail the registered mail with the assurance of receipt);

3) receipt of the notification specified by the participant of administrative production on the second copy of the notification in paper form (in case of delivery of the notification under the signature);

4) placement of information on the beginning of administrative production on the page of Official Internet representative office of National Bank.";

Item 135 to exclude 3);

4) in Item 136:

in the first offer of the word "or other person authorized by National Bank" to exclude;

in the second offer:

"letter" shall be replaced with words the word" in the form of the letter";

"or other representative National Bank of person" to exclude words.

Changes in Regulations on conducting checks of non-bank payment service providers, suppliers of limited payment services

1. To add Item 2 of the Section I after subitem 10 with new subitem 10-1 of the following content:

"10-1) object of supervision - the payment service provider, the supplier of limited payment services regarding observance of the requirements of the legislation of Ukraine provided by part one of article 81 of the Law on payment services and prudential standard rates;".

2. In the paragraph the second Item 21 of the Section II "recommended" to exclude the word.

3. In the Section IV:

Item 33 in paragraph four the word "recommended" to exclude 1);

Paragraph two of Item 38 to state 2) in the following edition:

"Changes in the administrative act of National Bank of conducting check are brought to the attention of object of check not later than in two working days after their entering into one of the following methods:".

4. To add the Section V after Item 43 with new Item 43-1 of the following content:

"43-1. The National Bank within the powers carries out unscheduled inspection of object of check according to the appeal (order) of state body (authorized body) in cases and on the bases determined by the laws of Ukraine.".

5. In the Section VI:

The word "recommended" to exclude 1) in Item 62;

2) undressed after Item 64 to add with two new Items 64-1, 64-2 of the following content:

"64-1. The National Bank within the powers for conducting check of object of check has the right to use information, including information with limited access obtained by it from state bodies and other persons and also information obtained in the course of implementation of supervision of persons concerning whom the National Bank exercises state regulation and supervision according to the legislation of Ukraine.

64-2. The National Bank has the right to send inquiries signed by the authorized officer of National Bank to state bodies and other persons, including persons concerning whom the National Bank exercises state regulation and supervision according to the legislation of Ukraine, for the receipt of information, documents necessary for conducting check of object of check.".

6. In the Section VII:

1) in Item 66:

the paragraph one after the words "circumstances which can be the basis for adoption of the administrative act by National Bank concerning object of check are fixed" to add with words and figures ", the report on check according to Item 79-1 of the Section VII of this provision";

"about preventing" to add paragraph two after words with words and figures "/the report on check according to Item 79-1 of the Section VII of this provision";

2) in Item 67:

in paragraph one of the word "National Bank" shall be replaced with words "The head of group of check";

in paragraph six:

to add the paragraph after the word "Message" with words" about the beginning of administrative production";

words "its creation" shall be replaced with words" creation of the certificate of check";

3) undressed after Item 72 to add with four new Items 72-1-72-4 of the following content:

"72-1. Object of check in case of disagreement with the professional judgment stated in the certificate of check that concerns it within 15 working days from the date of receipt of the certificate of check has the right to submit the application for review of professional judgment, constituted in any form, to National Bank (except cases, stipulated by the legislation Ukraine) with proper reasons and documents (their copies) confirming the facts stated in the application for review of professional judgment (in the presence).

The application for review of professional judgment submitted with violation of the term established in paragraph one of Item 72-1 of the Section VII of this provision is not considered.

72-2. The committee on supervision within 15 working days from the date of receipt of the statement for review of professional judgment and documents (their copies) confirming the facts stated in the application for review of professional judgment (in the presence) makes the decision about:

1) review of professional judgment;

2) refusal in review of professional judgment.

72-3. The decision of Committee on supervision specified in subitems 1 or 2 of Item 72-2 of the Section VII of this provision is brought to the attention of the object of check which submitted the application for review of professional judgment, joins materials of check and is considered by National Bank in case of adoption of administrative acts and implementation of supervising actions concerning object of check by results of performed.

The certificate of check, the report on check in case of decision making about review of professional judgment are left without changes.

72-4. The decision on refusal shall contain the bases of adoption of such decision with proper reasons in review of professional judgment.";

In paragraph one of Item of the 78th figure "30" to replace 4) with figures and the word "35 workers";

5) undressed after Item 79 to add with five new Items 79-1-79-5 of the following content:

"79-1. The report on check in which circumstances which can be the basis for adoption of the administrative act which were not fixed in certificates of check, but were established after the additional study by National Bank stated in certificates of verification of information in case of creation of the report on check (further - circumstances which can be the basis for adoption of the administrative act are stated), goes to object of check with the cover letter which is drawn up taking into account the requirements to the notification on the beginning of administrative production determined in Item 67 of the Section VII of this provision.

