For the purpose of ensuring uniformity of practice of consideration by economic courts of the cases connected with the state secrets, the Plenum of Supreme Economic Court of the Republic of Belarus, being guided by articles 14-16 of the Law of the Republic of Belarus of December 9, 1998 "About economic courts in the Republic of Belarus" (Vedamastsi Natsyyanalnaga to descent of the Republic of Belarus, 1999, No. 2, the Art. 32),
DECIDES:
1. Draw the attention of economic courts of the Republic of Belarus (further - economic courts) that the legislation of the Republic of Belarus on the state secrets is based on the Constitution of the Republic of Belarus and consists of the Law of the Republic of Belarus of November 29, 1994 "About the state secrets" (Sheets of the Supreme Council of the Republic of Belarus, 1995, No. 3, Art. 5; The National register of legal acts of the Republic of Belarus, 2003, No. 8, 2/921) (further - the Law) which determines the legal basis of reference of data to the state secrets, their classifications, declassification and protection, and also governs the relations arising in case of the address with the state secrets for the purpose of ensuring national security of the Republic of Belarus, other acts of the legislation and international treaties of the Republic of Belarus in the field of protection of the state secrets.
According to part one of article 1 of the Law the state secrets are the data protected by the state for the purpose of prevention of their unauthorized distribution and creation of threat of homeland security of the Republic of Belarus and also to constitutional rights and freedoms of citizens.
