Chapter 1. General provisions

Article 1. Subject and purposes of this Federal Law

This Federal Law for the purpose of creation of safe and favorable conditions for accommodation of citizens, improvement of quality of reforming of housing and communal services, forming of effective controling mechanisms housing stock, implementations of resource-saving technologies establishes legal and organizational basis of provision of financial support to subjects of the Russian Federation and municipalities on carrying out capital repairs of apartment houses, resettlement of citizens from emergency housing stock, upgrade of systems of utility infrastructure.

Article 2. The basic concepts used in this Federal Law

For the purposes of this Federal Law the following basic concepts are used:

1) capital repairs of the apartment house - carrying out and (or) rendering the works provided by this Federal Law and (or) services in elimination of defects of worn-out structural elements of common property of owners of rooms in the apartment house (further - common property in the apartment house), including on their recovery or replacement, for the purpose of improvement of operational characteristics of common property in the apartment house;

2) emergency housing stock - set of premises in apartment houses which are acknowledged in accordance with the established procedure till January 1, 2017 or in relation to provisions of Chapter 6.5 of this Federal Law after January 1, 2017 emergency and subject to demolition or reconstruction in connection with physical wear in the course of their operation;

3) resettlement of citizens from emergency housing stock - decision making and holding actions according to Articles 32, 86, parts 2 and 3 of article 88 of the Housing code of the Russian Federation;

4) provision of financial support by fund - provision by the state corporation - Fund of assistance to housing and communal services reforming (further - Fund) or the public company "Fund of Development of the Territories" (from the date of entering into the Unified State Register of Legal Entities of record about the termination of activities of the specified state corporation in connection with its accession to the public company "Fund of Development of the Territories" with simultaneous transformation of the specified state corporation according to the Federal Law) target means to budgets of subjects of the Russian Federation on irretrievable and non-paid basis on carrying out capital repairs of apartment houses, resettlement of citizens from emergency housing stock, upgrade of systems of utility infrastructure, and also in cases of early completion of regional address programs for resettlement of citizens from emergency housing stock, including such programs taking into account need of development of low-rise housing construction, on the conditions provided by this Federal Law and regulatory legal acts of the Government of the Russian Federation.

Chapter 5. Conditions of provision of financial support by fund

Article 14. The list of conditions of provision of financial support by fund

1. The fund provides financial support at the expense of the means under condition:

9. 8) the availability of regulatory legal acts of subjects of the Russian Federation or municipal legal acts providing realization in the territories of the municipalities applying for provision of financial support by the fund, actions directed to informing the population on the measures accepted by public authorities and local government bodies in the field of housing and communal services and concerning development of public control in this sphere - in case of application for provision of financial support by fund (further also - the request) since January 1, 2013;

9. 9) ceased to be valid according to the Federal Law of the Russian Federation of 27.12.2019 No. 473-FZ

9. 10) availability of the obligation of the subject of the Russian Federation to provide resettlement of citizens from all emergency housing stock located in the territory of appropriate subject of the Russian Federation till September 1, 2025 - in case of application for provision of financial support by fund on resettlement of citizens from emergency housing stock from January 1, 2019 to July 1, 2025;

11) availability of the regional address program for resettlement of citizens from emergency housing stock approved according to article 16 of this Federal Law - in case of application for provision of financial support by fund on resettlement of citizens from emergency housing stock;

11. 1) availability of the regional program for upgrade of system of the utility infrastructure approved according to article 16.1 of this Federal Law - in case of application for provision of financial support by fund on implementation of the regional program for upgrade of system of utility infrastructure;

12) ensuring allocation according to article 18 of this Federal Law of budgets of subjects of the Russian Federation, means of budgets of the municipalities applying for provision of financial support by fund, and (or) extrabudgetary funds on participation financing of the short-term plans of implementation of regional programs of capital repairs of common property approved by public authorities of the subject of the Russian Federation in the apartment houses accepted according to requirements of the housing legislation (further respectively - short-term plans of implementation of regional programs of capital repairs, regional programs of capital repairs), and also regional programs for upgrade of system of utility infrastructure;

13) availability of the obligation of the subject of the Russian Federation to provide failure to provide and non-use of the parcels of land on which apartment houses, total area of emergency housing stock in which was considered when calculating increase in the limit of provision of financial support set for the subject of the Russian Federation at resettlement of citizens from emergency housing stock, for the purpose of, objects of public service, social servicing, health care, education and education, public management, arrangement of places, other than the purposes of placement, for sports activities, physical culture, foot walks, placement of parks, gardens and squares, construction of apartment houses, and also in settlements which population does not exceed 30 thousand people, for the purpose of, were located, other than the purposes of individual housing construction in cases of provision of the parcels of land to citizens according to subitems 6 and 7 of Article 39.5 and subitems 6 and 7 of Item 2 of Article 39.10 of the Land code of the Russian Federation. This condition does not extend to the parcels of land on which the specified apartment houses were located if resettlement of citizens from such apartment houses was performed within implementation of the decision on complex development of the territory of the housing estate, and the parcels of land under the apartment houses settled with participation of fund, the territories of the housing estate included in the decision on complex development.

Features of provision of financial support by the fund created at the expense of additional property contribution of the Russian Federation which goes for increase in limits of provision of financial support by fund can be established by the regulatory legal act of the Government of the Russian Federation adopted according to the Federal Law on the federal budget for the corresponding year.
