About provision of pensions of the military personnel, faces of the commanding and ordinary structure of law-enforcement bodies, the Investigative Committee, the State committee of judicial examinations, bodies and divisions on emergency situations and bodies of financial investigations

Section I. General provisions

Article 1. The main terms used in this Law and their determinations

For the purposes of this Law the following main terms and their determinations are used:

military service - military service in Armed Forces, transport, internal, border, railway troops, the state security agencies, Committee for State Security of the former USSR, bodies of the border service, other troops and military forming;

military personnel is the military personnel of Armed Forces, transport, internal, border, railway troops, state security agencies, Committee for State Security of the former USSR, bodies of the border service, other troops and military forming;

faces of the commanding and ordinary structure are faces of the commanding and ordinary structure of law-enforcement bodies, the Investigative Committee, the State committee of judicial examinations, bodies and divisions on emergency situations and bodies of financial investigations of the State Control Committee;

pension - monthly state money payment which is appointed by the serviceman, to faces of the commanding and ordinary structure for the purpose of compensation of the income lost in connection with dismissal from military service or from service or in case of approach at them of disability, and to members of their families - in case of loss of the supporter;

service - service in law-enforcement bodies, the Investigative Committee, the State committee of judicial examinations, bodies and divisions on emergency situations and bodies of financial investigations of the State Control Committee;

family members are the members of the family of the military personnel, faces of the commanding and ordinary structure specified in article 30 of this Law.

Article 2. Right to provision of pensions, types and condition of provision of pensions

The right to provision of pensions according to this Law is granted to persons who are constantly living in the Republic of Belarus on the date of award of pension from among the military personnel, the faces of the commanding and ordinary structure discharged from military service or from service in the former USSR or the Republic of Belarus and members of their families, and also to persons specified in part two of article 59 of this Law.

The conditions provided by this Law, regulations and procedure for provision of pensions also extend to persons who are constantly living in the Republic of Belarus from among the military personnel, the faces of the commanding and ordinary structure discharged from military service or from service in the State Parties of the Commonwealth of Independent States, pensions to which were granted according to international treaties of the Republic of Belarus on social security of the military personnel, faces of the commanding and ordinary structure of law-enforcement bodies and members of their families (further - the international agreements on social security) and this Law, and also on the members of their families who are constantly living in the Republic of Belarus.

The military personnel of officers, ensigns, warrant officers, sergeants and foremen, soldiers and sailors passing military service under the contract (further - the military personnel passing military service under the contract), and also faces of the commanding and ordinary structure in the presence of the length of service established by this Law on military service and (or) on service have the right to life pension for long service.

The military personnel, persons of the commanding and ordinary structure who became disabled people under the conditions provided by this Law acquire pension entitlement on disability.

In case of death or the death of the military personnel, faces of the commanding and ordinary structure members of their families have pension entitlement on the occasion of loss of the supporter.

To the military personnel, persons of the commanding and ordinary structure having the right to provision of pensions, pensions according to this Law are granted and paid after dismissal from military service or from service.

To the military personnel, persons of the commanding and ordinary structure of disability pension, and to members of their families pensions on the occasion of loss of the supporter are granted irrespective of duration of military service or service.

Article 3. Persons having the right to pensions on an equal basis with military personnel of compulsory military service and members of their families

Conditions, regulations and the procedure for provision of pensions established by this Law for the military personnel of compulsory military service and members of their families, respectively belong also (unless otherwise specified) to:

a) to guerrillas and members of their families (except specified in article 4 of this Law);

b) the worker and the employee of the corresponding categories determined by the Council of Ministers of the Republic of Belarus working in the period of the Great Patriotic War in war zones (on front sites of the railroads, on construction of defensive boundaries, naval bases, airfields and another), and to members of their families;

c) to the citizens who were in structure of destructive battalions, platoons and groups of protection of the people and members of their families;

d) the person liable for call-up called on military or special charges, to the citizens who were on occupations or training sessions during passing of service by them in reserve and members of their families;

e) to the workers of the militarized protection who were not subject to the national social insurance, faces of the younger commanding and ordinary structure of service of special communication of the Ministry of Communications of the former USSR and members of their families;

e) to the citizens passing alternative service and members of their families. At the same time disability pensions and on the occasion of loss of the supporter are appointed by him on conditions, in the sizes and procedure established for the military personnel of compulsory military service, recognized by disabled people (the dead or the dead) owing to the reasons specified in the Item of article 21 of this Law.

Article 4. Persons having the right to pensions on an equal basis with the military personnel passing military service under the contract and members of their families

Provision of pensions of persons holding the command positions corresponding to officers positions in guerrilla groups and connections and members of their families, and also the women accepted in voluntary procedure on military service to positions of soldiers, sailors, sergeants and foremen, and members of their families is performed on the bases established by this Law for the military personnel passing military service under the contract and members of their families.

Article 5. Provision of pensions of the military personnel, faces of the commanding and ordinary structure and members of their families of the states with which the Republic of Belarus signs the international agreements on social security, and also arrived to the Republic of Belarus
