About approval of Licensed conditions of implementation of economic activity on mining from the fields having nation-wide value and included in the State fund of mineral deposits

According to article 8 of the Law of Ukraine "About licensing of certain types of economic activity" and in pursuance of the resolution of the Cabinet of Ministers of Ukraine of 14.11.2000 of N1698 "About Approval of the List of Bodies of Licensing" we order:

1. Approve Licensed conditions of implementation of economic activity on mining from the fields having nation-wide value and included in the State fund of mineral deposits (further - Licensed conditions) which are applied.

2. To management of licensing of the State committee of Ukraine concerning regulatory policy and entrepreneurship (Ivanchenko O. B.), the Public geological service (Proskuryakov O. A.) in accordance with the established procedure to provide provision of this order on state registration in the Ministry of Justice of Ukraine.

3. To the public geological service (Proskuryakov O. A.) provide the publication of this order in mass media.

4. To impose control of execution of this order on the Acting Chairman of the State committee of Ukraine concerning regulatory policy and entrepreneurship Vashchenko K. O. and First Deputy Minister of protection of the surrounding environment of Ukraine Glazunov S. M.

Licensed conditions of implementation of economic activity on mining from the fields having nation-wide value and included in the State fund of mineral deposits

1. General provisions

1.1. These Licensed conditions N1698 "About Approval of the List of Bodies of Licensing" are developed according to the Law of Ukraine "About licensing of certain types of economic activity", the Code of Ukraine about subsoil and the resolution of the Cabinet of Ministers of Ukraine of 14.11.2000, determine conditions of implementation of economic activity on mining from the fields having nation-wide value and included in the State fund of mineral deposits (further - mining), within the territory of Ukraine, its continental shelf and exclusive (sea) economic zone.

1.2. Licensed conditions are obligatory for all subjects of housekeeping irrespective of their forms of business and patterns of ownership performing activities for mining.

1.2.1. If the subject of housekeeping performs economic activity on mining not in full, and partially or from separate special works, then licensed conditions extend to the subject of housekeeping in part which establishes requirements to implementation of the economic activity specified in the license.

1.3. Licensed conditions determine organizational, qualification, production and other requirements of implementation of economic activity by mining.

1.4. The terms determined in these Licensed conditions are used in the following value:

a) production of combustible minerals - production of gaseous minerals, including methane of coal and technogenic fields; production of liquid minerals, including technogenic fields; production of solid minerals;

b) production of metal and nonmetallic minerals of radical, loose and technogenic fields - production of ferrous, non-ferrous, rare, scattered, rare-earth and radioactive metals; production of nonmetallic raw materials for metallurgy; production of mining chemical raw materials; production of mining raw materials (except for jewelry and jewelry and ornamental raw materials); production of agrochemical raw materials; production of construction raw materials;

c) production of waters - production of underground and surface water and therapeutic muds.

1.5. Works on mining and the services connected with mining which are carried out according to these Licensed conditions are given in appendix 1. Reference of minerals to nation-wide value, is performed according to the List of minerals of nation-wide value approved by the resolution of the Cabinet of Ministers of Ukraine of 12.12.94 of N827.

1.6. The license for mining grants the right to the subject of housekeeping on implementation of specific type or several work types provided by item 1.5.

1.7. For receipt of the license the subject of housekeeping submits the application for licensing to Gosgeolsluzhbu (appendix 2).

For receipt of the copy of the license, the duplicate of the license or in case of renewal of the license the subject of housekeeping submits to Gosgeolsluzhbu the application according to appendices 3, of 4, 5.

2. Requirements to implementation of economic activity on mining

2.1. Economic activity on mining is performed with observance of requirements of the current legislation concerning use of natural resources.

2.2. The subject of housekeeping carries out activities for mining under following conditions:

2.2.1. Organizational:

availability in structure of the company of the functional and auxiliary structural divisions necessary for activities implementation;

completeness specialists, the corresponding qualification which provide performance of works, specified in the license, other engineering employees and workers;

availability of job descriptions with distribution of obligations, powers and responsibility of officials;

completeness of the company computer and organizational facilities, the licensed software for implementation of economic activity;

availability of necessary engineering constructions;

availability of the special equipment, machines and mechanisms which are used, made according to standards or specifications and correspond to the scope specified in the maintenance instruction;

availability of the buildings, rooms, the production sites equipped taking into account unhealthy work conditions and answering to sanitary standards according to the State health regulations of planning and building of settlements, approved by the order of the Ministry of Health of Ukraine of 19.06.96 of N 173, registered in the Ministry of Justice of Ukraine 24.07.96 for N379/1404;

observance of requirements of the Fire safety regulations in Ukraine approved by the order of the Ministry of Ukraine concerning emergency situations of 19.10.2004 of N 126, registered in the Ministry of Justice of Ukraine 04.11.2004 for N1410/10009, in case of performance of works.

2.2.2. Technological:

availability of the feasibility statement on work on mining;

availability of the production schedules developed according to the project and the work plan on mining. The project of production provides completeness of withdrawal and complex rational production of useful components, and production schedules - requirements to technological level, complex of processing equipment, conditions of effective and its safe operation, quality of the leaving products, qualifications of personnel, labor protection and the surrounding environment from pollution. The rules of technical operation, projects and plans of development of mineral deposits approved by the order of the head of the subject of housekeeping and approved according to the Code of Ukraine about subsoil with the Ministry of protection of the surrounding environment of Ukraine and Gosgorpromnadzor;

compliance of technological means to requirements of the specifications and technical documentation of manufacturing plant, repair documentation, to requirements for labor and environmental protection, and work and operation of technical means of the increased danger are performed according to the permissions got according to the Procedure for issue of permissions of the State committee on supervision of labor protection and its territorial authorities approved by the resolution of the Cabinet of Ministers of Ukraine of 15.10.2003 of N1631.

3. Special requirements for implementation of economic activity for mining

3.1. The subject of housekeeping, performing mining, shall:

develop and approve (the order of the head of the subject of housekeeping) traffic patterns of the extracted mineral raw materials on production sites and storage locations taking into account composition of initial raw materials, conditions of specific production, features of engineering procedure and requirements to end products;

develop and approve (the order of the head of the subject of housekeeping) technically and economically reasonable regulations of withdrawal and regulation of losses;

ensure safety of minerals in the course of their production;

perform determination of quality of raw materials and end product, determination of content of the basic and the accompanying mineral in the laboratories certified according to the Rules of power and certification in the state metrological system approved by Gospotrebstandart's order of Ukraine of 29.03.2005 of N 71, registered in the Ministry of Justice of Ukraine 13.04.2005 for N392/10672;

conduct register of the extracted minerals;

perform operational investigation of mineral deposits and other geological researches, carrying out surveying works;

conduct and store geological, geophysical, surveying and executive technical documentation, and also samples of rocks and ores, duplicates of tests;

carry out works as the methods and methods excluding excessive destruction of soil cover and environmental pollution and providing effective recultivation of the territory;

bring in the government budget payment for mining according to the current legislation;

observe procedure for creation and submission due dates of the statistical reporting in the procedure established by the legislation.

3.2. The subject of housekeeping the geological information necessary for implementation of works on mining, shall receive according to the Regulations on procedure for the order geological information approved by the resolution of the Cabinet of Ministers of Ukraine of 13.06.95 of N423.

3.3. Liquidation and preservation of mining objects or their sites shall be performed according to the Procedure for approval of questions of liquidation and preservation of mining objects or their sites approved by Gosnadzorokhrantrud's order of 12.03.99 of N 41, registered in the Ministry of Justice of Ukraine 09.04.99 for N225/3518.
