About modification of some regulatory legal acts of the National Bank of Ukraine concerning supervision

According to Articles 7, 15, 44, 55, 56 Laws of Ukraine "About the National Bank of Ukraine", to Articles 63, 67 Laws of Ukraine "About banks and banking activity", to Articles 3, 4, 18 Laws of Ukraine "About prevention and counteraction of legalization (washing) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction", article 11 of the Law of Ukraine "About currency and currency transactions", to Articles 1, of 4, 5 Laws of Ukraine "About sanctions", article 21 of the Law of Ukraine "About financial services and finance companies", the Presidential decree of Ukraine of February 24, 2022 No. 64/2022 "About introduction of warlike situation in Ukraine", No. 2102-IX approved by the Law of Ukraine of February 24, 2022 "About approval of the Presidential decree of Ukraine "About introduction of warlike situation in Ukraine"" for the purpose of increase in efficiency of implementation of supervision by the National Bank of Ukraine in the field of financial monitoring, currency supervision, supervision in the field of realization of special economic and other rationing measures (sanctions), and also the Board of the National Bank of Ukraine decides reduction of regulatory legal acts of the National Bank of Ukraine in compliance with the laws of Ukraine:

1. Approve Changes in:

1) Regulations on procedure for the organization and implementation of supervision in the field of the financial monitoring, currency supervision, supervision in the field of realization of special economic and other rationing measures (sanctions) approved by the resolution of Board of the National Bank of Ukraine of June 30, 2020 No. 90 (in edition of the resolution of Board of the National Bank of Ukraine of April 04, 2024 No. 37) (with changes) (further - No. Provisions 90) which are applied;

2) Regulations on application of corrective actions by the National Bank of Ukraine to organizations for violation of the law concerning the financial monitoring approved by the resolution of Board of the National Bank of Ukraine of July 28, 2020 No. 106 (with changes) which are applied.

2. Bring in the resolution of Board of the National Bank of Ukraine of July 29, 2022 No. 165 "About features of regulation and supervision of implementation of activities for trade in currency values in cash form during action of warlike situation and introduction of amendments to the resolution of Board of the National Bank of Ukraine of March 06, 2022 No. 39" (with changes) the following changes:

Items 7-28 to exclude 1);

Paragraph one of Item 30 after the word "unplanned" to add 2) with the word of "exit".

3. Approve Changes in Regulations on procedure for the organization of accomplishment of separate requirements of the legislation in the field of financial monitoring, currency supervision, supervision in the field of realization of special economic and other rationing measures (sanctions) during action of the warlike situation approved by the resolution of Board of the National Bank of Ukraine of December 20, 2024 No. 153, which are applied.

4. The subjects specified in subitems 1-6 of Item 1 of the Section I of the Provision No. 90, shall provide setup and automation of forming of standard forms of the answers given in appendices 1, 2 to No. Provision 90, taking into account the changes made by this resolution no later than six calendar months since the month following after month in which this resolution became effective.

5. To department of financial monitoring (Anna Lipskaya) after official publication to inform the Subjects specified in subitems 1-6 of Item 1 of the Section I of the Provision No. 90, information on adoption of this resolution.

6. To impose control over the implementation of this resolution on the vice-chairman of the National Bank of Ukraine Dmitry Oleynik.

7. The resolution becomes effective from the date of, its official publication following behind day.

Item 3 of this resolution is effective during the period of action of the Presidential decree of Ukraine of February 24, 2022 with No. 64/2022 "About introduction of warlike situation in Ukraine".

Changes in Regulations on procedure for the organization and implementation of supervision in the field of financial monitoring, currency supervision, supervision in the field of realization of special economic and other rationing measures (sanctions)

1. In the Section I:

1) in Item 2:

to add the subitem 8 after the word "signatures" with words "/the advanced digital signature with the qualified certificate";

state subitem 18 in the following edition:

"18) structural division of bank/organization - branch, other isolated structural division of bank/organization, not separated structural division of bank/organization, exchange bureau of foreign currency of bank/organization, cash desk of bank/organization, object of mail service of the operator of mail service;";

2) undressed after Item 2 to add with new Item 2-1 of the following content:

"2-1. Frequency of conducting exit check and/or permanent supervision of bank/organization is determined taking into account risk level of use of bank/organization for legalization (washing) of income gained in the criminal way, financings of terrorism and financing of distribution of weapons of mass destruction and identification of risks in the field of observance of requirements of the foreign and sanctions exchange legislation by bank/organization which assessment is performed by National Bank (further - risks assessment).