79-2. Object of check no later than five working days from the date of receipt of the report on check in which circumstances which can be the basis for adoption of the administrative act are stated shall notify National Bank by means of e-mail on acquaintance with such report.

79-3. Object of check in case of availability of objections, explanations concerning circumstances which can be the basis for adoption of the administrative act has the right along with sending the notification on acquaintance with the report on check to provide reasonable written explanations and/or objections concerning such circumstances with documentary confirmation (in the presence).

79-4. The National Bank considers the explanations, objections provided by object of check according to Item 79-3 of the Section VII of this provision and informs object of check on results of such consideration.

79-5. The report on check in which circumstances which can be the basis for adoption of the administrative act are stated is considered the National Bank which is brought to the attention of object of check in case of non receipt from object of check in the time for notification established in Item 79-2 of the Section VII of this provision on acquaintance with such report.".

Changes in Regulations on the organization and conducting inspection checks in the markets of non-bank financial services

1. In the paragraph the second Item 32 of the Section II of the word "the registered mail with" shall be replaced with words "the mailing with the inventory of investment and".

2. To add the Section IV after Item 49 with new Item 49-1 of the following content:

"49-1. The National Bank within the powers carries out unscheduled inspection inspection of object of check according to the appeal (order) of state body (authorized body) in cases and on the bases determined by the laws of Ukraine.".

3. In the Section VII:

"The registered mail with" shall be replaced with words 1) in Item 107 of the word "the mailing with the inventory of investment and";

2) undressed after Item 110 to add with two new Items 110-1, 110-2 of the following content:

"110-1. The National Bank within the powers for conducting inspection check of object of check has the right to use information, including information with limited access obtained by it from public authorities, local government bodies and other persons and also information obtained in the course of implementation of supervision of persons concerning whom the National Bank exercises state regulation and supervision according to the legislation of Ukraine.

110-2. The National Bank has the right to send inquiries signed by the authorized officer of National Bank to state bodies and other persons, including persons concerning whom the National Bank exercises state regulation and supervision according to the legislation of Ukraine, for the receipt of information, documents necessary for conducting inspection check of object of check.".

4. In the Section VIII:

Paragraph one of Item 113-1 after the words "specified in Items" to add 1) with figures and the word of "126-1 Section VIII";

In paragraph one of Item 116-1 of the word "National Bank" shall be replaced with words 2)" the Head of inspection team";

Items 119-1, 119-2 to state 3) in the following edition:

"119-1. Object of check in case of disagreement with the professional judgment stated in the certificate of inspection check that concerns it within 15 working days from the date of receipt of the certificate of inspection check has the right to submit the application for review of professional judgment, constituted in any form, to National Bank (except cases, stipulated by the legislation Ukraine) with proper reasons and documents (their copies) confirming the facts stated in the application for review of professional judgment (in the presence).

The application for review of professional judgment submitted with violation of the term established in paragraph one of Item 119-1 of the Section VIII of this provision is not considered.

119-2. The committee on supervision within 15 working days from the date of receipt of the statement and documents (their copies) confirming the facts stated in the application for review of professional judgment (in the presence) makes the decision about:

1) review of professional judgment;

2) refusal in review of professional judgment.";

Item 119-3 in paragraph one the word and figures "subitems 1, 2" shall be replaced with words 4) also in figures "subitems 1 or 2";

And the word "30 calendar" to replace 5) in Item of the 125th figure with figures and the word "35 workers";

6) undressed after Item 126 to add with five new Items 126-1-126-5 of the following content:

"126-1. The report on inspection check in which circumstances which can be the basis for adoption of the administrative act which were not fixed in certificates of inspection check, but were established after the additional study by National Bank stated in certificates of inspection verification of information in case of creation of the report on inspection check (further - circumstances which can be the basis for adoption of the administrative act are stated), goes to object of check with the cover letter which is drawn up taking into account the requirements to the notification on the beginning of administrative production determined in Item 116-1 of the Section VIII of this provision.

126-2. Object of check no later than five working days from the date of receipt of the report on inspection check in which circumstances which can be the basis for adoption of the administrative act are stated shall notify National Bank by means of e-mail on acquaintance with such report.

