About establishment of the sizes of annual effective rate of remuneration under the agreement of leasing and other payments

According to article 24-5 of the Law of the Republic of Kazakhstan "About financial leasing" I ORDER:

1. Establish:

1) the sizes of annual effective rate of remuneration under the agreement of leasing:

no more than 36 (thirty six) annual interest rates - under the agreement of leasing, leasing subject cost under which does not exceed 20 000 000 (twenty million) tenges inclusive;

no more than 46 (forty six) annual interest rates - under the agreement of leasing, leasing subject cost under which exceeds 20 000 000 (twenty million) tenges.

no more than 35 (thirty five) annual interest rates - under the agreement of leasing on which the bank acts as the lessor;

2) the amount of other payments under the agreement of leasing according to appendix to this order.

2. To provide to committee of the industry of the Industry ministry and construction of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) within five calendar days after signing of this order the direction it in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" the Ministries of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Industry ministry and construction of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Industry and construction of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

The amount of other payments under the agreement of financial leasing

1. The amount of payments according to the legislation of the Republic of Kazakhstan:

the state fees, charges and other obligatory payments provided by the Tax code of the Republic of Kazakhstan;

the penalties imposed according to the Code of the Republic of Kazakhstan "About administrative offenses";

insurance premium on compulsory insurance of civil responsibility of owners of vehicles, according to the Law of the Republic of Kazakhstan "About compulsory insurance of civil responsibility of owners of vehicles";

insurance premium on voluntary insurance of subject of leasing, the franchize, provided by the insurance contract, according to the Civil code of the Republic of Kazakhstan and the Law of the Republic of Kazakhstan "About insurance activity";

payment for use of paid highways, according to the Law of the Republic of Kazakhstan "About automobile roads";

payment for use of paid parkings, according to acts of local executive bodies of the capital, areas and cities of republican value;

tax amounts on value added, the corporate income tax, penalty fee, penalties and other obligatory payments in the budget which are additionally accrued and (or) collected from the Lessor owing to non-compliance by the Leasing recipient with conditions, stipulated in Article 213 Tax codes of the Republic of Kazakhstan.

2. The amount of payments provided by the agreement of financial leasing:

the consideration of the application commission about provision of financial leasing;

initial contribution (advance payment) for leasing subject;

the expenses connected with content of subject of leasing in serviceable technical condition and proper appearance in accordance with the terms of the agreement of financial leasing;

expenses on elimination of the damages, repair and recovery of subject of leasing which arose owing to actions (failure to act) of the Leasing recipient and are not connected with its ordinary wear and tear;

expenses on installation, servicing, repair, replacement and dismantle of security aids, telematic devices, monitoring systems and anticreeping complexes;

the expenses connected with demontazhy the additional equipment installed by the Leasing recipient and reduction of subject of leasing in the condition provided by the agreement of financial leasing taking into account its ordinary wear and tear;

expenses on search, withdrawal, evacuation, transportation, storage, diagnostics, technical expertize, leasing subject assessment, and also on fee of the third parties involved for accomplishment of the specified works;

expenses on fee of the private legal executive, according to the Law of the Republic of Kazakhstan "About enforcement proceeding and the status of legal executives";

court costs, according to the Code of civil procedure of the Republic of Kazakhstan;

expenses on making of notarial actions, according to the Law of the Republic of Kazakhstan "About notariate";

expenses on post and courier services, according to the Law of the Republic of Kazakhstan "About mail";

penalty for non-execution and (or) improper execution of agreement obligations of financial leasing.
