About modification and amendments in some orders of the Minister of Energy of the Republic of Kazakhstan

I ORDER:

1. Approve the enclosed list of some orders of the Minister of Energy of the Republic of Kazakhstan to which changes and additions are made.

2. To provide to development department of power industry of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan after its official publication;

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

List of some orders of the Department of Energy of the Republic of Kazakhstan

1. Bring in the order of the Minister of Energy of the Republic of Kazakhstan of February 27, 2015 No. 147 "About approval of Rules of limiting approval of rate for electrical energy and limiting rate for service in maintenance of readiness of electric power" (it is registered in the Register of state registration of regulatory legal acts at No. 10627) the following changes and amendments:

in Rules of limiting approval of rate for electrical energy and limiting rate for service in maintenance of readiness of electric power:

the power making organizations which part heating power plants are;

the power making organizations which part are the power making organization developing electrical energy with sunlight energy use;

the power making organizations which part are the power making organization developing electrical energy with wind energy use;

the power making organizations which part are the power making organization developing electrical energy with use of geothermal power (heat of soil, underground waters, the rivers, reservoirs);

the power making organizations which part are the power making organization developing electrical energy with use of anthropogenous sources of primary energy resources (the consumer wastes, biomass, biogas and other fuel from consumer wastes used for production of electrical and (or) heat energy);";

"8-1. The production costs of electrical energy considered in case of limiting forming of rates for electrical energy include the following:

material costs (fuel, fuel transportation, water for technological needs, fuels and lubricants, auxiliary materials);

expenses on compensation of production personnel;

social tax, social assignments;

fixed asset depreciation and intangible assets, the installations with the maneuverable mode of generation realized within biddings except for generating;

repairs (the routine maintenance and overhaul repairs which is not leading to value addition of fixed assets);

payment for issues to the environment;

payment for use of water resources;

taxes (land, transport, property, mining and other obligatory payments);

services in technical scheduling;

services in rendering balancing of production consumption of electrical energy;

services of third parties of production nature.

Join in expenses of the period:

compensation of administrative personnel;

expenses on obligatory types of insurance, taxes, charges and payments;

fixed asset depreciation and intangible assets, the installations with the maneuverable mode of generation realized within biddings except for generating;

traveling expenses;

services of third parties (auditor, services of bank, communication services);

expenses on social payments and financial support according to the collective agreement between the employer and employees, except for expense recovery for services in maintenance of physical shape and sports services (the gym, the pool, etc.);

renumeration expenses for the borrowed funds (received for replenishment of current assets in national currency within the amount calculated by no more 2,5 of the multiple base rate established by National Bank of the Republic of Kazakhstan).

To the power making organizations according to which investment projects cost source, in addition to rate limiting investment component, were considerable additional external financing (the credits, loans), and also the credits (loans), other money received for the purposes of refinancing and repayment of principal debt of earlier attracted obligations, the Techniques taken about year of enforcement of paragraph 1 of Chapter 2 at the initiative of the power making organization join in expenses of the period:

"11. According to Item 3 of these rules, in need of limiting adjustment of rate for electrical energy the next years which are power making the organizations till September 1 address to authorized body through information system of authorized body and provide information on the predicted increase in the production costs of electrical energy provided by parts one and the second Item 8-1 of these rules with appendix of supporting documents, the financial reporting for prior year, and also calculations taking into account the predicted rate of inflation provided by mid-term plans of social and economic development of the Republic of Kazakhstan.

In need of limiting adjustment of rate for electrical energy the next years, in case of change of the profit margin considered in case of limiting approval of rates for electrical energy, the power making organizations till September 1 represent to authorized body through information system of authorized body on limiting adjustment of rate for electrical energy with appendix of calculations according to the Technique of determination of the profit margin considered in case of limiting approval of rates for electrical energy.

The rates for electrical energy and limiting rates for the balancing electric power corrected by limiting authorized body become effective since January 1 the year following after year in which limiting adjustment of rates for electrical energy, except for Item 11-1 of these rules, and also except for years of enforcement of paragraph 1 of Chapter 2 of the Technique of determination of the profit margin considered in case of limiting approval of rates for electrical energy was performed.

In case of the actual increase in production costs of electrical energy in the current year the power making organizations no more once represent to authorized body through information system of authorized body information on increase in production costs of electrical energy with appendix of supporting documents in two months prior to expected date of input of the changed limiting rates for electrical energy.

Enforcement of the changed limiting rates for electrical energy is performed from the first following after month of their approval.

In case of approval and limiting adjustment of rates for electrical energy by the power making organizations are provided the tax declaration for the corresponding period.

In the absence of supporting documents, the authorized body refuses limiting adjustment of rates for electrical energy, with the notification of the power making organization.";

"11-3. The power making organizations annually no later than March 31 submit in authorized body reports on production costs and realization of electrical energy, on production volumes and realization of electrical energy for prior calendar year with use of information system of authorized body.".