126-3. Object of check in case of availability of objections, explanations concerning circumstances which can be the basis for adoption of the administrative act has the right along with sending the notification on acquaintance with the report on inspection check to provide reasonable written explanations and/or objections concerning such circumstances with documentary confirmation (in the presence).

126-4. The National Bank considers the explanations, objections provided by object of check according to Item 126-3 of the Section VIII of this provision and informs object of check on results of such consideration.

126-5. The report on inspection check in which circumstances which can be the basis for adoption of the administrative act are stated is considered the National Bank which is brought to the attention of object of check in case of non receipt from object of check in the time for notification established in Item 126-2 of the Section VIII of this provision on acquaintance with such report.".

5. In Items 141, "the registered mail with" shall be replaced with words 143 Sections IX of the word "the mailing with the inventory of investment and".

Changes in Regulations on application by the National Bank of Ukraine of the adjusting measures, measures of early intervention, died influences in the field of state regulation of activities in the markets of non-bank financial services

1. To add Item 2 of Chapter 1 of the Section I after the paragraph of the nineteenth with the new paragraph the twentieth the following content:

"Term" the head of inspection team" is used in this Provision in the value given in Regulations on the organization and the conducting inspection checks in the markets of non-bank financial services approved by the resolution of Board of the National Bank of Ukraine of December 20, 2023 No. 167 (with changes).".

With respect thereto the twentieth to consider the paragraph the paragraph the twenty first.

2. To state Item 8-3 of Chapter 3 of the Section II in the following edition:

"8-3. Calculation of the size of the penalty determined in minimum wages is performed taking into account the size of minimum wage as of January 01 of calendar year in which the decision on imposing of penalty (penalty) is made.".

3. In the Section III:

1) in Chapter 15:

exclude Item 78;

in paragraph one of Item 85 of the word and figures of "the statement determined in Item 84 of Chapter 15 of the Section III of this provision" to exclude;

exclude Item 87;

2) in paragraph one of Item 95 of Chapter 16 the word of "day" shall be replaced with words "expiration".

4. In the Section IV:

In paragraph one of Item 177 of Chapter 26 of the word and figures "by results of consideration by National Bank of the submitted documents determined in Item 176 of Chapter 26 of the Section IV of this provision" to exclude 1);

Items 194, of the 211th Chapter 29 to state 2) in the following edition:

"194. The National Bank no later than the next working day from the date of decision making about suspension or the termination of separate types of the financial services provided by credit union enters the corresponding record about suspension or the termination of separate types of the financial services provided by credit union in the register.";

"211. The National Bank enters in the register the corresponding record no later than the next working day from the date of:

1) the expiration of the National Bank of term specified in the decision for which provision of financial services was stopped;

2) decision making about allowance of the application of credit union about early cancellation of stop of financial services (all or separate financial services which are stopped) according to Item 204 of Chapter 29 of the Section IV of this provision;

3) decision making about renewal of the right of credit union to render financial services which provision was stopped according to Item 209 of Chapter 29 of the Section IV of this provision.".

5. In the Section V:

1) in Item 260 of Chapter 36:

the subitem 7 after the word and figures "Article 28" to add with words, letter and figures" and the subitem" in "Item 7 parts four of Article 48";

to add Item after subitem 7 with new subitem 7-1 of the following content:

"7-1) imposing of penalties on finance company for violation of requirements of Article 29 of the Financial services act and finance companies concerning combination of activities for provision to consumers of the financial services specified in Items 1, 2 both 4 parts one of Article 29 of the Financial services act and finance companies with activities for provision of services of factoring in the amount of no more than 500 minimum wages and at least five minimum wages as of January 01 of calendar year in which the decision on imposing of penalty is made;";

Items 288, of 301 Chapters 41 to state 2) in the following edition:

"288. The National Bank no later than the next working day after entry into force of the decision on suspension or the termination of separate types of the financial services provided by finance company, pawnshop enters in the register the corresponding record about suspension or the termination of separate types of the financial services provided by finance company, pawnshop.";

"301. The National Bank enters in the register the corresponding record no later than the next working day, from the date of:

1) the expiration of the National Bank of term specified in the decision for which provision of financial services was stopped;

2) decision making about allowance of the application of finance company, pawnshop about early cancellation of stop of financial services (all or separate financial services which are stopped) according to Item 298 of Chapter 41 of the Section V of this provision.";

3) in Chapter 43:

add Item 308 with the new subitem of the following content:

"3) finance company - in case of violation of requirements of Article 29 of the Financial services act and finance companies on combination of activities for provision to consumers of the financial services specified in Items 1, 2 both 4 parts one of Article 29 of the Financial services act and finance companies with activities for factoring provision of services.";

add Item 309 with the new subitem of the following content:

