1. Approve the enclosed Federal aviation rules "General Rules of Airborne Transportations of Passengers, Baggage, Loads and Requirement to Servicing of Passengers, Consignors, Consignees".

2. Not apply in the territory of the Russian Federation the order of the Ministry of civil aviation of January 16, 1985 No. 19 "About approval and enforcement. Rules of transportation of passengers, baggage and loads on air-lines of USSR" and the order of the Minister of civil aviation of January 03, 1986 No. 1/I "About approval and enforcement of Rules of the international airborne transportations of passengers, baggage and loads".

Federal aviation rules "General Rules of Airborne Transportations of Passengers, Baggage, Loads and Requirement to Servicing of Passengers, Consignors, Consignees"

I. General provisions

1. The federal aviation rules "General Rules of Airborne Transportations of Passengers, Baggage, Loads and Requirement to Servicing of Passengers, Consignors, Consignees" (further - Rules) are developed according to the Convention for standardization of some rules concerning the international airborne transportations * (1) (Warsaw, on October 12, 1929), the Convention, additional to the Warsaw convention, for standardization of some rules concerning the international airborne transportations performed by person which is not contract carrier (Guadalajara, of September 18, 1961) * (2), and articles 102 and 106 of the Federal Law of March 19, 1997 N 60-FZ "The air code of the Russian Federation" * (3) (further - the Air code of the Russian Federation).

2. Rules are applied when implementing domestic and international airborne transportations (further - transportations) passengers, baggage, loads by scheduled flights of movement of aircrafts and additional flights (further - regular flights) and flights under the agreement of chartering of the aircraft (air charter) (daleecharterny flights).

3. In case of accomplishment of international carriages these rules are applied in the part which is not contradicting international agreements of the Russian Federation about air traffic.

4. Carriers have the right to establish the rules of airborne transportations (further - rules of carrier). These rules shall not contradict general rules of airborne transportation and worsen the service level of passengers, consignors, consignees. * (4) * (3)

Rules of carrier can be changed them without notice passengers, consignors and consignees provided that changes are not applied to the passenger, the consignor or the consignee after the conclusion of the agreement of airborne transportation of the passenger, the agreement of airborne transportation of load.

5. The passenger, the consignor, the consignee shall observe the legislation of the Russian Federation, the international agreements of the Russian Federation and the legislation of the country, on the territory, from the territory or through the territory of which is transported passengers, baggage and loads, the concerning transportations of passengers, baggage and loads, fulfillment of requirements on safety of flights, aviation safety and requirements connected with boundary, customs, sanitary and quarantine, veterinary, quarantine phytosanitary control types.

6. The carrier will organize, provides and carries out transportation of passengers, baggage, load by regular flights. The carrier has the right to give obligations or their part under the agreement of airborne transportation to person performing on behalf of carrier booking, sale and registration of transportations on carriage documents (further - the authorized agent), to person rendering services in servicing in zone and buildings of air terminal complex of the decreasing and arriving passengers (further - the servicing organization) or to other person, including other carrier, being responsible for their actions (failure to act) before the passenger, the consignor and the consignee and agreement performance of airborne transportation of the passenger, the agreement of airborne transportation of load.

The carrier carries out transportation of passengers, baggage, load by charter flights according to the agreement of chartering of the aircraft (air charter).

7. Transportation of passengers, baggage, loads by regular flights is performed in the terms and procedure provided by the agreement of airborne transportation of the passenger, the agreement of airborne transportation of load.

Terms of the contract of airborne transportation of the passenger, the agreement of airborne transportation of load to contain in the Air code of the Russian Federation, rules of carrier, conditions of application of rate and the carriage document.

7.1. The period of landing of the passenger aboard the aircraft begins with the moment of entrance of the passenger on ladder / telescopic ladder / other means used for landing aboard the aircraft and (or) disembarkation from aircraft board for the purpose of landing aboard the aircraft and terminates in the moment of pass of the passenger aboard the aircraft.

II. Booking of transportation of the passenger, baggage, load

8. Fixing on the aircraft of passenger seat and transportation reservoir for transportation of the passenger, baggage, load on certain flight and date (further - booking) is the compulsory provision of transportation by air transport of the passenger, baggage, load.

