For the purpose of ensuring uniformity of practice of economic courts when implementing fixing of judicial session technical means the Plenum of Supreme Economic Court of the Republic of Belarus, being guided by articles 14-16 of the Law of the Republic of Belarus of December 9, 1998 "About economic courts in the Republic of Belarus" (Vedamasts? DECIDES:

1. Draw the attention of economic courts that according to part ten of Article 189 of the Economic Procedure Code of the Republic of Belarus (further - HPK) carrying out the stenograph, and also zvuko-or videos of judicial session is the right of economic court and can be performed taking into account complexity of case, the list of persons participating in case and (or) other circumstances at the discretion of economic court.

The question of carrying out the stenograph, zvuko-or videos of judicial session by economic court of the first instance is, as a rule, allowed in preparatory judicial session about what it is specified in determination about purpose of case to legal proceedings. The matter is, as a rule, resolved by economic court of appellate instance in case of adoption of the petition for appeal to production about what it is specified in the corresponding determination.

Zvuko-or the video of judicial session (further - fixing of judicial session by technical means) represents complete fixing of judicial session by means of hardware and software, devices and the corresponding instructions which provide proper fixing, storage, copying (duplication) and use of information which displays the course of judicial session.