"9) from five minimum wages, but no more than 500 minimum wages in monthly size as of January 01 of calendar year in which the decision on imposing of penalty is made, - for violation of requirements of Article 29 of the Financial services act by finance company and finance companies on combination of activities for provision to consumers of the financial services specified in Items 1, 2 both 4 parts one of Article 29 of the Financial services act and finance companies with activities for factoring provision of services.";

Paragraph one of Item 362 of Chapter 47 to state 4) in the following edition:

"362. The National Bank no later than 30 calendar days of receipt date of the statement determined in Item 360 of Chapter 47 of the Section V of this provision, and the documents determined in Item 361 of Chapter 47 of the Section V of this provision makes the decision about:";

Item 364 of Chapter 48 to add 5) with the new subitem of the following content:

"8) implementation by finance company, pawnshop of risk activities which threatens interests of clients or creditors of finance company, pawnshop.";

6) in Chapter 49:

state Item 372 in the following edition:

"372. The National Bank no later than the next working day from the date of the expiration specified in the requirement about the termination of activities of separate division of finance company, pawnshop excludes data on such separate division from the register.

The National Bank no later than the next working day from the date of decision making on temporary ban or requirements about the termination of activities of separate division of finance company, pawnshop notifies on such decision finance company, pawnshop according to the procedure and the terms determined in the subitem 2 of Item 481 of Chapter 65 of the Section XI of this provision.";

exclude Item 382.

6. 391, of the 398th Chapter 51 of the Section VI to exclude Items.

7. To exclude Items 488-2-488-4, 492-1 of Chapter 66 of the Section XI.

8. In the Section XII:

1) in Chapter 68:

in paragraph one of Item 501 of the word "paragraphs the first - third" to replace with the word and figures "subitems 1-3";

to add Chapter after Item 504 with four new Items 504-1-504-4 of the following content:

"504-1. The participant of administrative production notes on the second copy the notification on the beginning of administrative production in paper form of day and time of receipt of such notification in case of delivery of the notification under the signature.

504-3. The National Bank has the right to place information on the beginning of administrative production (except information with limited access) on the page of Official Internet representative office of National Bank in case of non receipt from the participant of administrative production of confirmation about receipt by it of the notification on the beginning of administrative production in the terms and procedure determined in paragraph one of Item 504-2 of Chapter 68 of the Section XII of this provision.

504-4. Day of receipt by the participant of administrative production of the notification on the beginning of the administrative production specified in Item 504-1 of Chapter 68 of the Section XII of this provision is day:

1) the obtaining specified by the participant of administrative production in confirmation about receipt of the notification on the beginning of administrative production, certain in paragraph one of Item 504-2 of Chapter 68 of the Section XII of this provision (in case of receipt of such notification by National Bank);

2) the obtaining specified in the assurance of receipt of the notification to the participant of administrative production (in case of sending the notification by mail the registered mail with the assurance of receipt);

3) receipt of the notification specified by the participant of administrative production on the second copy of the notification in paper form (in case of delivery of the notification under the signature);

4) placement of information on the beginning of administrative production on the page of Official Internet representative office of National Bank.";

2) in Chapter 71:

state Item 528 in the following edition:

"528. The notification on the beginning of administrative production is drawn up in the form of the letter behind the signature:

1) authorized officer of National Bank;

2) the head of inspection team if administrative production is begun based on results (materials) of inspection check.";

in Item 529:

in the first offer of the word "or other person authorized by National Bank" to exclude;

in the second offer:

Changes in Regulations on application of corrective actions by the National Bank of Ukraine for violation of the consumer protection law of financial services by the collection companies

1. To add Item 2 of the Section I after the paragraph of the sixth with the new paragraph the seventh the following content:

"The term "head of inspection team" are used in this Provision in the value given in Regulations on the organization and the conducting inspection checks in the markets of non-bank financial services approved by the resolution of Board of the National Bank of Ukraine of December 20, 2023 No. 167 (with changes).".

With respect thereto to consider paragraphs of the seventh, eighth respectively paragraphs the eighth, ninth.

2. In the Section III:

Item 14-2 to exclude 1);

Item 15 to add 2) with the words "and decision making in essence".

3. In the Section VIII:

Paragraph two of Item 51 to replace 1) with four new paragraphs the second or fifth the following content:

"The message on the beginning of administrative production is drawn up in the form of the letter behind the signature:

1) authorized officer of National Bank;
