About the digital signature
This Law governs the public relations in the field of creation and application of the digital signature in the course of forming and use of documents electronically of display by means of the automated information and telecommunication systems and programmatically - technical means.
Provisions of this Law extend to the electronic documents identified by means of the digital signature of public authorities of the Republic of Tajikistan (except documents on counterintelligence, intelligence and operational search activities, use of cryptographic and operational measures of protection of the state secret), and also physical persons and legal entities of the Republic of Tajikistan, when making civil transactions and in others stipulated by the legislation cases of the Republic of Tajikistan.
The purpose of this Law is providing legal conditions of use of the digital signature in electronic documents in case of which observance the digital signature in the electronic document is recognized to the equivalent sign manual the paper document.
Operation of this Law does not extend to the relations arising when using other analogs of the sign manual.
In this Law the following concepts are used:
- the electronic document - the document in which information is provided in electronic digital form;
- the machine carrier - the magnetic disk, magnetic tape, laser disk and other material carriers used for record and storage of information by means of electronic computer facilities;
