About approval of forms of the reporting on hearing of cases by Appeal and local economic courts and Instruction for their filling and representation

According to the Law of Ukraine "About judicial system of Ukraine", the Regulations on Public judicial administration of Ukraine approved by the Presidential decree of Ukraine of March 3, 2003 N 182, and for the purpose of ensuring timely receipt of the reporting on consideration by Appeal and local economic courts of legal cases and materials I ORDER:

1. Approve forms of the reporting on hearing of cases by Appeal and local economic courts: N1-AC "Report on Consideration of Economic Cases by Local Courts", N2-AC "Report on Results of Review of Economic Cases on Appeals" (are applied).

2. Approve the Instruction for filling and representation of forms of the reporting on hearing of cases by Appeal and local economic courts it (is applied).

3. To chairmen of Economic Courts of Appeal to represent to Public judicial administration of Ukraine (further - GSA of Ukraine) the reporting under the N2-AC form to the 10th coming behind the accounting period, the copy - to territorial administration of GSA of Ukraine.

4. To represent to chairmen of local economic courts GSA of Ukraine the reporting under the N1-AC form to the 10th coming behind the accounting period, the copy - to territorial administration of GSA of Ukraine.

5. To represent GSA of Ukraine to the State committee of statistics of Ukraine the summary reporting on hearing of cases under Ukraine to the 30th coming behind the accounting period, and their copies - to the Supreme Court of Ukraine no later than 3 days after representation of statistics of Ukraine to the State committee.

6. To management of the organization of work on maintaining legal statistics, clerical work and archive of courts (Bukina L. E.) bring the order to the attention of chairmen of Appeal and local economic courts.

7. To chairmen of the courts to inform of this order of workers of the office of courts.

8. To impose control over the implementation of this order on the vice-chairman of GSA of Ukraine O. A Roll.

Instruction for filling and representation of forms of the reporting on hearing of cases by Appeal and local economic courts

1. General provisions

1.1. This Instruction determines rules of filling of reports on consideration by Appeal and local economic courts of legal cases and materials (further - reports), procedure for their creation and representation.

The rules stated in the Instruction are based on requirements of the current legislation.

1.2. In court the worker of the office of court (the consultant, the assistant to the chairman of justices, the assistant judge, the legal statistics specialist) to whom the chairman of justices or person fulfilling its duties according to the current legislation assign obligations on creation of reports is responsible for observance of requirements of this Instruction, and control of this site of work is exercised by the chairman of justices.

1.3. Reports contain data on the number of the cases and materials which were under consideration, considered and are not considered as of the beginning and the end of the accounting period.

1.4. Reports are constituted by accumulative result of data for the corresponding accounting periods: half-year and year.

1.5. Primary reports on consideration of legal cases and materials are constituted based on the relevant documents of primary accounting of cases.

1.6. The organizations originators of information in which reporting data additions and other misstatements are revealed make corrections to reports irrespective of who established availability of additions and other misstatements in reports, and submit the corrected reports to all addressees to whom doubtful data were sent. 2. Procedure for submission of reports

2.1. Primary reports on consideration of legal cases constitute Economic Courts of Appeal of areas, Economic Courts of Appeal of the cities of Kiev and Sevastopol, Economic Court of Appeal of the Autonomous Republic of Crimea, local economic courts (further - courts).

2.2. The public judicial administration of Ukraine (further - GSA of Ukraine) constitutes the summary report on consideration of legal cases by courts. The report is signed by the contractor and the head of the structural unit of GSA of Ukraine performing data of reports.

2.3. Information on procedure and terms of submission of reports contains on the title page of each report.

2.4. Chairmen of the courts, chiefs of territorial administrations of public judicial administration, and also direct contractors of reports are responsible for reliability and timely submission of reports. Specified persons sign reports. Persons who fill them are responsible for reliability of documents of primary accounting.

2.5. Reports are constituted in duplicate. The first copies of reports remain in court where are stored in special case on the nomenclature of cases of court, others - go to the addressees specified on the title page of the report.

2.6. GSA of Ukraine submits summary reports on hearing of cases and materials across Ukraine to the State committee of statistics of Ukraine to the 30th coming behind the accounting period, copies - to the Supreme Court of Ukraine no later than 3 days after representation of statistics of Ukraine to the State committee.

2.7. Reports go in electronic and paper type with the cover letter prior to the due date. Indicators of reports in paper form shall correspond to indicators of reports in electronic form.

3. Procedure for filling of reports of Trial Courts

3.1. Remaining balance of unconsidered cases is specified the beginning of the accounting period as of January 1 of accounting year.