9. When booking the automated reservations systems are, as a rule, used.

10. Booking shall be reflected in reservations system of carrier. Information on the made booking shall be provided by carrier or the authorized agent to the passenger, the consignor.

11. Booking of passenger seat and transportation reservoir for the passenger assumes transportation of the passenger and his baggage in date, flight and along route on which booking was made.

Booking of transportation reservoir for load assumes cargo hauling in date, flight and along route on which booking was made if other is not provided by the agreement of airborne transportation of load.

12. Booking is made in the terms and procedure established by carrier.

13. The passenger for implementation of booking can address carrier or the authorized agent is direct in Items of sale of transportations or by phone, e-mail, etc., or to make passenger seat and transportation reservoir independently through information systems.

14. The passenger when booking gives necessary information on the personal data and, in the presence, - about special conditions of transportation of the passenger, baggage.

In case of refusal the passenger from provision of information necessary for booking, booking is not made.

The passenger when booking specifies number of the mobile phone or different way of communication for its informing.

15. When booking passenger seat and transportation reservoir for the passenger carrier or the authorized agent:

provides to the passenger the reliable and complete information about the schedule of movement of aircrafts of this carrier, availability of empty passenger seats and transportation reservoirs on flights of this carrier along transportation route, rates and conditions of application of rates, including information on terms of return (non-return) of the transportation payment paid for transportation, rules of this carrier, on terms of the contract of airborne transportation of the passenger, terms of service onboard the aircraft, aircraft type, carrier which will actually transport.

15.1 When booking the authorized agent has the right to provide to the passenger additional services in matching of optimum route of transportation, the carrier(s) performing transportation along transportation route and the transportation carriage charge taking into account rates and conditions of their application.

16. When booking passenger seat and transportation reservoir for the passenger the carrier or the authorized agent has the right not to assign to the passenger specific passenger seat in inside of the aircraft with the declared servicing class. In this case number of the passenger seat allocated to the passenger is specified in case of registration of the passenger.

17. Booking under the ticket which is drawn up with open date of departure is made in the presence of empty passenger seats and free transportation reservoir on flight of carrier within validity of airborne transportation of the passenger.

18. If the passenger having the open ticket of departure requests transportation booking, and the carrier has no opportunity to provide passenger seat and transportation reservoir during the term of the agreement, then the carrier or the authorized agent shall make booking on the next flight on which there is empty passenger seat and transportation reservoir of that class of servicing which corresponds to the paid rate.

19. Booking of transportation reservoir is made for load by carrier or the authorized agent.

20. The consignor when booking transportation reservoir shall report to carrier or the authorized agent information on data of the consignor and the consignee, the name of load, expected date of sending, gross weight (further - weight) and load amount, dimensions of each cargo piece, quantity of cargo pieces, address conditions with load, the properties of load requiring special conditions or precautionary measures in case of its transportation, storage and processing.

21. Before booking of transportation reservoir the carrier or the authorized agent makes check of load regarding reference of load or its part to categories of dangerous goods for load. Check of load determines opportunity and conditions of transportation of dangerous goods.

22. When booking transportation reservoir for load carrier or the authorized agent:

provides to the consignor information on the schedule of movement of aircrafts of this carrier, rates and conditions of their application, rules of this carrier, on terms of the contract of airborne transportation of load, availability of free transportation reservoir, the tonnage on flights of this carrier along transportation route.

22.1 When booking transportation reservoir for load the authorized agent has the right to provide to the consignor additional services in matching of optimum route of transportation, the carrier(s) performing transportation along route and the transportation carriage charge taking into account rates and conditions of their application.

23. When booking by the authorized agent information according to the priority parameters of conditions of transportation set by the passenger, the consignor and/or transportation conditions, general concerning each carrier, is provided to the passenger, the consignor.

24. The carrier and the authorized agent has no right to transfer information obtained from the passenger or the consignor, to the third parties, except as specified, stipulated by the legislation the Russian Federation or international treaties of the Russian Federation.

25. For booking it is necessary to approve transportation with carrier:

1) the passenger with the child up to 2 years;
